Sub: Regulating requests for counting of past service on submission of technical

resignation on or after 1.1.2004 by Lateral Entry 1 Direct Recruitee Senior
Scientists and Principal Scientists in the ICAR

This is in continuation of the Council's circular of even number dated 5
March, 2009 on the subject cited above.

On repeated requests, the Government of India have further reviewed the issue
concerning mobility of personnel amongst Central 1 State and Autonomous bodies while

working under pensionable establishments vide OM no. 28/30/2004-P&PW(B) dated 28
October, 2009.

It has now been decided by the Government of India to continue mobility of

Government servants 1 Autonomous body employees appointed on or before 31.12.03 and
who were governed under the old non-contributory Pension scheme of their respective
Governments 1 organizations in order to provide for the continuance of Pensionary benefits
based on combined service in accordance with the CCS (pension) Rules, 1972 as under:-

(a) Between the Central Govt. Departments covered under CCS(Pension) Rules, 1972;
and the Railway Pension Rules, 1993 or other similar non-contributory pensionable
establishments of Central Govt. covered by old Pension Rules other than
CCS(pension) Rules, 1972 ;

(b) Between State and Central Govt provided the employees were appointed in the State
Govt (s) on or before 31.12.2003 and covered under old pension scheme similar to
CCS (Pension) Rules, 1972;

(c) The pre-existing arrangement of mobility between State/Central Autonomous Body to

Cent~al 1 State ~vt and between autonomous bodies that were governed by old
pensIOn schemes 10 force upto 31/12/2003 vide OM No. 28/10/84P&PW dated
7/2/1086 and OM No. 28/l 0/84-Pension unit dated 29/8/1984 stand restored althOUgh
thos~ under CPF etc. will not be allowed entry into the old pension scheme on
appo1Otments from 1/1/2004.

These provisions are in modification / supersession of the earlier provisions

contained in DOP&PW OM dated 26-7-2005.

Accordingly, the guidelines as contained in point no. 3 of ICAR circular of

even numbr dated 5th March, 2009 stands amended to the above extent and all other
contents of the earlier circular shall remain the same.

It is requested that the amended provisions may kindly be brought to the

knowledge of all concerned and all such cases be processed in accordance with the
amended provisions.
