the sale or purchase of goods of special importance shall be subject.
Research Methodology
There are two types of data used. They are primary and secondary data. Primary
data is defined as data that is collected from original sources for a specific purpose.
Secondary data is data collected from indirect sources.

These include books, the internet, company brochures, product brochures, the
company website, competitor’s websites etc, newspaper articles etc.

Different - The goods which form the subject of a contract of sale may be either
existing (owned or possessed by the seller) or future goods.
• Existing goods – they are the goods owned and possessed by the seller at the
time of making a contract of sale. Existing goods may be of the following types:
1. Specific goods- Goods identified and agreed upon at the time of
making a contract of sale.
2. Ascertained goods- Goods identified subsequent to the formation of
the contract of sale.
3. Unascertained goods- goods not identified or agreed upon at the time
of making of the contract of sale.
• Future goods-Future goods are goods to be manufactured or produced or
acquired by the seller after making of contract of sale.
Section 5
When is a sale or purchase of goods said to take place in the course of import
or export
(1) A sale or purchase of goods shall be deemed to take place in the course of the
export of the goods out of the territory of India only if the sale or purchase either
occasions such export or is effected by a transfer of documents of title to the goods
after the goods have crossed the customs frontiers of India.
(2) A sale or purchase of goods shall be deemed to take place in the course of the
import of the goods into the territory of India only if the sale or purchase either
occasions such import or is effected by a transfer of documents of title to the goods
before the goods have crossed the customs frontiers of India.
(3) Notwithstanding anything contained in sub-section (1), the last sale or purchase
of any goods preceding the sale or purchase occasioning the export of those goods
out of the territory of India shall also be deemed to be in the course of such export,
if such last sale or purchase took place after, and was for the purpose of complying
with, the agreement or order for or in relation to such export.
(4) The provisions of sub-section (3) shall not apply to any sale or purchase of
goods unless the dealer selling the goods furnishes to the prescribed authority in
the prescribed manner a declaration duly filled and signed by the exporter to whom
the goods are sold in a prescribed form obtained from the prescribed authority.
Subject to the other provisions contained in this Act, every dealer shall, with
Official Gazette, appoint, not being earlier than thirty days from the date of such
notification, be liable to pay tax under this Act on all sales of goods other than
electrical energy effected by him in the course of inter-State trade or commerce
during any year.
• Voluntary Registration: As per section 7(2), any dealer liable to pay tax
under the sales tax law of the appropriate State, or where there is no such law in
force in the appropriate State (or any part thereof),any dealer having a place of
business in that state (or part) may (not withstanding that he is liable to pay tax
under the CST Act as he does not make inter-state sale), apply for registration
under the CST Act, giving the particulars as prescribed .
A dealer may apply for registration under section 7(2) in the
following cases:
1. If he is registered under the sales tax law of the state but is not liable
to pay tax under the CST Act.
2. If there is no sales tax law in a state (or any part of it) while the dealer
carries on business in that state.
3. If a dealer deals in tax free goods in a state.
4. If he purchases goods from other states but sales are made within the
state.
The application for registration can be made at any time by the
dealer.
In case he does not apply for registration, he is not subject to any
penalty.
