2 Plaintiff Tee Turtle, LLC, for its Complaint against Defendants Kellytoy
3 Worldwide, Inc. and Kellytoy (USA), Inc. (collectively, “Kellytoy” or “Defendants”),
4 states and alleges as follows:
5 NATURE OF THE ACTION
6 1. This is an action for patent infringement under the United States Patent
7 Laws, 35 U.S.C. § 1, et seq. Defendants have infringed, and continue to infringe,
8 directly and/or indirectly, the following United States patents owned by Tee Turtle:
9 a. No. D822,127 (the “ʼ127 Patent”);
10 b. No. D836,168 (the “ʼ168 Patent”);
11 c. No. D860,337 (the “ʼ337 Patent”); and
12 d. No. 10,786,746 (the “ʼ746 Patent”)
13 (collectively, the “Tee Turtle Patents”). Copies of each of the Tee Turtle Patents are
14 attached hereto as Exhibit A through Exhibit D, respectively.
15 2. Specifically, Defendants have directly and/or indirectly infringed and
16 continue to infringe each of the Tee Turtle Patents through the manufacture, use, offering
17 to sale, and/or sale in the United States, and/or the importation into the United States, of
18 infringing reversible plush toys.
19 3. Tee Turtle seeks damages and other relief for Defendants’ infringement of
20 the Tee Turtle Patents.
21 THE PARTIES
22 4. At all relevant times mentioned herein, Tee Turtle is and has been a
23 Missouri limited liability company with its principal place of business in Missouri.
24 5. Tee Turtle was founded in 2012 by designer/CEO Ramy Badie to offer
25 cutting edge pop-culture t-shirt designs. Tee Turtle uses original and licensed artwork to
26 create and sell apparel to a loyal customer fan base:

1 9. At all relevant times mentioned herein, Defendants Kellytoy Worldwide,


2 Inc. and Kellytoy (USA), Inc. (collectively “Kellytoy”) are and have been California
3 corporations with their principal place of business at 4811 S. Alameda Street, Los
4 Angeles, California 90058.
5 10. Kellytoy is a large participant in the stuffed animal market. In February
6 2020, Kellytoy claimed that it has sold over 50 million of its Squishmallow toys in two
7 years. See https://www.toynews-online.biz/2020/02/10/kellytoy-celebrates-as-global-
8 sales-of-squishmallows-surpass-50-million-since-launch/. Kellytoy has expanded its
9 offering to include an infringing line of Flip-A-Mallows reversible plush toys. Kellytoy
10 markets the product through online and retail stores throughout the United States and
11 around the world.
12 11. Tee Turtle is being harmed by Kellytoy’s infringement and seeks injunctive
13 relief to stop the harm. And, to the extent that there is harm that is compensable by
14 money damages, Tee Turtle would be entitled to past damages because it has marked its
15 products and provided actual notice to Kellytoy.
16 JURISDICTION AND VENUE
17 12. This patent infringement action arises under the patent laws of the United
18 States, including 25 U.S.C. § 101 et seq.
19 13. This Court has subject matter jurisdiction pursuant to 28 U.S.C. §§ 1331 and
20 1338.
21 14. Venue in this judicial district pursuant to 28 U.S.C. §§ 1391 and 1400.
22 15. This Court has personal jurisdiction over Kellytoy Worldwide, Inc. and
23 Kellytoy (USA), Inc., as they are California corporations with a principal place of
24 business at 4811 S. Alameda Street, Los Angeles, California 90058. Tee Turtle is
25 informed and believes and thereupon alleges that Kellytoy is marketing their Flip-A-
26 Mallows throughout California, including in this District.
27 FACTUAL ALLEGATIONS
28 A. Tee Turtle’s Patents and its Reversible Plushies

