JUDICIAL AFFIDAVIT
of
POLICE CORPORAL JESUS LEVY T. DACERA

This Judicial Affidavit of Jesus Levy T. Dacera, the Police Officer who
conducted the rape investigation, is executed to serve as to testimony to instant
case.
This Judicial Affidavit was taken at the office of Atty. Peter S. Atil at
Barangay Apas, Cebu City. Questions were propounded by the same and
the examination was conducted in English and Filipino, the languages that were
used and understood by the Affiant. Affiant answered each question fully
conscious that he did so under oath and may face criminal liability for false
testimony and perjury.

Q1: Please state your name, age, address and other personal circumstances
for the record.
A1: I am, Police Corporal Jesus Levy T. Dacera 24 years of legal age,
Single and currently residing at Upper Casili Sto. Niño 1 Purok Tulip,
Consolacion, Cebu. I am one of the police officers who responded at the scene
of the crime on October 23, 2020.
Q2: From which station did you receive the information about the crime
which took place on the night of October 23, 2020?
A2: It was on Consolacion Police Station, Sir, and the nearest police station in
Brgy. Pandayan M. Depito St, Poblacion Occidental Sta.Lucia Consolacion
Cebu.
Q3: Were you at the station when you receive the call about a rape
happening in Brgy. Pandayan M. Depito St, Poblacion Occidental
Sta.Lucia Consolacion Cebu?
A3: Yes. Im on duty at that time, Sir, and we were ordered to go to the
complainant’s address, Sir.
Q4: From whom did you receive the call?
A4: From a barangay peace and security officer, Sir, Mr. Diolito Turno since
they were the first ones who got at the scene of the crime.
Q5: What did the barangay tanod reported?
A5: I am the one who got to answer the call, Sir. He identified himself as Mr.
Diolito, head of the tanod in Brgy Poblacion Occidental. He stated that
there’s a rape scene that took place on the complainant’s address and they
told us to respond quickly since they had the rapist in custody.
Q6: What about the victim?
A6: He said that they have called a habal-habal to have the victim rushed to the
nearest hospital, at the Mendero Hospital. Then after the call Sir, we rushed
to the address given.
Q7: And who is the name of the victim Mr. Dacera?
A7: Miss Savannah Leigh Pruitt, Sir.
Q8: When you reach the given address, who were present at the scene?
A8: The tanods are there Sir, some neighbors, the rapist who was tied
up in one corner of the living room, and the victim, Sir.
Q9: Can you describe what you saw at the crime scene?
A9: Yes, Sir. The victim was on the floor. She had bruises and scratches on her
body. Her head was bleeding and she was unconscious and there was a stab
wounds. When we got there, she was carried towards the Habal-Habal because the
blow in her head and stab on her body looks severe that they had to rush her
quickly to the hospital. She only had pieces of clothing covering her private parts
because the tanods and the neighbors covered her up. There was a police officer
who took a picture of the evidences Sir, like her wounds and bruises.
Q10: What did you do to the accused?
A10: We took him to the station Sir.
Q11: What is the name of the accused?
A11: Martin S. Kunano.
Q12: What were the statements of Mr. Kunano regarding the crime?
A12. He confessed Sir that he indeed raped the victim.
Q13: Can you possibly relate his statements based on the police records of the
investigation?
A13: In his statement, he said that he raped Miss Savannah Leigh Pruitt because he
was emotionally tormented and he could no longer hold his anger towards
her.
Q14: What was the reason of his anger?
A14: He said that Miss Savannah Leigh Pruitt kept on ignoring him, Sir.
