1. Narrate the salient contributions and differences in the opinion of the Supreme Court in
the judgments of the Gopalan and Maneka cases dealing with the fundamental right to
life and personal liberty.
2. ‘The right to freedom of speech and expression does not confer an absolute right to speak
or publish without responsibility’.
Comment on the above statement and discuss the following grounds on which the
aforesaid right may be restricted.

ii. Decency and Morality

3. What do you mean by “minorities” u/a 30 of the Constitution? Discuss the right of
minorities to establish and administer educational institutions with the help of relevant
case law.
4. Discuss the concept of equality enshrined u/a 14 of the Constitution of India. What is the
E.P. Royappa doctrine of equality? Explain.

5. Discuss the protection in respect of conviction for offences as guaranteed u/a 20 of the
Constitution of India with the help of relevant case law.

6. Constitution of India guarantees the freedom of conscience and the right to freely profess,
practice and propagate religion. Critically evaluate the scope, reach and limitations of
aforesaid guarantees with the help of relevant judicial opinion.

(SECTION – A) (04X15)

1. Sarju Limited contracted to sell by description to the CRA Ltd., sulphuric acid,
commercially free from arsenic. The CRA Ltd. did not make known to the Sarju Limited,
either expressly or by implication the purpose for which they required the acid. Sarju
Limited supplied to CRA Ltd. sulphuric acid which was not commercially free from
arsenic. CRA Ltd. used the acid in the manufacture of brewing sugar in the shape of
invert and glucose, which they sold to brewers who used it in the brewing of beer. The
beer thus made was rendered poisonous, and the brewers suffered loss in respect of which
CRA Ltd. were liable to them. CRA Ltd. also lost the price of the acid, which was
rendered worthless to them, and the value of other goods spoilt through being mixed with
the acid; and the goodwill of their business was damaged. CRA Ltd. claimed damages
from Sarju Limited for the above stated loss. Argue on behalf of Sarju Limited and CRA
Ltd. and decide.
2. Critically analyze the interpretation of the term “Goods” under the Sale of Goods Act,
1930 by the Competition Commission of India, Suo Motto Case No.01 of 2013, i.e.
Cartelisation in Sale of Sugar Mills by the Uttar Pradesh Ltd. and the U.P. Rajya Chini
Evam Ganna Nigam Ltd.
3. An agent who is personally liable unsuccessfully defends an action brought against him
for breach of an unauthorized contract entered into by him on behalf of his principal.
What are the rights and liabilities of the agent if the principal
a) Ratifies what the agent has done
b) Does not ratify what the agent has done
Under the relevant Sections of the Indian Contract Act, 1872
4. A mercantile agent selling goods for the principal fell behind in his payments and was
required by the principal to furnish a security for the sum of Rs.50,000. Mr. Raghav
furnished a guarantee of Rs.30,000 on an agreement that recited the terms of dealing
between the principal and the debtor mercantile agent but failed to disclose that the
mercantile agent was already in debt to the principal. Is the guarantee furnished by Mr.
Raghav is valid? Furnish reasons with the relevant sections under the Indian Contract Act,
1872.
5. Mr. Sanjay parked his car at the parking lot of Syndicate Parking Company, paying the
required fee and leaving the key in the car. Mr. Sanjay testified that this was done at the
attendant’s request, and this testimony was not controverted. The attendant left the lot
about midnight, and some-time after that time, the car was stolen. Is the Syndicate
Parking Company is liable to Mr. Sanjay? Furnish grounds under the applicable sections
of the Indian Contract Act, 1872.
6. Distinguish a bailment from a pledge. What are the rights, duties and liabilities of the
pledge under the Indian Contract Act, 1872?

1. WTO agreements ensure growth and spontaneity of world trade in general, for both
developed and developing countries. Discuss the various agreements under WTO and
critically evaluate the given statement.
2. Explain the holistic causes for the problems of poverty, unemployment and inequalities of
income distribution in India. Suggest various ways to eliminate these problems at the
macro level.
3. Explain the causes of low profitability of commercial banks in India and discuss the
reforms suggested by the Narasimhan Committee 1991 and 1998.
4. The land reforms are a set of institutional changes that were introduced to reduce the
unequal distribution of land in rural areas. In this regard, discuss the major land reforms
introduced and critically analyze how effective they were to reduce inequality in rural
areas.
5. The New Economic Reforms 1991 have ushered in the era of globalization, liberalization
and privatization in India. Explain the statement and critically evaluate the reform process
in India.
6. Analyzing the achievements and shortcomings of the Public Sector Undertakings,
critically evaluate their role in growth and development of our country.