1 16. Tee Turtle holds three design patents that cover reversible plush toys. The
2 ʼ127 Patent, titled “Reversible Plush Toy,” was filed on December 20, 2017, and issued
3 on July 3, 2018. See Exhibit A. It includes one claim for “the ornamental design for a
4 reversible plush toy, as shown and described” in 8 drawing sheets, which depict the
5 design of a reversible plush toy.
6 17. The ʼ168 Patent, titled “Reversible Plush Toy,” was filed on May 31, 2018,
7 and issued on December 18, 2018. See Exhibit B. It includes one claim for “the
8 ornamental design for a reversible plush toy, as shown and described” in 8 drawing
9 sheets, which depict the design of a reversible plush toy.
10 18. The ʼ337 Patent, titled “Reversible Plush Toy,” was filed on October 23,
11 2018, and issued on September 17, 2019. See Exhibit C. It includes one claim for “the
12 ornamental design for a reversible plush toy, as shown and described” in 8 drawing
13 sheets, which depict the design of a reversible plush toy. Collectively, the ’127 Patent,
14 the ’168 Patent, and the ’337 Patent are referred to herein as the “Tee Turtle Design
15 Patents.”
16 19. Tee Turtle holds a utility patent that covers reversible plush toys. The ʼ746
17 Patent, titled “Reversible Toy,” was filed on December 20, 2017, and issued on
18 September 29, 2020. See Exhibit D. It includes 29 claims disclosing a novel reversible
19 plush toy. The ’746 Patent is referred to herein as the “Tee Turtle Utility Patent.”
20 20. Each of the Tee Turtle Patents described above and attached hereto are
21 owned by Tee Turtle, and are valid, enforceable, and currently in full force and effect.
22 21. Tee Turtle designed and markets a line of reversible plush toys that
23 incorporate and practice its intellectual property rights, examples of which are available
24 at www.teeturtle.com/collections/plushies (“Reversible Plushies”). The Reversible
25 Plushies have been a popular and successful product line for Tee Turtle. The Reversible
26 Plushies incorporate and adopt the design and functionality protected by the Tee Turtle
27 Patents.

1 B. Kellytoy’s Infringing Activities


2 22. Kellytoy markets and sells a line of products called “Flip-A-Mallows.” The
3 Flip-A-Mallows line is an extension of the very popular Kellytoy “Squishmallow” line
4 that they contend is like getting “two Squishmallows in one.” See https://www.toynews-
5 online.biz/2020/02/10/kellytoy-celebrates-as-global-sales-of-squishmallows-surpass-50-
6 million-since-launch/. Kellytoy’s Flip-A-Mallows misappropriate the related intellectual
7 property, including infringement of the patented design claimed in the Tee Turtle
8 Patents, and generally appear to copy Tee Turtle’s Reversible Plushies.
9 23. Kellytoy’s violation of Tee Turtle’s intellectual property rights has and will
10 continue to cause significant damage to Tee Turtle’s market, including lost sales, lost
11 market share, lost reputation, and diminution of brand value. The Flip-A-Mallows
12 products that infringe on Tee Turtle’ s rights come in a variety of styles—including,
13 without limitation, the corgi/calico, dragon/unicorn, owl/fawn, shark/clownfish,
14 sloth/hedgehog, and pegasus/llama Flip-A-Mallows (the “Flip-A-Mallows Products”).
15 24. As an example of Kellytoy’s infringement, below is a comparison of one of
16 Kellytoy’s products, the sloth/hedgehog Flip-A-Mallow, with the claims of the Tee
17 Turtle Design Patents (note that the dashed lines in the design patents provide context but
18 are not required for infringement):

23 27. At no time has Tee Turtle given Kellytoy permission, license, or


24 authorization to use any of the Tee Turtle Patents.
25 28. On or about March 7, 2020 Kellytoy first announced the launch of the Flip-
26 A-Mallows Products on its Twitter account, which has over 45 thousand followers. On
27 its website on April 6, 2020, at https://squishmallows.com/kellytoy-expands-

1 squishmallows-with-reversible-flip-a-mallows/, Kellytoy formally announced its new


2 line of “reversible Flip-A-Mallows plushes.”
3 29. Even before that announcement, on March 27, 2020, Tee Turtle’s counsel,
4 Case Collard, sent a cease and desist letter to Kellytoy, informing them of their
5 infringing activities, and enclosing copies of the ʼ168 Patent, the ʼ127 Patent, and the
6 ʼ337 Patent. Mr. Collard further informed Kellytoy that Tee Turtle had applied for the
7 ʼ746 Patent, which Tee Turtle anticipated would issue in due course.
8 30. Thereafter, over the course of the next several months, through their
9 counsel, Tee Turtle and Kellytoy engaged in efforts to resolve this dispute. Counsel
10 exchanged correspondence on April 30, 2020, May 13, 2020, July 30, 2020, August 5,
11 2020, and throughout September to December 2020. In this correspondence, Tee Turtle
12 presented in great detail the basis of Tee Turtle’s infringement claims. Although counsel
13 negotiated in an effort to amicably resolve the matter, the parties were unable to reach an
14 agreement.
15 31. Despite having been informed of Tee Turtle’s Patents, Kellytoy continues to
16 sell, offer for sale, distribute, and/or manufacture its infringing Flip-A-Mallows Products.
17 For example, below is a screenshot from Kellytoy’s website, captured on December 8,
18 2020, showing that Kellytoy is presently offering for sale an infringing three-pack of 12
19 inch Flip-A-Mallows Products:

