Your Excellencies, it is undeniable that the state of Rophan violated international law and the submissions of the

Respondent are incorrect in fact and in law.

________/lastly, on issue of STATE OF NECESSITY; Respondent claims that, as Amirans are a threat to the national
security of Rophan, the arbitrary expulsion of Amirans is justified. This is incorrect. While it is true that a state of
necessity, provided by the ARSIWA, may be used to justify the said action of Rophan, the ARSIWA, however, likewise
provide that in invoking the same, THE STATE MUST EXERCISE DUE DILIGENCE & GOOD FAITH. Here, Your
Excellencies, as the diplomatic negotiations of the parties herein arrived at a deadlock and their diplomatic ties severed,
Rophan, motivated by mere prejudice, deliberately and collectively identified all Amiran Nationals as criminal hackers
without even conducting investigations/proceedings to ultimately know the truth or establish factual findings. Therefore,
Your Excellencies, it is clear that Rophan did not exercise due diligence and acted in bad faith.

________/lastly, on the issue of the RIGHT OF THE STATES TO REGULATE THE PRESENCE OF ALIENS:
Respondent claims that the mass deportation of Amirans is justified by said right. This is likewise incorrect. While States
have the right to regulate the presence of aliens in its territory, under Article 13 of the ICCPR, however, once aliens are
allowed entry into the territory of a state party, they are entitled to the rights set out in the covenant, such as the right to
due process and individual examination of each alien’s case. In this case, Your Excellencies, Amirans entered Rophan by
reason of employment and thus had been lawfully admitted thereto. Hence, they have the right to be heard before any
competent authority before may be lawfully expelled therefrom. As such, Your Excellencies, Rophan violated Article 13
of the ICCPR.

________/lastly, on the issue of DUE PROCESS: Respondent claims that the diplomatic negotiations, the 48-hour
period, and the prior notices had already complied with the due process requirement. This is not correct. Article 13 of the
ICCPR requires decision in each individual alien’s case, which is wanting in this case as without even conducting an
investigation/proceedings before which each Amiran may advance his reasons and submit his own proof through counsel,
the Amirans was outrightly identified as criminal hackers and subjected to mass expulsion. As such, Your Excellencies,
Rophan violated Article 13 of the ICCPR.

________/lastly,, on the issue of THE ABSENCE RACIAL DISCRIMINATION: Respondent argues that, since there
are Amirans who may be exempt from the deportation, there is no racial discrimination in this case. This is likewise
incorrect. The facts of the case reveal that the issue arose because of the hacking incident, thereby accusing Amiran ICT
workers as the perpetrators, however, by issuing and implementing the joint statement, other Amiran workers not
employed in the ICT industry and are not otherwise falling under the exemptions, may be subjected as well to mass
deportation. Therefore, a group of workers is singled out and discriminated by mere reason of being Amiran Nationals,
which is clearly constitutes a violation of ICERD.
