Santos, herein petitioner and administrator of a parcel of land known as Lot 17, located

at, entered into a contract with the defendant, for the lease of a portion of Lot 17
described as Lot 9. The lease contract was for a period of one (1) year, with a monthly
rental of ₱5, 000.00. After the expiration of the lease contract on March 10, 2020 the
defendant continued occupying the subject premises without paying the rent. On
November 8, 2021, the petitioner sent a letter to the defendant demanding that he vacate
the subject premises and pay compensation for its use and occupancy. The defendant,
however, refused to heed these demands. The petitioner filed a complaint for unlawful
detainer against the petitioner before the Municipal Trial Court (MTC), Branch 3. The
case was docketed as Civil Case No. 37826-CV. The petitioner prayed, among others,
that the defendant and those claiming rights under him be ordered to vacate the subject
premises, and to pay compensation for its use and occupancy. The defendant alleged that
the petitioner had no right to collect rentals.
