Grievance Description

Kind attention: AWBI - CZA, concealed actual report before the, Delhi High Court in
W.P.(C) 4391/2020 and C.M. No. 15802/2020, submitting their reply as No animals of
circuses alive, who were registered before 2008 - 2009, except Elephants & these
Elephants were traded under cover of donation without CWLW approval, Elephant
Project instructions dated 8-1-2008 were badly overruled.
How & why Radhe Krishna Temple Elephant Welfare Trust donated animals to Sardar
Patel Zoological Park duly approval of CWLW of Gujarat, whereas Radhe Krishna
Temple Elephant Welfare Trust, neither recognized under section 38-H of Wildlife
Protection Act, 1972 nor animals were declared under Stock Rules, 1974 or 2003, hence
unlawful animals were legalize by Enforcement agencies of IFS cadre.
NOTE:
All animals, except Asiad Circus, Great Gemini Circus with Raymen Circus are alive,
whereas rest of circus animals are not immortal, died due to age factor, besides it all
Elephants of these circuses, with Greens Zoological Rescue and Rehabilitation Kingdom,
in Gujarat without recognition under 38-H of the Wildlife Protection Act, 1972, consent to
operate.

Greetings,
The mandate of AWBI to minimize the stress & pain on injury but AWBI became tool of publicity
& politics without any specialization, the Performing Animals Sub Committee (PASC - Film)
constituted to grant permission - No objection certificate about use of animals in films & Serials
with documentary but I have so many complaints of corruption, whereas Cock fights allowed in
film Kesari, which is not acceptable, besides it many matters decided by PASC without competency
as use of animals for education purpose is exempted under 27 (b) of the Prevention of Cruelty to
Animals Act, 1960.
Whereas, section 38-A of the Prevention of Cruelty to Animals Act, 1960, describe the procedure of
Rules and regulations to be laid before Parliament:
Every rule made by the Central Government or by the Committee constituted under section 15 and
every regulation made by the Board shall be laid, as soon as may be after it is made, before each
House of Parliament, while it is in session, for a total period of thirty days which may be comprised
in one session or in two or more successive sessions, and if, before the expiry of the session
immediately following the session or the successive sessions aforesaid, both Houses agree in making
any modification in the rule or regulation as the case may be, or both Houses agree that the rule or
regulation, as the case may be, should not be made, the rule or regulation shall thereafter have
effect only in such modified form or be of no effect, as the case may be so, however, that any such
modification or annulment, shall be without prejudice to the validity of anything previously done
under that rule or regulation.
Introduction of the Performing Animals (Registration) Rules, 2001, never approved by the both
Houses of Indian Parliament, keeping in view 38-A as stated above, all animals of 24 circuses,
registered under this Rule & PASC also permitted use of animal, whereas age of performing
animals never be kept in mind by incompetent corrupt officials of AWBI, adopting double
standards because without any transportation rules & regulations for Camels, allowed as
performing animals, besides it no vehicles as per specification of Bureau of Indian Standards are
being used to shift animals. Hence:
1. All animals with Circuses are retired, replaced by other animals, concealing facts.
2. The function of PASC is not legal as Performing Animals (Registration) Rules, 2001 not a passed
by the Parliament as per section 38-A of the PCA Act, 1960.
3. White paper needed.
Great Golden Circus microchip of elephants also replaced along with animals, performed at two
places Anand in Gujarat with Malegaon in Maharashtra, immediate attention required.

Immediate attention AWD with AWBI on attached representation:


OIPA: Indian People for Animals with Scouts & Guides for Animals & Birds opinions:
1. Why two petitions were moved as public Interest litigation instead Personal Interest
Litigation with hidden agenda, especially to target our traditions & culture for their gain
& profit
2. Why these two self styled establishments, never recognized by AWBI as AWOs
3. Why they are worried about Circus animals instead abandoned, unclaimed -
unproductive animals, abused all around
4. Why PETA India with FIAPO doesnt have shelter for animals in distress
5. Why PETA India CEO with others on the pay role for bread & butter
Whereas Indian Circuses are competent to handle their private owned animals, why
donation based establishments behind them with foreign funding, I strongly opposed their
hidden agenda for their gain & profit.