(SECTION – A) (04X15)

1. Can A Hindu husband seek divorce from his wife under the following
situations:
a) The husband’s application for restitution of conjugal rights was
dismissed by the court as the court felt that the wife’s working in a
different city is a reasonable cause for her not joining the husband at
the matrimonial home. Three years has passed from the said incident
and the couple is still living separately with a minimum contact.
b) The wife used to beat her minor son regularly and one day turned him
out of the house and he spent the entire night outside sitting at the gate
of the house. Few days after the incident, she left her house and started
living with her parents and filed a criminal complaint against the
husband under section 498-A of IPC. The relationship between the
couple is strained; the son is living with the husband.
c) Both the husband and wife filed a joint petition for divorce on 22nd
January 2015. On 26th April 2015, the wife withdrew her consent.
d) Due to irrevocable difference between the husband and wife, the court
passed a decree of judicial separation. Seven years has passed and
there has been no reconciliation between the parties.

2. Ali and Saima met each other in 2005 while in university. After completing
their master’s degree in 2007, both got a job in Bangalore and started living
together. They bought a house which was in the name of Saima. In 2012,
Saima got a promotion and shifted base to Mumbai. In 2015 she got pregnant
and informed the same to Ali who wanted her to have an abortion, to which
she refused and as a result they broke up. Ali married Razia in March 2016
under SMA, 1954. Saima gave birth to a son in April 2016. She wants
maintenance for herself and her son. Furthermore, Razia has also filed an
annulment on the ground of fraud as Ali failed to inform her about his
relationship with Razia and subsequent pregnancy. Are Saima and her son
entitled to maintenance? Can Razia get an annulment? Argue in accordance
with relevant provisions and case laws.

3. What are the essentials of a valid marriage under the Hindu law? Explain
with the help of statutory provisions and case law.
a) Examine the validity of following marriages under the Hindu Law as well
as the Muslim Law
i) A, marries a widow aged 17 years during her pregnancy.
ii) A, marries his paternal aunt's daughter’s son daughter.
iii) A, marries her maternal aunt's daughter’s son’s son.
iv) A, marries his deceased wife’s sister.
v) A, marries her paternal uncle.

4. Ahmed married Anam in 2011, but due to his aggressive behavior, there were
constant quarrels between the couples. After a major fight in November 2012,
Anam left the matrimonial home. Ahmed messaged her and said that if she
doesn’t come back within twenty-four hours, consider herself as divorced.
Anam did not come back. After four months of this incident, due to the
efforts of the friends and relatives of the couple, Anam came back and they
started living together again as husband and wife. In September 2015 a
daughter was born to them. Ahmed was not happy as he wanted a son and
asked Anam to give up the child, to which she refused. As a result, the
relationship between the couple was strained. Ahmed married again in
December 2015 to Shehnaz. He sent Anam back to her parent’s house. For
few months he sent certain amount of money but then he stopped. Anam tried
to contact him but he refused to even acknowledge her presence. Tired of the
charade, Anam filed an application for maintenance for herself and her infant
daughter in August 2016. Ahmed refused maintenance saying that he had
divorced Anam and as there was no intermediate marriage of Anam, there
living together was Haram (prohibited) and the child illegitimate. Hence he
was not obligated to maintain them. He provided Anam some money as
maintenance for the iddat period. Decide in the light of Islamic Law and case
laws. (Both the parties belong to Sunni sect)

5. Explain the concept of ancillary relief under the Hindu Marriage Act. Is a
second Hindu wife entitled to maintenance?

6. What are the necessary conditions for a valid adoption?


Examine the validity of any two of the following adoptions:
i) A, 21 year old Hindu female adopts a 3 year old Muslim girl
ii) A, aged 16 years is given in adoption by his mother.
iii) Sanjana a divorcee gave her infant son in adoption without the
consent of the Husband
iv) Sonam was adopted by Karan when she was an infant. Karan
married Ira. Ira adopted Sonam after the death of Karan
v) Diya, a 11 year old child widow is adopted by Mayank a 34 year
old male.
