NOTICE UNDER SEC 80 SUIT BY OR AGAINST GOVERNMENT

1. That the applicant is a Pvt Ltd Co. registered under the companies Act, 1956 in the
office of Registrar, companies, Phagwara on 08-08-2009 and running its business in
the name and style “Custorium Waste Handling Pvt Ltd. having its registered office at
Industrial Area Phagwara-Phase 11 J.P Nagar.
2. That defendant 1&2 herein invited bids from interested companies through Gem
Portal for purchasing ‘ Waste Containers, Dustbin or garbage bin, since the applicant
is engaged in manufacturing of solid waste equipment therefore appointment
participated in the tender process and on 14-11-2019, in the aforementioned matter
applicant has received order of supply of containers for Rs. 14 Lakh, (Fourteen Lakh
only)
3. That After the containers were ready for delivery. The applicant has received two
letters for cancellation of order through email. As the defendant has breach the terms
and conditions of Gem Portal. Copy of the letter has been marked as Annexure No.1
to this notice.
4. That being helpless on 06-01-2020, the applicant co. sent a letter to the defendant No-
1 stating therein that manufacturing of dustbin has been completed by the applicant on
18-12-2019 and further the intimation of completion of manufacturing of dustbin has
already been provided to defendant No-1. The applicant company is trying to generate
the E-way bills to supply the dustbin within time, but the respondent authorities not
paid any heed to the grievances to the applicant Co.
That feeling aggrieved by the cancellation order dated 31-01-2020 the applicant herein
preferred the respondent to compensate for breach of Gem Portal, amount of Rs.14 Lakhs,
(Fourteen Lakhs only /- with 12% with additional Interest). I hereby give you notice that if
the said amount is not paid, my client will, on the expiry of two months’ notice, file a suit
against you for the recovery of Rs14 lakhs as damages and expenses incurred by him, at your
entire risk as to cost and consequences.
