Section All questions are compulsory each question have equal marks

1. Answer any three questions. Each question carries 3 marks.


a. An engineering student has made an invention which is novel, non
obvious and has industrial application. He has presented a paper in a
conference on the same on 15th of June 2020. He now wishes to file a
patent and approaches you as a patent consultant. How will you advise
him?

b. You went for a picnic to a nearby jungle with your friends. You found a
species of a plant in the jungle which you have never seen before. Your
Botany professor says even he hasn’t seen this species before. You decide
to file a patent on this species. What are your chances to get a patent?

c. A scientist has claimed to discover a machine which gives an output that is


1.5 times more than the input. This is an excellent invention on which he
wishes to file a patent, and approaches you as a patent consultant. How
will you advise him?

d. A person files a patent on the use of nutmeg in a mouthwash at the Indian


patent office. The patent gets published. An Ayurvedic doctor who knows
that this is a property reported already in Ayurveda, wants to oppose the
grant of the patent. How can he go ahead?

b. When is an invention considered to be Novel?
c. “non obviousness’ is the most litigated patentability criteria”-explain
d. What is fair use of copyright?
