PETITION
PETITIONER H. F. E., through counsel, alleges:
1. That he is the principal complainant in a criminal
case for murder, namely (Title and Number of Case), which is pending before this court. 2. That, on 20 February 1963, the following news item appeared on page 1 of the newspaper (Name of News-paper): “In a certain criminal case pending before the Court of First Instance of Manila, three men are accused of having brutally murdered a suspected Japanese spy during the enemy occupation. This case is arousing widespread observation and comment, and the prevailing opinion is that courts and other instrumentalities of justice should not overlook the patriotic fervor which sometimes leads to improvident acts of the guerillas during the Japanese regime.” 3. That respondent T.S.C. is the editor of the aforementioned newspaper, and keeps office at (address). 4. That the above-quoted news item, aside from being false, tends to impede and obstruct the administration of justice, and consists in unlawful interference with the proceedings of this court. WHEREFORE, petitioner prays that respondent T.S.C., after being given a chance to be heard, be punished for contempt of court, imposing upon him such penalty as this court may deem just and proper in the premises.
