    GRAND JURY REFERRAL I ‘The State of Texas vs. CLIFFORD WILLIAM MCCRARY 282nd DOB: 5/6/1968 Sex: Male Race: White Gi Witness: Read In Offense “Agency FRAUD SELL SECURITIES >= S1OK< $100K TXOS7OI5A INDICTMENT NO.: F2000469 IN THE NAME AND BY THE AUTHORITY OF THE STATE OF TEXAS: The Grand Jury of Dallas County, State of Texas, duly organized at the July Term, A.D., 2020 of the Criminat District Court No. 2 for said County, upon its oath do present in and to said Court at said term, That CLIFFORD WILLIAM MCCRARY, hereinafter called Defendant, on or about the 28th day of October, 2015, in the County of Dallas, State of Texas, did then and there, pursuant to one scheme and continuing course of conduct, sell and offer for sale securities in the form of notes, evidence of indebtedness, and investment contracts described as membership interests issued by HLV Master Fund, LLC, to Kendall Cotton, Christina Cotton, Willam McManemin, and Megan McManemin, hereinafter referred to as "purchasers," and defendant engaged in fraud in connection with the offer for sale and sale of said securities by, intentionally failing to disclose that on or about August 31, 2105, the defendant was indicted by a Dallas County Grand Jury and charged with first degree felony theft in Cause Number F-1500541, said information being material fact, and intentionally failing to disclose that on or about August 31, 2105, the defendant was indicted by a Dallas County Grand Jury and charged with second-degree felony misapplication of fiduciary property in Cause Number F- 1500542, said information being material fact, and intentionally failing to disclose that on or about March 4, 2015 a Default Judgment was entered in the 191st Judicial District Court of Dallas County, Texas, in Cause Number DC-15-00419. The Defendant was ordered to pay Plaintiff $33,862.94, with interest continuing to accrue at eighteen percent (18%) per annum, along with attorney's fees of $4,043.99, sald information being material fact, and Fier .
