PERCENTAGE TAXES. 41. The pe tcentage taxes in the National Internal Revenue Code are: y (a) 3% percentage tax on persons who are exempt from the value- added tax because their gross annual sales or receipts do not exceed one million nine hundred nineteen thousand five hun- Gred pesos (P1,919,500), and who are not required to pay any other percentage tax; (b) Tax on domestic carriers; (c) Tax on international carriers (c) Franchise tax; (d) Overseas communications tax; (e) Tax on banks and non-bank financial intermediaries with qua- si-banking activitios; (f) Tax on other non-bank financial intermediaries; (g) Tax on life insurance companies; (h) Tax on agents of foreign insurance companies; {i) Amusement tax; (j) Tax on winnings; and (k) Tax on stock transactions. The basic rule: Those who are subject to the percentage tax/es are not subject on the same business to the value-added tax. however, a registered taxpayer may have two lines of activities, one of which is subject to the value-added tax, and the other subject toa percentage tax. A percentage tax is not an indirect tax because the law does not allow the seller to shift the tax to the buyer. One cannot see in a sales invoice an additional item for percentage tax. But this is more apparent than real. Actually, a seller's selling price has @ built-in recovery of percentage tax on the sale. 2 4.
