AGREEMENT

KNOW ALL MEN, BY THESE HERE PRESENTS, this AGREEMENT entered into
by and between:

________________________________________, Filipino Citizen, of legal age,


(single/married) and a resident of
__________________________________________________, hereinafter known as the
FIRST PARTY;

and

_________________________________________, a Public School duly established and


operated under the Laws of the Republic of the Philippines, under the supervision and
control of the Department of Education, herein represented by _____________________,
in his/her capacity as the Schools Division Superintendent of DepEd Schools Division
Office of Cagayan, hereinafter known as the SECOND PARTY;

WHEREAS, the Department of Education requires persons with qualifications consistent


with those prescribed under DepEd and Civil Service rules to assist in DepEd’s performance of
its educational mandate;

WHEREAS, such persons who are otherwise not yet applicants to vacant positions or are
otherwise not yet qualified for a teaching position may extend such service on a voluntary basis
to DepEd;

WHEREFORE, the Parties do herby covenant and agree to the following:

1. The FIRST PARTY shall volunteer to teach _____________________________classes;

2. The volunteer teaching is understood to be incapable of establishing an employer-


employee relationship between the Parties. The volunteer teaching is not subject to
monetary compensation;

3. Despite the absence of an employer-employee relationship, the FIRST PARTY
recognizes the supervision and control to be exercised over him/her by DepEd authorized
personnel;

4. The FIRST PARTY must undertake the necessary preparations before teaching to ensure
quality experiences and care for the pupils;

5. The FIRST PARTY must adhere to the standards and rules set by Deped. In case of an
offense, while the absence of an employer-employee relationship precludes disciplinary
sanctions, appropriate criminal and civil actions may still be pursued if warranted;

6. The SECOND PARTY, through the School Head, shall supervise the volunteer teachers
to ensure that classes are implemented according to standards and guidelines set;

7. The SECOND PARTY, through the School Head shall certify reports, accomplishment
reports, attendances/daily time records, and class programs prepared by the FIRST
PARTY;

8. The SECOND PARTY shall only recognize volunteer work that conforms to the Deped
standards, and may terminate the volunteer teaching of the FIRST PARTY for
unsatisfactory performance, to be determined by the School Head, subject to validation
by pertinent DepEd authorities if the evaluation is challenged;

9. The FIRST PARTY concedes that the volunteer teaching does not guarantee
regularization, nor does it oblige the SECOND PARTY to absorb the FIRST PARTY
into the national plantilla;

10. The volunteer teaching may be used as “teaching experience” that could be credited
during the assessment of the FIRST PARTY if he/she opts to apply for a vacant teaching
position, subject to the criteria for evaluating “experience” in the assessment as provided
for in relevant DepEd and CSC rules;

11. This AGREEMENT shall be construed in conformity to pertinent Philippine laws and
rules.
