1. This action is not yet ripe. According to the subject Mortgage, which was drafted by
the Plaintiff without any editing by Defendants, the indebtedness secured thereby involves a twenty-

year line of credit. The Mortgage is the controlling document, and any ambiguity is to be construed

against the drafter and in favor of Defendants. The provision on page 1 of the Mortgage, providing
T
for a twenty-year line of credit, is inconsistent with and contrary to the provisions contained elsewhere
O
in the loan documents which purport to require that the entire indebtedness be paid off in a one-time
N
balloon payment, on July 28, 2016, which is ten rather than twenty years from the date upon which

loan, which Plaintiff knew or should have known was likely to cause damages to the Defendants.

This inequitable conduct includes, but is not limited to, the filing of this foreclosure suit while in the
midst of detailed settlement negotiations with Defendants; the repeated failures to accurately calculate
the amount of Defendants' monthly interest payments, and to timely inform the Defendants of the
amount they would be required to pay each month; repeated failures and refusals, despite demands,
to disclose the calculations allegedly giving rise to the seemingly inflated and late-disclosed monthly
charges; failure to return calls to customer service; falsely reporting delinquencies to the credit

bureaus and refusing to rectify the errors after Defendant Laurence Schneider notified Plaintiff of

same; and the unlawful and dishonest misappropriation and legally improper release of one or more

liens on real property. The beneficial owner of said lien or liens was Schneider and/or a corporate

entity in which he, as was known to Plaintiff, was a substantial stakeholder. Said lien or liens
was/were placed with Plaintiff as collateral (security), only to insure repayment of loans made to

Schneider pursuant to a separate line of credit. Without justification or legal excuse, Plaintiff released

2. Schneider and Bank have consented to the propriety of venue in this circuit and the

Count 1 - Violations of The Fair Credit Reporting Act -15 U.S.C. §1681 et seq
4. 15 U.S.C. § 1681s-2 imposes obligations upon, and prohibits certain conduct by,

"furnishers ofinformation to credit reporting agencies." At all times material, Bank was a "furnisher"
within the meaning of the Fair Credit Reporting Act. It furnished information, which in many
instances was inaccurate, to the three major credit bureaus, about Schneider's creditworthiness. Such
information exists for the purpose of enabling potential lenders to accurately evaluate the risks and
rewards of contemplated undertakings, such as the issuance of lines-of-credit and other products.
When such information is inaccurate, it is reasonably foreseeable that the consumer will be damaged

as the result.

5. By operation of 15 U.S.C. §1681s-2(a)(l)(A), "a person shall not furnish any
C
information relating to a consumer to any consumer reporting agency if the person knows or has
ED
reasonable cause to believe that the information is inaccurate." In or about August, September,
October, and November of 2015, Bank violated this section by inaccurately reporting Schneider's
FI
installment payments as being more than thirty days delinquent, when in fact they were not.

to erroneously report Schneider's payments as delinquent, and continued to misrepresent the amounts

owed for one or more of the following months of 2015: September, October, and November.

Bank's noncompliance with§§ 1681s-2(a)(l)(A) and 2(a)(l)(B) was willful, Bank shall be required
to compensate Schneider in an amount equivalent to the total of all actual damages he sustained as
the result, plus punitive damages, and reasonable attorney fees and court costs. Schneider contends

that the actions and inactions of Bank, when viewed in context, make it more likely than not that such
actions were willful, and intends to establish Bank's willfulness through discovery in this cause.
Bank's noncompliance with §§1681s-2(a)(l)(A) and 2(a)(l)(B) was negligent rather than willful,
Bank shall be (1) required to compensate Schneider in an amount equivalent to the total of all actual
damages he sustained as the result of Bank's negligent failures to comply with, inter alia, §§ 1681 s-

2( a)( 1)(A) and 2(a)(l)(B), and should this action be successful, (2) required to pay Schneider a

reasonable attorney's fee, plus costs.

9. Among Schneider's actual damages are: loss of available credit in the approximate

amount of one million dollars, the loss of substantial business opportunities, the inability to reach an
accommodation with Bank which would have obviated the alleged necessity of this foreclosure suit,

and substantial and material reduction in the probability of a recovery in the tens of millions or more

in one or more False Claims Act proceedings in which Schneider is or was the Relator.

10. The Credit Agreement upon which the Bank's foreclosure action is based includes
an optional provision on page 4 which, if selected, would purportedly waive Schneider's right to trial

by jury on any counterclaim lodged against Bank. Selection of this waiver is indicated by the affixing

of one or more of the parties' initials in an adjacent blank. Specifically, waiver requires one or more
T
of the parties to "(Initial Here_)[.]" In this instance, the line whereupon initials could have been

inscribed contains no marking of any type. There has been no contractual waiver of Schneider's right

WHEREFORE, in addition to trial by jury, Schneider demands all available forms of damages
on Count 1, plus costs and attorney fees pursuant to the above-cited authorities, and such additional

12. Bank, through its representatives, made false statements of material fact which they
knew or should have known were false and of the sort likely to damage Schneider. These statements
primarily consisted of erroneous and inflated monthly billing, claims that all errors had been rectified

made or, in the alternative, Bank made these statements while being aware that Bank did not know

Schneider and/or a corporate entity in which he, as was known to Bank, was a substantial stakeholder.
Said lien or liens was/were placed with Bank solely as collateral (security), only to insure repayment

Bank released such liens, thereby causing damage to Laurence Schneider's financial interests.

20. Bank's conduct in this regard constitutes the exercise of dominion wrongfully asserted

over Schneider's property, and such dominion was inconsistent with Schneider's ownership interests
therein.
