I, PMCS, Melisa Suico Filipino, legal age and

resident of A.S Fortuna St. Brgy. Banilad, Mandaue City
after having been sworn to in accordance with the law ,
do hereby depose and state that:

PRELIMINARY STATEMENT

The lawyer conducting or supervising this

examination is ATTY. Ferdinand Quirol at Police
Station 4, Brgy. Casuntingan, Mandaue City, Cebu.

I am answering his question, fully conscious that I

do so under oath and may face criminal liability for false
testimony and perjury .

 The judicial affidavit is prepared in English and is
offered to prove the following:

a. That I am a the police officer who was the

investigator- on – case of the Direct Assault on
October 20, 2020 at A.S Fortuna St.Brgy.
Banilad, Mandaue City involving the victim Jess
on Macapal and the accused Don Rich Basergo.
b. That I saw the video of Leo Manatad that the
accused Don Rich Basergo punched the victim
Mr. Jesson Macapal. And I concluded and
recommended that criminal charges be filed
against the accused. And
c. That I filed a criminal complaint against the
accused Don Rich Basergo before the
Municipal Trial Courts in Cities ( MTCC)
Branch 7 in Mandaue City.

DIRECT TESTIMONY

With the above offer, transcribed below are the

questions probed from the investigator.

1. Question(Q) : Mr. Investigator, please state your

name and occupation.
Answer (A) : I am Police Chief Master Sargent
Melisa Suico currently assigned in Police station 4
at Brgy. Banilad, Mandaue City as a criminal
investigator.

2. Q: What is the nature of your work as Criminal

Investigator at the Mandaue Station Office?

 A: I investigate the crime that occurred in the A.S
Fortuna St. Brgy. Banilad, Mandaue City.

3. Q: How was your investigation regarding the case

of Mr.Jesson Macapal?
A: For almost a two weeks that I investigate the
case of Mr.Macapal and now I already gather an
evidence from the accused.

4. Q: When the exact date that the accused assault

the victim ?
A: October 20, 2020

5. Q: What are the evidence that you gather from

your investigation?
A: We have a two (2) witness to state the truth
and the video recorded.

6. Q: What did you observed the medical result of

the victim?
A: I observed that there was a broken join in the
right hands of the victim and the black eyed in the
left eye.

7. Q: What were your conclusion?

A: Considering the fact and circumstances, I
concluded, that the accused of Mr. Don Rich
Basergo, was observed to be a crime for violation
of Chapter four Article 148 of RA 10951 in Revised
Penal Code which generally constitute a general
crimes of Chapter four Article 148 RA 10951 in
Revised Penal Code for Direct Assault.
8. Q: Was the case referred to the prosecutor’s
office?
A: Yes, I filed a criminal complaint against Basergo
before the Mandaue City prosecutor, who

 eventually issued and filed an information before
the Municipal Trial Court in Cities ( MTCC) of
Mandaue City.

9. Q: If I would be able to show you to you your

investigation report of that criminal case on
October 20,2020 , would you be able to recognize
it?
A: Yes.
10.Q: Do you attest to the truthfulness of all the
allegations contained in this judicial affidavit?
A: Yes.
