5. Reasons for this Request :

The Contractor, ROLCO CONSTRUCTION & DEVELOPMENT CORPORATION, in its


letter dated March 24, 2017, request for WSO No. 1 due to RROW problems which
hampered its construction activities. Pertinent to its letter is the Certification of the
Punong Barangay dated March 17, 2017 stating that the contractor is unable to perform
construction activities at the site due to the refusal of affected stakeholders to allow
entry into their property.

Relative to this, the Project Engineer in its report dated March 21, 2017, detailed that
the affected stakeholders did not allow the entry of the contractor to work in their
respective area. He added that these stakeholders even refuse to sign the Permit to
Enter issued to them in relation to the Project.

Said unsigned Permit to Enter is attached herewith.

The Project Engineer also recommended for the suspension of works pending the
resolution of the RROW problem at the project site.

9. Remarks:

On the basis of the submitted documents indicated in the checklist of supporting


documents and attachments for DoTS and as per inspection conducted by our
personnel confirming the circumstances involved, this office finds this request for
Work Suspension Order No. 1 to be meritorious since the cause hereto due to RROW
problem is not the fault of the contractor and beyond the control of the
Implementing Office. The said request is in accordance with Sub-Section 9.1 and 9.2
of Annex “E” of IRR of RA 9184 which states that:

9.1. The procuring entity shall have the authority to suspend the work
wholly or partly by written order for such period as may be deemed
necessary, there exist right-of-way problems which prohibit the contractor
from performing work in accordance with the approved construction
schedule. The contractor shall immediately comply with such order to
suspend the work wholly or partly.

9.2. The contractor or its duly authorized representative shall have the
right to suspend work operation on any or all projects/activities along the
critical path of activities after fifteen (15) calendar days from date of
receipt of written notice from the contractor to the district
engineer/regional director/consultant or equivalent official, as the case
may be, due to the following:

a. There exist right-of-way problems which prohibit the contractor from


performing work in accordance with the approved construction schedule.

Based on the approved PERT/CPM Network Diagram, the items of Work within the
Critical Path that are affected by the suspension of works are; Item 102(2) –
Surplus Common Excavation; Item 103(3) – Foundation Fill; Item 104(1)a
- Embankment from Roadway Excavation (Common Soil); Item 404(1)a –
Reinforcing Steel Grade 40, Item 405(1)a2 – Structural Concrete Class A;
Item 506(1) – Stone Masonry.

In view of the foregoing, and as per favorable recommendation of the Project


Engineer, the request for Work Suspension Order No. 1 is respectfully forwarded to
the District Engineer for consideration and approval pursuant to the guidelines under
D.O. No. 144, Series of 2016, D.O. No. 192, Series of 2016 and D.O. 106 Series of
2018 subject however to the condition that the approval of this Work Suspension
Order No. 1 is not an automatic extension of contract time.
