MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

THIS MEMORANDUM OF AGREEMENT is entered into by and between:

The B.E.S.T. COLLEGE OF POLOMOLOK,INC., a Private Secondary Educational

Institution duly recognized by the Government of the Philippines, represented by its
Schools Principal MRS. LYDIA A. RAMOS, hereafter referred to as the FIRST PARTY;
-and-
The _____________________________________ , a domestic corporation duly
organized and existing under Philippine Laws with office/business address at
_______________________________________, POLOMOLOK, SOUTH COTABATO
herein represented by its
__________________________________________________, hereafter referred to as
the SECOND PARTY.

WITNESSETH:

The parties hereby bind themselves to undertake a Memorandum of Agreement for the
purpose of supporting the SCHOOLS Immersion Activity for student-trainees under the
following terms and conditions:

WHEREAS, the FIRST PARTY shall be responsible for briefing the on-the-job student-
trainees who intend to conduct practicum exposure on the SECOND PARTY as part of
the SCHOOL'S curriculum;

WHEREAS, the FIRST PARTY shall provide the on-the-job student-trainee the basic
orientation on work values, behavior, and discipline to ensure smooth cooperation with
the SECOND PARTY;

WHEREAS, the FIRST PARTY shall issue an official endorsement vouching for the well
being of the on-the-job student-trainee which shall be used by the SECOND PARTY for
processing the application of the student-trainee;

WHEREAS, the FIRST PARTY shall voluntarily withdraw a student-trainee who is found
to misbehave and/or act in defiance to existing standards, rules, and regulations of the
SECOND PARTY and impose necessary sanctions to the said student-trainee;

WHEREAS, the SECOND PARTY may grant allowance and/or adequate insurance to
student-trainee in accordance with the SECOND PARTY’S existing rules and
regulations;

WHEREAS, the SECOND PARTY, upon consultation with the FIRST PARTY, may
require qualified students to submit themselves to examinations, interviews, and file
pertinent documents to support their application;

WHEREAS, the SECOND PARTY is not obliged to employ student-trainee upon

completion of the training;

WHEREAS, the student-trainees shall be personally responsible for any and all
liabilities arising from negligence in the performance of his/her duties and functions
while under training;

WHEREAS, There is no employer-employee relationship between the SECOND

PARTY and the student-trainee;

WHEREAS, the duration of the program shall be equivalent to 80 working hours for
Academic Tracks (ABM, STEM, HUMSS) and 240 working hours for TVL (HE-Cookery,
AUTOMOTIVE, SMAW, ICT) unless otherwise agreed upon by the SECOND PARTY
and the FIRST PARTY;

WHEREAS, Any violation of the foregoing covenants will warrant the cancellation of the
Memorandum of Agreement by the SECOND PARTY within thirty (30) days upon notice
to the FIRST PARTY.

WHEREAS, the SECOND PARTY granted the request of the FIRST PARTY to be the
HEI partner in the implementation of Senior High School (SHS) in 2017-2018 and tap
the qualified employees with NC II & Licenses to teach the SHS Laboratory Activities.

WHEREAS, the FIRST PARTY agreed that the SECOND PARTY should impose proper
discipline to their SHS students as provided in the B.E.S.T. COLLEGE OF

POLOMOLOK, INC., students manual and to be responsible in the conduct of

laboratory activities.

WHEREAS, the SECOND PARTY granted the request of the FIRST PARTY to accept
ten (10) TVL-HE Cookery students to undergo immersion at _____________________.

NOW THEREFORE, in consideration of the foregoing premises, both parties

hereunto agreed, as they agree to the following terms and conditions:

RESPONSIBILITIES OF THE PARTIES

A. B.E.S.T. COLLEGE OF POLOMOLOK, INC.

1. Coordinates with the ___________________________________ in terms of

laboratory activities, updatings and other matters related to the

implementation of the Senior High School.

2. Takes care of the ___________________________________facilities used

during the laboratory activities.

3. Assures the proper conduct and discipline of B.E.S.T. COLLEGE OF

POLOMOLOK, INC. students during their laboratory acitivities.

4. Conducts proper monitoring of the early implemetation of its Senior High

School.

B. ____________________________________

1. Assists B.E.S.T. COLLEGE OF POLOMOLOK, INC. in their implementation

of the Senior High School and updatings of its syllabi.

2. Allows B.E.S.T. COLLEGE OF POLOMOLOK, INC. to make use of its

facilities whenever the need arises.

3. Provides B.E.S.T. COLLEGE OF POLOMOLOK, INC. technical assistance

by ___________________________________personnel during their conduct

of laboratory activities

AMMENDMENTS

1. No modification of this Memorandum of Agreement or any part thereof shall be

made except upon execution of a written instrument duly signed by both

PARTIES.

2. Should circumstance necessetates the revision of the provisions embodied in this

Memorandum of Agreement, the concerned PARTIES shall, prior to such

revision, coordinate in the process of revision and grant a reasonable grace

period of implementation of such revision.

EFFECTIVITY

This Memorandum of Agreement shall take effect immediately upon signing by all
Parties concerned and shall remain in force unless sooner terminated by mutual
consent.

IN WITNESS WHEREOF, the Parties to the Memorandum of Agreement through their

respective representatives have hereunto confirm to its term and affix their signature