1 32. Kellytoy sells the infringing Flip-A-Mallows Products in direct competition


2 with Tee Turtle’s Reversible Plushies. In some instances, Kellytoy undercuts Tee
3 Turtle’s prices by selling the infringing Flip-A-Mallows at discount retailers such as
4 FiveBelow at prices well below the average price at which Tee Turtle sells its similarly
5 sized Reversible Plushies.
6 33. Kellytoy’s marketing of its infringing Flip-A-Mallows makes clear how
7 close a copy its products are. Kellytoy advertises its infringing Flip-A-Mallows on
8 various online platforms by referencing the reversible nature the Flip-A-Mallows. For
9 example, on its website, Kellytoy refers to the Flip-A-Mallows as “Reversible
10 Squishmallows” and uses arrows to indicate how the Flip-A-Mallows flip one from
11 configuration to another.
12 34. Kellytoy markets the Flip-A-Mallows Products aggressively through its
13 social media accounts. A February 10, 2020 article on a third party website indicates
14 that Kellytoy has over 200,000 followers across its social media accounts and has
15 millions of consumer interactions with its content. As an example, the article reports that
16 Kellytoy has over 20 million views of its videos posted on TikTok alone. On
17 information and belief, Kellytoy’s aggressive marketing online has led to significant
18 sales of Flip-A-Mallows Products.
19 COUNT I
20 Patent Infringement Under 35 U.S.C. § 271 of United States Patent No. D822,127
21 (Against All Defendants)
22 35. Tee Turtle re-alleges and incorporates herein by this reference each of the
23 preceding allegations in this Complaint.
24 36. As described herein, Defendants’ infringing Flip-A-Mallow Products have
25 been and are infringing one or more claims of the ʼ127 Patent pursuant to 35 U.S.C.
26 § 271(a), literally or under the doctrine of equivalents, by making, using, offering to sell,
27 and/or selling in the United States products that are covered by one or more claims of the
28 ʼ127 Patent.

1 37. Tee Turtle is informed and believes and thereupon alleges that the acts and
2 conduct of Defendants complained of herein constitute willful infringement.
3 38. Defendants’ infringement of the ʼ127 Patent has caused and will continue to
4 cause Tee Turtle substantial and irreparable injury, for which Tee Turtle is entitled to all
5 of the relief provided by 35 U.S.C. §§ 281, 283, 284, and 285, including but not limited
6 to injunctive relief or, should the Court find harm that is compensable by money
7 damages, compensatory damages including lost profits and not less than the amount of a
8 reasonable royalty, interest, costs, enhanced damages, and reasonable attorney’s fees, as
9 the court deems just and appropriate.

13 39. Tee Turtle re-alleges and incorporates herein by this reference each of the

15 40. As described herein, Defendants’ infringing Flip-A-Mallow Products have
16 been and are infringing one or more claims of the ʼ168 Patent pursuant to 35 U.S.C.
17 § 271(a), literally or under the doctrine of equivalents, by making, using, offering to sell,
18 and/or selling in the United States products that are covered by one or more claims of the
19 ʼ168 Patent.
20 41. Tee Turtle is informed and believes and thereupon alleges that the acts and
21 conduct of Defendants complained of herein constitute willful infringement.
22 42. Defendants’ infringement of the ʼ168 Patent has caused and will continue to
23 cause Tee Turtle substantial and irreparable injury, for which Tee Turtle is entitled to all
24 of the relief provided by 35 U.S.C. §§ 281, 283, 284, and 285, including but not limited
25 to injunctive relief or, should the Court find harm that is compensable by money
26 damages, compensatory damages including lost profits and not less than the amount of a

