GENERAL TERMS AND CONDITIONS OF USE OF THE DELHAIZE WIFI NETWORK

You shall carefully read these general terms and conditions and the privacy policy and accept them before using the
Service. By ticking the matching boxes on the portal, you confirm that you have actually read these general terms and
conditions of use and the privacy policy, and that you accept it.

1. DEFINITIONS

"Access Code" refers to a User ID and a password, or any other code, which have been given to an End User when creating of
his/her User Account and enabling to authenticate this End User and to give him/her access to the Delhaize Wifi network.
"Clients" refer to the clients of the Supplier "User Account" refers to a set of data made of the link between an Access Code and
an End User.
"Data": any data related to the identification of the End User, the identification of the Terminal equipment that is presumed to have
been used, and the identification of the electronic communications service that has been used.
"Delhaize Wifi Network" refers to the Wifi network which has been freely made available to the End User by Delhaize, in a public
place covered by this network. The use of this network is subject to the General Terms and Conditions of Use.
"Delhaize Wifi Service" or the "Service": service which enables the End User to have access to the Internet through a Terminal
from a zone covered by the Wifi Delhaize network.
"End User" refers to any person, Client of the Supplier, with a User Account, who uses the Service pursuant to these General
Terms and Conditions of Use.
"General Terms and Conditions (of Use)": refers to these general terms and conditions.
"Supplier" or "Delhaize" refers to DELHAIZE GROUP S.A., located at 1080 Brussels, rue Osseghemsstraat, 53.
"Terminal" refers to any device equipped with a functional connectivity that meets the Wireless Lan IEEE 802.11 b/g/n standards.

2. OBJECT

The General Terms and Conditions of Use apply to the use by the End User of the Delhaize Wifi Service such as described in
these General Terms and Conditions and made available by the Supplier.

The Service enables the End User with a Terminal to freely access the Internet from the zones covered by the Delhaize Wifi
Network.

The Service enables an End User to access the Internet under the hereafter described conditions and limits. The Service does not
include any mailbox provision nor web page hosting.

3. REGISTRATION AND ACCESS TO THE DELHAIZE WIFI SERVICE

This Service is offered freely by Delhaize to its Clients who hold a Plus-Card loyalty card.

Access to the Service requires an identification of the End User through the portal.

Any Client of the Supplier who wants to access the Service must create a User Account beforehand by completing a form in which
he/she mentions the following information: name, first name, Plus-Card number, mobile phone number and post code. The portal
sends to this mobile phone number an Access Code enabling the End User to login and to use the Service.

Once the End user has signed in, he/she will be free to access the Service later on without having to sign in once again, unless
he/she has deleted the identification cookies or has signed out from the Service by submitting a sign-out request by e-mail
info@delhaize.be.

4. AVAILABILITY OF THE DELHAIZE WIFI SERVICE

The Service is available during the opening hours of the Supplier's company-operated stores that are covered by the Delhaize Wifi
network.

5. COMMITMENT AND RESPONSIBILITY OF THE END USER

When registering to the Service, the Client commits himself/herself to communicate his/her accurate contact information. The
Supplier is authorized to suspend access to the Service if the contact information is inaccurate.

Access Codes are personal and confidential. The End User is not allowed to give or to disclose his/her Access Codes to anybody
in any form. In case of loss or theft or, more generally, of misappropriation of his/her Access Codes, the End User commits
himself/herself to warn the Supplier about it with no delay.

Any connection to the Service made with the Access Code of a User shall be deemed to have been made by the latter under
his/her own responsibility. Therefore, the concerned End User has the sole responsibility for any direct or indirect, material or
immaterial damage to the Supplier and/or to third parties related to the use of his/her Access Codes.

Any use of the Service must comply with applicable laws and rules and in a way that is normally reasonable, responsible and
cautious.

Any use of the Service must be done in full knowledge of the specificities of the Internet, its limits and weaknesses (see Section 7
of these General Terms and Conditions).

The Service may under no circumstances be used:


- for any obscene, defamatory, indecent, improper, threatening, unwanted or unsolicited communication, which causes
inconvenience, public disturbance, or which conflicts with applicable laws, including laws prohibiting incitement to racial
hatred;
- to transmit or upload on the Internet any prohibited, illicit or illegal data, or data that are contrary to accepted principles
of morality or to public policy and that damage or are liable to damage the rights of third parties, including intellectual
property rights;
- for illegal activities, including criminal acts;
- for any illegal communication of secret or confidential data;
- for any activity contrary to privacy and personal data protection rules (including the sending of any unsolicited business
information);
- for the sending of viruses, malware or any computer sabotage;
- for the theft of data, an illegal or non-authorized access to data or to an IT system.

The End User is prohibited from any fraudulent, abusive or excessive use of the Service, including, but not limited to, the
intentional or unintentional blockage of the email servers of the Supplier (and of its subcontractors, if any) and/or of the email
recipients through indiscriminate mass mail-outs (spamming, bulk e-mail, junk e-mail or mail bombing) or of its network, or the
sending of attractive messages generating necessarily a large amount of answers (teasing or trolling), which could disrupt the
availability of these servers or networks, and bears full responsibility for such a use of the Service.

The End User shall comply with the intellectual property rights of the Supplier, its subcontractors and any third party. He/she won't
be allowed in any way to create illegal, pirated or unauthorized copies of any product, service or information from third parties and
to make them available through the Service.

The Service is exclusively reserved to the End User, excluding any indirect use through an automated system.

The Supplier cannot be held responsible for any misuse or any fraudulent or abusive use of the Service by the End User. The End
User commits himself/herself to indemnify the Supplier for any direct or indirect damage that would result from the unintentional or
negligent failure to comply with his/her obligations under these General terms and conditions.

