ELIZABETH M. MENDOZA, of legal age, Filipino and a resident of
39-H P. Tuazon Street, Cubao, Quezon City, after having been duly sworn in accordance with law, hereby depose and state that:
1. In 2001, a Deed of Donation was executed by Agapito Mendoza in
favor of the couple Daniel B. Mendoza and Elizabeth Mendoza donating to them, jointly, that parcel of land located along P. Tuazon Street, Cubao, Quezon City, more particularly described as follows:
“A parcel of land (Lot 1-C-1-A of the subd. Plan
(LRC) Psd-22817, being a portion of Lot 1-C-B (LRC) Psd-22274, LRC (GLRO) Rec. No. 917 situated in the Dist. of Cubao, Q. City, Is. of Luzon. Bounded on the NE., and SE., 2 to 4 by Lot 1-c-1B of the subd. Plan, on the SW., pts. 4 to 1 by Central Blvd. and on the NW., pts 1 to 2 by Lot 1-B, Psd-175. Beginning at a pt. marked “1” on plan, being S. 72 deg. 01’W., 5610.75 m. from BLIM No. 1, Mariquina, Rizal, thence N. 30 deg. 54’E., 62.43 m. to pt. 2; thence S. 59 deg. 31’E., 17.54 m. to pt. 3; thence S. 30 deg. 32’W., 61.04 m. to pt. 4; thence N. 63 deg. 56’W., 18.00m. to point beginning; containing an area of ONE THOUSAND AND NINETY FIVE (1,095) SQUARE METERS, more or less.”
2. After the Deed of Donation was registered, Transfer of Certificate of
Title No. N-232488 covering the aforedescribed parcel of land was issued by the Register of Deeds for Quezon City in the name of “Daniel B. Mendoza, of legal age, Filipino, married to Elizabeth Mendoza”.
3. Having been donated to the couple jointly during their marriage,
Elizabeth Mendoza is a co-owner in equal share of the aforesaid property.
4. It has come to the knowledge of Elizabeth Mendoza that her
husband Daniel B. Mendoza is claiming ownership of the entire property and is attempting to sell or dispose of the entire property despite the fact that he only owns one-half thereof. 5. Unless an adverse claim is annotated on the aforedescribed Transfer Certificate of Title, Elizabeth Mendoza is in danger of being defrauded and deprived of her just and valid right over the aforedescribed parcel of land and for this reason she is executing this Affidavit in support of her request for the annotation of an adverse claim over the parcel of land described herein.
