AFFIDAVIT OF WITNESS
I, IVY NAGAC SELORICO, of legal age, Filipino, married,
and a resident of Barangay Macabalan, Cagayan de Oro City,
assisted by counsel, after having been duly sworn to an oath
in accordance with law hereby depose and state:
1. I am a member of the Sangguniang Barangay of
Barangay Macabalan, Cagayan de Oro City.

2. I do not personally know private complainant in this case

but I learned to be familiar of him because he frequented
the barangay hall with regard his case filed against
respondent before the Office of the Lupong
Tagapamayapa of Barangay Macabalan.

3. Every time he visits the barangay hall, he always

complains that he is not able to meet with the
respondent when his case is called for hearing before the
Office of the Lupong Tagapamayapa. However, he goes to
the barangay hall in the morning when the case is
scheduled in the afternoon.

4. In one of his visits, I remember that he brought with him

a carpenter to demolish the house where private
complainant lives.

5. Few days later, he again went to the barangay hall. At the

time and date alleged by the private complainant when
the “threat” happened, I was at the barangay hall also.
Private complainant immediately proceeded to the
Session Hall of the Barangay Macabalan, Cagayan de Oro
when he saw private complainant inside.

6. I also noticed that when he went there, he was alone as

he brought with him his helmet and drove his own
motorcycle.

7. He was shouting angrily at respondent, “nganong dili ka
muhawa, gahi kaayo ka pahawaon”. He was always angry
and hysterical everytime he visits our office.

8. Consequently, Edna Paguia Diaz, who is one of our

barangay employees advised him to not cause a scene at
the barangay hall and to respect the office. So he left the
barangay hall but he was still shouting even when he
was already outside and he was on his way to the Office
of the Lupong Tagapamayapa.

9. I am executing this affidavit to attest as to the truth of

the foregoing facts and for whatever legal purposes this
may serve.

and was identified through competent evidence of identity
consisting of her COMELEC VIN 4305-0633A-
B2886INS200001-8. I certify that I have examined the affiant
and I am satisfied that he understood all the foregoing
allegations of her Affidavit of Witness and that she voluntary
executed the same.
