RESOLUTION D RAFT
WHEREAS
The citizens of Bonner County, Idaho, are endowed by our Creator with certain unalienable
fundamental human rights. As they are endowed upon us by a Power higher than humankind,
humankind is powerless to impact them. As they are unalienable, we cannot under any
circumstances be separated from them.
We are welcomed into this world with our first breath and delivered from it with our last. Breath
is the very essence of life. There is no human right more fundamental than the right to breath,
for without it, life itself ceases to exist. No government agency has the power to regulate this
fundamental right.
Unfortunately, this is precisely the power erroneously claimed by the Panhandle Health District
by the issuance of its mask mandate. The Panhandle Health District enjoys no such power.
The citizens of Bonner County are not subject to any edict issued on the basis of such an
illegitimate power. We resolutely refuse to comply
Liberty has been the core of our nation since its founding. Self-determination, self-reliance and
independence are fundamental American values. These values are not subject to restriction by
edict, even during the course of what some view as an emergency. There is no emergency
exception to the core principle that the fundamental human rights endowed by our Creator may
not be separated from us by any human action. There is no emergency exception to our right to
breathe free.
WHEREFORE:
‘The Bonner County Board of Commissioners hereby resolves that:
1 No Bonner County agency shall enforce the mask mandate issued by Panhandle Health
District on Thursday, November 19, 2020 (the “Mask Mandate");
2. No Bonner County funds shall be used in connection with any activity undertaken in any
manner by any Bonner County employee to enforce the Mask Mandate;
3. Bonner County shall, and effectively immediately hereby does, terminate all future
funding of any nature whatsoever to or in support of Panhandle Health District, and, to the
extent legally allowed, does hereby reclaim and call for the disgorgement of all funding provided
to Panhandle Health District during the year 2020 to date; and
4. Bonner County shall undertake all available legal challenges to the legitimacy of the
Mask Mandate, and hereby authorizes the County Prosecutor and Civil Prosecutor to institute
such challenges forthwith.