4 43. Tee Turtle re-alleges and incorporates herein by this reference each of the
5 preceding allegations in this Complaint.
6 44. As described herein, Defendants’ infringing Flip-A-Mallow Products have
7 been and are infringing one or more claims of the ʼ337 Patent pursuant to 35 U.S.C.
8 § 271(a), literally or under the doctrine of equivalents, by making, using, offering to sell,
9 and/or selling in the United States products that are covered by one or more claims of the
10 ʼ337 Patent.
11 45. Tee Turtle is informed and believes and thereupon alleges that the acts and
12 conduct of Defendants complained of herein constitute willful infringement.
13 46. Defendants’ infringement of the ʼ337 Patent has caused and will continue to
14 cause Tee Turtle substantial and irreparable injury, for which Tee Turtle is entitled to all
15 of the relief provided by 35 U.S.C. §§ 281, 283, 284, and 285, including but not limited
16 to injunctive relief or, should the Court find harm that is compensable by money
17 damages, compensatory damages including lost profits and not less than the amount of a
18 reasonable royalty, interest, costs, enhanced damages, and reasonable attorney’s fees, as
19 the court deems just and appropriate.
20 COUNT IV
21 Patent Infringement Under 35 U.S.C. § 271 of United States Patent No. 10,786,746
22 (Against All Defendants)
23 47. Tee Turtle re-alleges and incorporates herein by this reference each of the
24 preceding allegations in this Complaint.
25 48. As described herein, Defendants’ infringing Flip-A-Mallow Products have
26 been and are infringing one or more claims of the ʼ746 Patent pursuant to 35 U.S.C.
27 § 271(a), literally or under the doctrine of equivalents, by making, using, offering to sell,

3 49. Tee Turtle is informed and believes and thereupon alleges that the acts and
4 conduct of Defendants complained of herein constitute willful infringement.
5 50. Defendants’ infringement of the ʼ746 Patent has caused and will continue to
6 cause Tee Turtle substantial and irreparable injury, for which Tee Turtle is entitled to all
7 of the relief provided by 35 U.S.C. §§ 281, 283, 284, and 285, including but not limited
8 to injunctive relief or, should the Court find harm that is compensable by money
9 damages, compensatory damages including lost profits and not less than the amount of a
10 reasonable royalty, interest, costs, enhanced damages, and reasonable attorney’s fees, as
11 the court deems just and appropriate.
12 PRAYER FOR RELIEF
13 WHEREFORE, Tee Turtle prays for judgment against Defendants, jointly and
14 severally, as follows:
15 A. That the Court enter a judgment finding that Defendants have infringed on
16 one or more of the claims in the ʼ127 Patent under 35 U.S.C. § 271.
17 B. That the Court enter a judgment finding that Defendants have infringed on
18 one or more of the claims in the ʼ168 Patent 35 U.S.C. § 271.
19 C. That the Court enter a judgment finding that Defendants have infringed on
20 one or more of the claims in the ʼ337 Patent under 35 U.S.C. § 271.
21 D. That the Court enter a judgment finding that Defendants have infringed on
22 one or more of the claims in the ʼ746 Patent under 35 U.S.C. § 271.
23 E. That the Court enter a judgment preliminarily and permanently enjoining
24 Defendants and their officers, directors, agents, servants, employees, affiliates, attorneys,
25 and all others acting in privity or in concert with them, and their investors, partners,
26 parents, subsidiaries, divisions, successors, and assigns, from further acts of infringement
27 of the Tee Turtle Patents during the pendency of this case or after a final judgment in this
28 case.

1 F. Should the Court find harm that is compensable by money damages, a


2 judgment awarding Tee Turtle all damages adequate to compensate for each Defendant’s
3 infringement of the Tee Turtle Patents and/or each Defendant’s total profits pursuant to
4 35 U.S.C. § 284, and in no event less than a reasonable royalty for each Defendant’s acts
5 of infringement, including all pre-judgment and post-judgment interest at the maximum
6 rate permitted by law.
7 G. That the Court determine that such infringement was willful and award Tee
8 Turtle, against each of the Defendants, treble damages under 35 U.S.C. § 284.
9 H. That the Court enter an order declaring this an exceptional case and
10 awarding Tee Turtle its costs and disbursements, including reasonable attorney’s fees,
11 under 35 U.S.C. § 285.
12 I. That the Court award Tee Turtle pre- and post-judgment interest.
13 J. That the Court award Tee Turtle such other and further relief as the Court
14 may deem just and proper.
15 JURY DEMAND
16 Tee Turtle demands that all claims or causes of action raised in this Complaint be
