AFFIDAVIT-COMPLAINT

We, spouses RONILO TOLLO y LABORDO and SOFIA TOLLO y

ESTREMADORA , both of legal age, Filipino citizen, married, residing at Blk 11 Lot 6
Creeksite, UPS IV, Marcelo Green, Parañaque City after
having duly sworn to in accordance with the law do hereby depose and say:

1. That we are the complainants in the above-entitled case;

2. That we are formally charging respondent MARY JANE H. MALLORCA, with postal
address at no. Blk 13 Lot 5 Creeksite, UPS IV, Marcelo Green, Parañaque City, for
the crime of Unjust Vexation penalized under Art. 287-A of the Revised
Penal Code, committed as follows, to wit:

a) That on the morning of September 6, 2020, on or about 3:00 AM after a mauling incident
involving our daughter, SHELLA MAE TOLLO , I went to the respondent’s house on the
said address to confront her about the prior incident;

b) That while I, SOFIA TOLLO y ESTREMADORA, was outside their house, the
respondent shouted at me saying the following “MAGNANAKAW KAYO SA
ASOSASYON”;

c) That every time I and my husband pass by their area, I can see and hear people talking
behind my back as if they are mocking me with insults and harsh words;

d.) That as an officer of the Homeowner’s Association, my husband’s reputation was

damaged due to such an incident;

e.) That because of that unfounded allegation of us being thieves, I and my husband, the
complainants in this case experienced sleepless nights, besmirched reputation, wounded
feelings, and injured honor;

f.) That during one of the barangay hearings, the respondent admitted that she has no proof
of what she alleges against us and that she uttered such statements out of malice and ill-will;
 g.) That on September 30, 2020, I filed a complaint before the barangay, and
after several hearings, no amicable settlement was reached between the
parties as evidence the Certificate to File Action issued last October 7, 2020 which is hereto
attached as Annex “B”.

3. That I am executing this affidavit to attest to the truth of the foregoing statements,
and for the purpose of charging respondent MARY JANE H. MALLORCA for the crime of
Unjust Vexation penalized under Art. 287-A of the Revised Penal Code.

Affiant further sayeth none.