6. COMMITMENT AND RESPONSIBILITY OF THE SUPPLIER

The only obligation of the Supplier is to provide due care concerning the execution of its obligations under these General Terms
and Conditions. Should the Supplier be held responsible under these General Terms and Conditions, the User expressly agrees
that he/she will not be eligible for any compensation of direct or indirect damage he/she would have suffered.

The Supplier undertakes to use the reasonable means at its disposal to ensure high availability of the Service. However, he
cannot guarantee a functioning without disruptions or inconveniences, nor any determined transmission durations and capacities.

The Supplier reserves the right to carry out at any time maintenance work that may interrupt the operation of the Service.

The Supplier is not responsible for the contents made available through the Internet or for the damages that may arise from their
use. The Supplier has no control on the content or the characteristics of the data that have been received or transmitted by the
End User. However, in order to ensure proper management of the system of access to the Internet network, the Supplier reserves
the right to delete any message or to prevent any operation of the End User that could disrupt the proper functioning of its network
or of the Internet or that does not comply with the rules mentioned in the General Terms and Conditions. To the extent permitted
by law, an exception may also be made to the rule related to the privacy of the communications upon request of competent
authorities.

The Supplier shall not be held responsible for the exploitation (and for its consequences) of the data and information that the End
User has entered or collected through the Internet.

The Supplier shall not be held responsible in cases including but not limited to:
- the non-compatibility of a WLAN IEEE 802.11b/g/n network card with the Delhaize Wifi Network (that could be among others
related to the parameterization of the End User's Terminal);
- the use of the Service that contravenes the provisions of these General Terms and Conditions and/or that is contrary to good IT
practices;
- the bad installation and/or bad configuration and/or malfunction of the Terminal and particularly of its network card(s);
- any use not complying with the instructions of the Service;
- the impossibility to access the private virtual network of a company;
- the disruptions and/or total or partial unavailability and/or interruption of part or all of the services that are offered on the
networks operated by third operators;
- the consequences that an End User and/or the third parties may face should erroneous data be communicated during the
creation of his/her User Account or should an End User omit to communicate any data change in his/her User Account;
- a force majeure within the meaning of the case-law of the Belgian Court of Cassation.

The Supplier can outsource all or part of its obligations that are mentioned in the General Terms and Conditions.

7. UTILIZATION OF THE INTERNET

As far as the utilization of the Internet is concerned, the End User has been informed that the Internet is a network conveying data
that may be protected by intellectual property rights or that may infringe various applicable legal provisions.

The End User is prohibited from transmitting or uploading on the Internet any prohibited, illicit or illegal data, or data that are
contrary to accepted principles of morality or to public policy and that damage or are liable to damage the rights of third parties,
including intellectual property rights.

It is specifically reiterated that the Internet is not a secured network. Under these circumstances, it is the responsibility of the End
User to take all the appropriate measures in order to protect his/her own data and/or software, particularly from the contamination
by potential viruses circulating on the Internet or from the intrusion of a third party in his/her Terminal, but also to proceed to data
back-ups before and after the utilization of the Service.

The End User recognizes to be fully informed of the non-reliability of the Internet network, especially concerning the lack of
security related to data transmission and the failure to guarantee performances related to the volume and the speed of data
transmission.

The End User recognizes to be informed that the integrity, authentication and confidentiality of the information, files and data of all
kind that he/she wishes to share on the Internet cannot be guaranteed on this network or by the Supplier. The End User should
not transmit via the Internet messages the confidentiality of which he/she wishes to guarantee infallibly.

When it comes to products or services that are available on the Internet, the End User shall address the suppliers directly for any
related claim.

Communications made via the Service have normally the same security level than standard Internet communications. Any
absolute protection against intrusions or illicit listening cannot be guaranteed. The Supplier declines any responsibility concerning
such occurrences. If the End User wishes to reinforce the level of security, he/she can install himself security software such as a
firewall or VPN (Virtual Private Network), under his/her sole responsibility.

8. PERSONAL AND IDENTIFICATION DATA

The End User explicitly acknowledges having read and accepted the Privacy Policy of the Service.

In compliance with applicable legal and regulatory provisions including the law of December 8, 1992 on the protection of the
privacy with respect to the processing of personal data, any End User has a right of access to his/her personal data, the right to
have them rectified or suppressed, and the right to object to any processing for direct marketing purposes by addressing an email,
with a proof of his/her identity, to the Supplier at the following address: info@delhaize.be.

9. SUSPENSION

If an End User fails to meet one of his/her obligations, the Supplier reserves the right to temporarily or definitely suspend the
access of this End User to the service, without prior notification nor any compensation and without prejudice to its right to claim
the payment of damages, especially in case of an act or attempted act of piracy or in case of sending or attempted sending of illicit
information or in case of simultaneous connection or attempted simultaneous connection with identical Access codes.

10. TERMINATION OF THE CONTRACTUAL RELATIONSHIP

The contractual relationship between the parties begins at the registration of the End User.

The User may terminate it at any time by signing-out of the service by sending an email with a proof of his/her identity to the
Supplier at the address info@delhaize.be.

The Supplier can terminate the Service at any time, without prior notice or justification.

11. GENERAL POINTS

By accessing the Service, the End User acknowledges acceptance of the General Terms and Conditions. Only the last version
available via the portal is applicable.

The Supplier reserves the right to modify the Service and to adapt these General Terms and Conditions. In case of modification,
the End User shall be informed of this on the subsequent connection and he/she shall have to accept the new General Terms and
Conditions before use of the Service.

12. APPLICABLE LAW

These General Terms and Conditions of use shall be governed by Belgian law.

Any litigation relating to their interpretation or application shall be settled exclusively by the competent courts of the judicial district
of Brussels.
