This case is before the court on the ex parte motion of the Plaintifis for a temporary
restraining order under Civil Rule 65.0[3).
The court has considered the motion, the affidavit filed herein, and the verified complaint
and it appearing to the court after due deliberation that the Defendant, Ashley Commercial
Group, LLC should be restrained and enjoined from performing excavation and bulldozing work
in and around the burial ground alleged in the complaint.
It further appearing to the court from the motion, the affidavit and the verified complaint of
the Plaintiffs that immediate and irreparable injury, loss or damage will be sustained by Plaintifis
iffa temporary restraining order is not issued, the court determining and finding that:
1. The rights of the Plaintiffs herein are being and will continue to be violated by the said
Defendant unless the Defendant is restrained.
2. The Plaintiffs will suffer irreparable harm and loss if Defendant is not restrained.
3. Plaintiffs have no adequate remedy at law.4. A restraining order herein is necessary to ensure and preserve the burial ground and
Plaintiffs’ rights,
5. Plaintiffs have alleged a substantial claim to a personal right
TTIS HEREBY ORDERED AND ADJUDGED that the Defendant, Ashley Commercial
Group, LLG, its officers, employees and all persons working through and under them, be and
hereby are immediately enjoined and restrained, directing and indirectly, from performing
excavation and bulldozing work in and around the burial ground alleged in the complaint until
further order of the court.
ITIS FURTHER ORDERED AND ADJUDGED that this restraining order shall issue
immediately and that a bond by the Plaintiffs, with surety, in the amount of $2,500 shall be

bond with surety is not posted, this Restraining Order shall be considered dissolved ab
