When we talk about something personal in general sense, it always means that
we wish to keep the thought, idea, thing or talk within ourselves. If we talk
about a child in school days, to share a silly secret which he thinks as personal;

children take a pinky promise from the other person. Isn’t that pinky promise

said as something asked in consent of sharing the personal talk? Now if a child
can be so conscious about sharing a silly secret with a friend and takes a

promise as a con rmation, then the adults de nitely think multiple times
before sharing any data.

There is a widespread adoption of digital technologies across India. And in

sudden struck of pandemic COVID-19, entire world relies on digital

technologies. Where there is digitalisation there is a protection policy in sharing

commercial or personal data.
Meaning of Personal Data: any piece of information from which inference can

be drawn to identify a person.
For privacy policies, the government of India has introduced a new bill for the

protection of data of Indian citizens. The Personal Data Protection Bill, 2019
was introduced in Lok Sabha by the Minister of Electronics and Information

Technology, Mr Ravi Shankar Prasad, on December 11, 2019. The Bill seeks to

provide for protection of personal data of individuals, and establishes a Data
Protection Authority for the same.

There was a famous case law and a landmark verdict to be remembered for the

Right to Privacy (Justice K.S.Puttaswamy and Anr. Vs Union of India and ors). A

landmark judgement of the Supreme Court of India which holds that the right to

89 privacy is protected as a fundamental constitutional right under Articles 14,19
18
and 21 of Constitution of India. The nine-judge bench of J.S.Khehar ,
J.Chelameswar, S.A.Bobde, R.K.Agrawal, R.F.Nariman, A.M.Sapre,
Dr.D.Y.Chandrachud, S.K.Kaul and S.A.Nazeer unanimously held that the “right
to privacy is protected as an intrinsic part of the right to life and personal

liberty under Article 21 and as a part of the freedoms guaranteed by Part III of

the Constitution”. It explicitly overrules previous judgements of the Supreme
Court in Kharak Singh vs State of UP and M.P.Sharma vs Union of India, which
had held that there is no fundamental right to privacy under the Indian
Constitution.

Applicability: The Bill governs the processing of personal data by: (i)
government (ii) companies incorporated in India, and (iii) foreign companies

dealing with personal data of individuals in India. Personal data is data which

pertains to characteristics, traits or attributes of identity, which can be used to

identify an individual. The Bill categorises certain personal data as sensitive

personal data. This includes nancial data, biometric data, caste, religious or
political beliefs, or any other category of data speci ed by the government, in

87 consultation with the Authority and the concerned sectorial regulator.

The Personal Data Protection Bill, 2020 has classi ed data into different kinds.

and Data duciary. Data means and includes a representation of information,
facts, concepts, opinions, or instructions in a manner suitable for

communication, interpretation, or processing by humans or by automated
means. Data Fiduciary means any person who alone or in conjunction with

The Bill also says that a data duciary must take all steps to ensure that

personal data that is processed is complete, accurate, not misleading ,

updated and must have some regard to the purpose for which it is processed in
