ANSWER

I, PCPL FHINE SHAINA P BA-OD, of legal age, police officer by

profession and currently assigned at Manila Police District, United Nations
Avenue, Manila, after having been sworn on oath in accordance with law,
do hereby depose and say that:

1. I am the respondent in the administrative case in the above

entitled case for grave neglect of duty arising from a complaint filed by
PCPT MOISES FERNANDO M REYES, Chief, DAHU, MPD for being
allegedy absent without official leave (AWOL) on December 30, 2019 to
February 12, 2020 or a total of forty-days (45) days;

2. That such case is preposterous as she was illegally placed on

AWOL status effective December 30, 2019 pursuant to NCRPO SPECIAL
ORDERS NO. NCRPO-SO-AWOL-2020-1894 dated March 13, 2020
issued by PCOL MARIA LEONORA C CAMARAO, Chief, RPRMD,
NCRPO1 after she was hospitalized due to a Threatened Abortion
manifested by occasional bleeding coupled with severe stomach cramps.
Due to fear of miscarriage and loss of her baby she was conceiving for the
1st trimester, she applied for a Sick/Vacation Leave at the DPRMD of
Manila Police District which was approved by her immediate superiors at
the District Headquarters. This approval prompted her to seek the
assistance of her obstetrician and gynecologist to determine her status of
health and her conceived baby;

 3. But due to the declaration of National Pandemic due to Covid19,
all leaves were either cancelled or irregularly disapproved for those
application that was still on process which included her application for sick
leave despite the fact that she was immuno-comprised due to conception.
Due to this, she was placed on AWOL Status effective December 30, 2020.
Felt that such AWOL Orders was issued irregularly, she filed a request
from the Regional Director, NCRPO on June 3, 2020 for the lifting and
cancellation of her AWOL Orders NCRPO SPECIAL ORDERS NO.
NCRPO-SO-AWOL-2020-1894 . Such request was favorably acted upon
by RD, NCRPO through the issuance of NCRPO SPECIAL ORDERS NO.
NCRPO-SO-LV-2020-3652 dated June 22, 2020. In the said Orders, the
respondent was granted a fifty-three (53) days Sick Leave from December
30, 2019 to March 17, 20202.

4. To further release her of any liability arising from her placement to

AWOL Status by the nominal complaint, Chief, DAHU, MPD, the RD,
NCRPO further issued NCRPO SPECIAL ORDERS NO. 582 dated June
25, 20203 that cancelled and nullified NCRPO SPECIAL ORDERS NO.
NCRPO-SO-AWOL-2020-1894. In the said Orders entitled
CANCELLATION OF ABSENT WITHOUT OFFICIAL LEAVE, it stated that
“ABSENT WITHOUT OFFICIAL LEAVE (AWOL) of PCpl FHINE SHINA
PUNDINLAN BA-OD, 251971, REGIONAL HQS-ORPRMD-RPHAS,
NCRPO effective December 30, 2019 is hereby CANCELLED.

5. Hence, due to the intervening events and the issuances of orders

from the higher headquarters, she could not be possibly liable for any
offenses arising from neglect of duty as the dates being questioned that
she was absent without official leave has became moot and academic
considering the period effectivity of the grant of sick leave by RD, NCRPO
is the same as that being complained before this honorable office and that
the AWOL orders previoulsy and irregularly issued has been cancelled.

6. Hence, this administrative case must be dropped and closed

and dismissed outright either for FOR LACK OF MERIT.

7. That I am executing this affidavit to attest the veracity of the

foregoing facts.
