PETITION

COMES NOW, petitioner through the undersigned counsel, and

unto this Honorable Court, most respectfully avers:

That, petitioner GENEROSA ALINSUGAY EMPLEO is of legal

age, married, Filipino, and the three other petitioners mentioned above
are all her children living with her, and they are all bona fide residents of
Brgy Glan Padidu, Glan, Sarangani Province for more than three (3)
years, where summons and other court processes can be served, while
respondent’s office is located at Brgy Poblacion, Glan, Sarangani
Province where summons and other Court notices can likewise be
served;

That, the herein petitioner is the legitimate daughter of spouses

ANGEL EMPLEO, later known as RAFAEL-ANGEL EMPLEO
YAMAMOTO and GENOVEVA FEROLINO ALINSUGAY. Attached
herewith machine copy of the marriage contract of Angel Empleo and
Genoveva Ferolino Alinsugay, marked as Annex “A”;

That, herein petitioner was born on 17 July 1958 at Glan-Padidu,

Glan, South Cotabato now, Sarangani Province. Her birth was
registered before the office of the local civil registrar of Glan, Sarangani
Province and she was registered by her father as GENEROSA
ALINSUGAY EMPLEO and the name of his father who registered her is
ANGEL EMPLEO. Attached herewith machine copy of the birth
certificate of Generosa Alinsugay Empleo, marked as Annex “B”;

That, on 19 October 1984, herein petitioner exchanged marriage

vows with CORNELIO V. FIGURACION before the Honorable Mayor
Tomas D. Guevarra of Mexico, Pampanga using the family name
EMPLEO as appearing in her birth certificate. Attached herewith
machine copy of the marriage contract of Cornelio V. Figuracion and
Generosa Alinsugay, marked as Annex “C”;

That, as a result of her marriage with Cornelio V. Figuracion, the

couple bore three male children namely; GENNEL ANDRE EMPLEO
FIGURACION born on 19 May 1985, EARLE EMPLEO FIGURACION
born on 16 September 1987, and JOHN GECO EMPLEO
FIGURACION, born on 15 December 1993. The above named children
of the herein petitioner adopted the name EMPLEO, as their middle
name. Attached herewith machine copies of the birth certificates of
Gennel Andre Empleo Figuracion, Earle Empleo Figuracion and John
Geco Empleo Figuracion, marked as Annexes “D”, “E” and “F”,
respectively;

That, on 27 July 2006, the Regional Trial Court, Branch 38,

Alabel, Sarangani Province, issued an order in connection with Special
Proceeding Case N0. 186 granting the petition of Angel Empleo to
change his registered name to Rafael-Angel Empleo Yamamoto to
include all documents relative to his person. Attached herewith certified
machine copies of the order dated 27 July 2006, marked as Annexes
“G”; “G-1”; “G-2”; “G-3”; “G-4” and “G-5”, respectively;

That, on 29 April 2009, after ANGEL EMPLEO has changed his

name to Rafael-Angel Empleo Yamamoto, the latter executed an
affidavit stating among others that herein petitioner is his legitimate
daughter and that she must also make necessary change as regards to
her surname/family name to include her descendants. Attached
herewith affidavit executed by Rafael-Angel Empleo Yamamoto,
marked as Annex “H”;

That, there being a change in the family name of her father from
EMPLEO to YAMAMOTO, petitioner is also intending to change her
surname name/family name in order to establish a better and closer
paternity and filiations between ascendants and descendants;

That, the petitioner is filing this petition for herself and in behalf of
her three (3) children in accordance with Rule 103 of the Rules of Court
and for the purpose of changing the surname name/family name of the
herein petitioner to include all documents relative to her person,
ascendants and descendants, such as her birth certificate, her marriage
contract, the marriage contract of her parents, birth certificate of her
children and all other documents relative to their identity in consonance
with the corrections made in the name of his father as stated in the
order in Special Proceeding Case N0. 186.

WHEREFORE, it is most respectfully prayed that after notice,

publication and hearing, the Registrar of the Local Civil Registry of
Glan, Sarangani Province be ordered to change the entries in the
certificate of live birth of the herein petitioner, her marriage contract,
marriage contract of her parents, and birth certificates of her three (3)
children, as follows:

I, GENEROSA ALINSUGAY EMPLEO, having been duly sworn to in

accordance with law hereby, depose and says:

1. That, I have caused the preparation and filing of the above petition;
have read and understood the same and the contents therein are true and
correct of my own knowledge and belief;

2. That, I have not theretofore commenced any action or filed any claim
involving the same issue in any court, tribunal or quasi-judicial agency and, to
the best of my knowledge, no such other action or claim is pending therein;

3. That, if I should thereafter learn that the same or similar action or

claim has been filed or is pending, I shall report that fact within five (5) days
therefrom to this Honorable Court wherein my aforesaid petition has been
filed.
