LITIGIOSUS (FRESHER’S MOOT COURT COMPETITION) 2019

RULES
The Competition shall be named as the LITIGIOSUS: Fresher’s Moot Court Competition .

ROUNDS

1. The Competition shall comprise of three rounds.

a) The First round shall host all the teams who have applied.
b) The Second round shall host the top four teams.
c) The Third round shall be the finale.
2. All rounds shall take place on October 16, 2019.
3. The Competition shall be held on a team wise basis, each team comprising of two speakers.

REGISTRATION

1. The team shall comprise of two speakers, both of them shall be students of the first semester of
the institution.

2. Each team shall register with Saumya Sinha of 3rd Semester by stating their “Name”, “Roll
Number”, “Section”, and “Contact Details” of both the participants through a Whatsapp text on
“7808140367”, latest by September 20, 2019.

3. No registration shall be accepted after September 20, 2019.

MEMORIALS

1. Each participating team shall prepare written arguments (memorials) for both the parties
Claimant/ Plaintiff/ Petitioner/Applicant and Defendant/Respondent.
2. The memorials must be firmly stapled.

3. The memorials should not have spiral binding.

4. The cover page of the Memorial must follow the colour scheme:

a) Blue for the Plaintiff / Claimant / Petitioner cover page

b) Red for the Defendant / Respondent cover page

5. A memorial shall be printed on one side of the A4 size page only. The text font for the main
body shall be 12, Times New Roman with font spacing of 1.5 and text font for the footnotes
shall be 10, Times New Roman with font spacing of 1.0. The margins shall be 1.5 inch on the
left side and 1.0 inch on other sides. The character spacing should be normal and neither
expanded nor condensed.

6. The memorial shall not exceed 20 pages excluding the front page and index of authorities.

7. The memorials submitted must contain the following,

a) Cover Page

b) Contents

c) Table of Abbreviations

d) Table of Authorities

e) Statement of Jurisdiction

f) Statement of Facts

g) Statement of Issues

h) Summary of Arguments

i) Arguments Advanced

j) Prayer

8. The teams are to submit the Soft copy of their memorials by 14th October, 2019 (11.59 PM) and
two hard copies from each side on 15th October, 2019 (4.00 pm). No late submission shall be
accepted under any circumstances.

9. The Memorials shall be evaluated by persons so appointed by the MCC.


CONDUCTION OF ORAL ARGUMENTS AND PROCEDURE

1. The draw of lots shall take place on October 15, 2019 at 5:00 PM.

2. Each team shall be given:-

a) 12 minutes for presenting their arguments in the preliminary rounds.

b) 14 minutes for presenting their arguments in the Semi-Final rounds.

c) 16 minutes for presenting their arguments in the Final rounds.

d) An extension of 2 minutes shall be allowed at the discretion of the judges.

3. It shall be compulsory for each member of the team to address the bench.

a) Each member of the team shall address the court for a minimum of 4 minutes in preliminary
rounds; 5 minutes in semi-final round and 6 minutes in the final round.

b) The members shall be allowed to pass chits.

c) The rebuttal/sur-rebuttal has to be done by one mooter only and it cannot be claimed as a
matter of right.

4. The teams are required to submit annexures/ compendium of the cases cited prior to the rounds
to the court masters.

5. The teams are to follow proper decorum inside the court room, failure of which shall attract
negative marking.

6. In case of a draw, the winner shall be decided by a two minute tie breaker between the two
teams.

7. In case of any dispute, the decision of the judges shall be final.

8. Scouting is prohibited and any team found indulging in the same shall be disqualified.
MOOT PROBLEM

1. The moot problem has been prepared by the committee members. Approaching any member
regarding the same shall lead to immediate disqualification.

JUDGING

1. There shall be a bench of two judges for the preliminary rounds.

2. There shall be a bench of three judges for the semi-finals.

3. There shall be a bench of five judges for the finale.

4. The judging shall be done by the students of the University who shall be selected by the MCC
after inviting applications from the students.

MARKING CRITERIA

1. The teams will be judged on a total of 300 points each (100 points per speaker and 100 points for
the memorial). The memorial marks shall be included in each round.

2. Each memorial shall be judged under the following heads:

a) Memorial and case citation structure.

b) Analysis and organization of facts and legal principles

c) Logical structuring of arguments

d) Use of authorities

e) Research skills

3. Each speaker shall be judged under the following heads:

a) Appreciation of facts

b) Identification and articulation of issues including jurisdiction

c) Clarity of thoughts, legal structure of arguments

d) Use of authorities and precedents

e) Presentation skills
f) Response to questions

g) Ingenuity and creativity

h) Court mannerism

i) Time management

The Marking Criteria and Marks allotted to compute the total of oral rounds is as follow:-

1. The Prizes shall be awarded for the following positions,

a) Winners

b) First Runners Up
c) Best Speaker

d) Best Memorial

MISCELLANEOUS

1. If any one of the members of a team is notified or informed of any detail or information
concerning the Competition, it shall be deemed as if the said team as a whole has been duly
notified or informed.

2. The dress code to be adhered to for the duration of the Competition is:

 Ladies: White salwar and kurta or white shirt and black trousers along with black coat and
black shoes.

 Gentlemen: White shirt, black trousers and black tie along with black coat and black shoes.

3. The Rules governing the conduct of the Competition should be strictly adhered to. Any deviation
thereof can attract penalties or disqualification at the sole discretion of the Competition
Administrator.

4. The Organizers reserve the right to amend, alter, vary or change, in any manner whatsoever, the
Rules governing the Competition, which would be communicated to the teams within a reasonable
time.
