Dear Dr. Moreno:

This is in compliance to the request of this good office for a written Answer to
show cause why the undersigned should not be suspended as provided in GPPB Resolution
No. 40-2017, particularly Sec. 4.1 (a) & (b) thereof, which reads:

4.1 Procurement stage.

During the procurement stage, pursuant to Section 69 of R.A. 9184, the


procurement entity shall impose on bidders or prospective bidders the penalty of
blacklisting for one (1) year for the first offense, blacklisting for two (2) years for
the second offense, from participating in the public bidding process, without
prejudice to the imposition of additional administrative, civil, or criminal sanctions,
as provided by applicable laws, for the following violations:

a.) Submission of eligibility requirements containing false informations or falsified


documents.

b.) Submission of Bids that contain false information in the Bids in order to
influence the outcome of eligibility screening or any other stage of the public
bidding.

The undersigned most respectfully insist that a suspension or blacklisting is not in


order in this case. Foremost, the procurement entity should consider the fact that the
project has been awarded, implemented, satisfactorily completed and turned over to the
procuring entity, without any violations in the contract and within the stipulated period.
The issue of alleged infractions during the procurement stage has therefore become moot
and academic.

Further, the above-mentioned provision of the Rules speaks of eligibility


requirements which if concealed or undisclosed would affect the outcome of the eligibility
of the contractor to undertake the project. The main purpose of disclosing the contractor's
other on-going projects is to determine its financial eligibility. At the time of the bidding of
the subject project, the Net Financial Contracting Capacity (NFCC) of the undersigned
amounts to One Hundred Twenty Five Million Two Hundred Two Thousand One Hundred
Sixty Pesos and Forty Centavos (Php 125, 202, 160. 40) and not even a quarter of it was
utilized at that time. A copy of the Computation of Net Financial Contracting Capacity
(NFCC) of the undersigned is hereto attached for your perusal.
