Review Questions

1. Name two examples of capital crimes.

Two examples of capital crimes would be the murder of a police officer, and sexual
abuse of a minor.

2. Name two examples of federal crimes.

Two examples of federal crimes are a bank robbery and kidnapping.

3. Explain the difference between jails and prisons.

Jails are normally smaller and are there to keep in custody those waiting for trial as well
as prisoners serving short sentences for minor crimes or misdemeanors. Local police or
local government agencies usually run them.

Prisons are normally bigger than jail intended to lock up many criminals for longer
amounts of time. Either a state government or the Federal Bureau of Prisons (BOP)
typically operates them.

4. What is the difference between probation and parole?

Probation is a test given to criminals with minor crimes or first-time offenders to see if
they can be trusted to follow the law.

Parole comes later, letting the criminal get out of prison, but is under official supervision
after being set free from prison.

5. What are the three factors judges consider when setting bail?

The three factors a judge considers is the amount of proof the prosecution has, how
serious the crime is, and the possibility that the person everyone is pointing the finger at
will try to run away.
Critical Thinking Questions

1. Do you agree that incarceration is a better method of correction than


corporal punishment? Why or why not?

Incarceration is a better type of punishment in my opinion than corporal punishment. The


reason I believe this is because we are giving them a certain amount of time on becoming
a better person and having a second chance at a better life by looking back on the crime
or crimes they have done. Causing pain to someone may do something, but it is not right.
Hitting them where they hurt is the way to go and taking away their freedom to do
ANYTHING can really be a turning point in someone’s life. Having more time to
themselves to think about what they have done with their life and the decisions they have
made may affect them to the point that they want to change their way of life, and by
giving them the 2nd chance to redeem themselves I think is the best way to do so.

How are school rules similar to state and federal laws? What would the
typical American high school be like if there were no rules or
consequences for breaking them? Explain.

School rules are like state and federal laws because all laws and/or rules have a
consequence or have some sort of severe cost for not obeying them. School rules are the
principles of actions the school requires of its students. They also let students and parents
know what the school thinks is vital. The same thing goes with laws. Laws let us know
that we have certain things we have to abide by per each state, business, restaurant etc…
If there were no rules to follow at a typical American high school, or a punishment for
violating them, then teaching anything or learning anything would be a battle. The world
would crumble bit by bit and people would be getting hurt because of the lack of order.

2. Do you think criminals benefit more from community service or house


arrest? Explain.

I think criminals benefit more from house arrest than community service because to them
community service is not really anything. They think all they have to do is pick up
garbage from the side of the road and that is it. They learn nothing, but on the other hand,
these criminals get to know what jail feels like, just in the comfort of their home. They
learn better from their mistakes that way because they have to suffer the experience of
not going where they want to go, when they want to go and have to suffer the
consequences, so maybe next time they will think before making that kind of mistake
again.
3. Should community service always fit the crime, or should these
sentences be based on the needs of the community? Explain.

Community service should always fit the crime. Community service will help the
criminals to know more the values and ethos prevailing among the society.  

4. Do you think it is fair that some first-time offenders have to serve jail
time while others are allowed to enroll in diversion programs? Explain.

Depending on the crime they have done, is what determines it to me. People who have
committed a non-repetitive crime for the first time should be allowed to enroll in
diversion programs. Enrolling them in a diversion program is making them do something
they do not want to do, but also giving them a chance to change their way of life for the
better so they do not repeat the crimes they have already committed or do worse crimes. I
think the punishment should fit the crime.
