Subject: Continued Testing Cadence and Bye Weeks

We have extended our agreement with the NFLPA to continue daily COVID-19 testing,
except for game days, until further notice. BioReference Laboratories has been made aware of
this extension and is prepared to continue the current testing cadence.

Importantly, this agreement includes requiring daily testing for players and coaches during
clubs’ bye weeks in order to mitigate the risk of future transmission of the virus. Players and
coaches will not be permitted to leave the club city during the bye week and must provide daily
specimens for COVID-19 testing. Players and coaches who are currently exempt from testing
pursuant to the Screening and Testing Protocol will be required to report to the club facility for a
daily screening and temperature check. Under our August 3 side letter agreement with the NFLPA,
if a player misses a test without prior authorization from each of: (i) his club; (ii) the NFL
Management Council; and (iii) the NFL Players Association, he is subject to the following
discipline:

 First missed test: $50,000 fine;


 Second missed test: One game suspension without pay for Conduct Detrimental;
 Third and subsequent missed tests: Additional discipline for Conduct Detrimental
(including additional suspensions).
In addition, any player or coach who misses a daily test without authorization during the
bye week will be required to have five (5) negative PCR tests, each taken 24 hours apart, prior to
being permitted to re-enter the club facility. Players who miss mandatory team activities while
undergoing such re-entry testing are subject to additional discipline and/or lost earnings for events
missed (including games). Clubs must provide notice to their players about their obligations and

consequences for missing a test prior to the start of their respective bye weeks. We have attached
a sample notice document that you may use to provide this notice.
