Subject: Application against the FIR registered by Neha Sharma

against Himanshu Sharma (Husband) and against his Sister Cheena

Kapoor. Under Dowry Prohibition Act and other relevant provisions of

Indian Penal Code

Sir/Madam,

The Applicant respectfully submits as under:

1. That the applicant herein is the husband of complainant and a

peaceful and law obeying citizen of India.

2. That the marriage of the applicant was happily done in the year

2007 as per mutual consent and understanding between both

the families.

3. That on 4 June 2020, the applicant was little drunk and came to

home from his factory and after coming home the applicant has

gone to sleep in his room.

4. That the applicant did not troubled anyone home and there was

no argument between applicant and the complainant, 4 to 5

 neighbors are witness of this. Their phone no. and details are

given in the application.

5. That all neighbors have mentioned many times that my wife

Neha Sharma the complainant herein had scolded and beaten

my children every now and then while the applicant stay out of

house in factory for work.

6. That it was also witnessed by neighbors that the father of

applicant Sh. Jeevan Lal Sharma aged 66years has never done

any brutal act against the complainant and never said any wrong

word to the complainant.

7. That the sister of applicant Cheena Kapoor has always been

obedient to the complainant i.e., Neha Sharma the wife of the

applicant, and have never said any wrong words to the

complainant. My neighbors are witness of all these.

8. That the sister of applicant occasionally visit’s to the applicant’s

house only to enquire about the health of the father. On 4 th of

june the brother I law of the applicant Abhishek Malhotra and

father in law Sweet Malhotra called my Jijaji Praveen Kapoor to

ask Himanshu Sharma to improve himself otherwise we will do

that.
 9. That all throughout the 14 years of marriage the applicant has

never done any crual act towards his wife and also has never

misbehaved with the family members of the complainant. The

applicant has many times told the complainant’s parents that

the complainant’s voice is very loud and provocative (all my

neighbors are witness to that) but they replied that her behavior

and voice is same with everyone.

10. That the applicant never told to the complainant to leave the

matrimonial home under any circumstance on the day of 5 th of

June she left the matrimonial house without informing anyone

also she took away with herself all her cloths and jewelry without

informing anyone and without anybody’s consent. No one in the

family knows that what other thing she had taken away with her.

In the light of all these facts and witness statement given by my

neighbor’s the applicant denies all the false allegations stated

within complaint by the complainant under section 498-A of IPC,

Dowry Prohibition act or any other provision of IPC.
