COMPREHENSIVE ROAD SAFETY ORDINANCE

EXPLANATORY NOTE:

WHEREAS, the Province/City/Municipality of ____________ is among the Local


Government Units which promote and advance the policy on violence and injury
prevention in particular to promote a culture of safety on roads as enunciated under
the Administrative Order No. 2014-0002 entitled National Policy on Violence and
Injury Prevention Program (VIPP) by the Department of Health through the
Regional Office VI with technical inputs from the Violence and Injury Prevention
Alliance (VIPA) VI.

WHEREAS, Republic Act 10916. Road Speed Limiter Act of 2016

WHEREAS, Republic Act 8750. Seat Belts Use Act of 1999

WHEREAS, Republic Act 10054. Motorcycle Helmet Act Of 2009

WHEREAS, Republic Act 10586. Anti-Drunk and Drugged Driving Act of 2013

WHEREAS, Republic Act 10913. Anti-Distracted Driving Act of 2016

WHEREAS, Republic Act 10666. Children’s Safety on Motorcycles Act of 2015

WHEREAS, with the noted increase of road crashes the need to espouse and raise
the level of awareness and for the Province/City/Municipality/Barangay to jointly and
harmoniously advocate and implement the road safety regulation of the
Province/City/Municipality of ____________.
WHEREAS, by providing standards of safe driving for road users and enacting
measures for road safety purposes, injuries, crashes and deaths may be mitigated, if not,
stopped from increasing;

NOW THEREFORE, on motion of _____ Member _________, unanimously


seconded by ____ Members present, BE IT ORDAINED by the Sangguniang _______ of
the Province/City/Municipality of __________ in Regular Session assembled hereby
adopts the following:

Section 1. Title. This ordinance shall be known as the “Comprehensive Road Safety
Ordinance of the Province/City/Municipality of ____________.”

Section 2. General Objective. To address the increasing number of road crashes,


injuries and deaths in the Province/City/Municipality of ____________.

Section 3. Specific Objectives.

3.1 To decrease number of road crashes, injuries and deaths in the


Province/City/Municipality of ____________.

3.2 To maintain risk-free roads in the Province/City/Municipality ________ .

3.3 To promote respect and harmony among road users and pedestrians.

3.4 To teach the general public on the importance of pedestrian and commuter safety.

3.5 To promote safety and immediate road access to all road users especially in times
of emergencies.

Section 4. Definition of Terms - As used in this Ordinance, the term below shall
have the meanings ascribed to them in this section. Any word or term not defined shall be
given their plain meaning and customary meaning, unless the context requires otherwise
and shall be integrated in a manner consistent with the purposes and spirit of this
Ordinance.

a. Alcohol - refers to alcoholic beverages, the consumption of which produces


intoxication.

b. Breath Analyzer - refers to equipment which can determine the blood alcohol
concentration level of a person through testing of his breath.
c. Chemical Test - refers to breath, saliva, urine or blood tests to determine the
blood alcohol concentration level of a person through testing of his breath.

d. Dashboard Camera – a video camera attached to the windshield or dashboard of


a vehicle, used to record the view outside, or, with a double lens, both outside
and inside the vehicle

e. Double Parking - refers to putting into a halt or parking vehicle on the roadway
side of another vehice already stopped.

f. Driver – refers to any person operating a motor/electric vehicle.

g. Driving under the influence of alcohol - refers to the act of operating a


motor/electric vehicle while the driver’s blood alcohol concentration level has,
after being subjected to a breath analyzer test, reached the level of intoxication,
as established jointly by the Department of Health (DOH), the National Police
Commision (NAPOLCOM) and the Department of Transportation (DOTr).

h. Driving under the influence of dangerous drugs and other similar substances -
refers to the act of operating a motor vehicle while the driver, after being
subjected to a confirmatory test as madated under the Republic Act No. 9165 is
found to be positive for use of any dangerous drug.

i. Drying of palay on public road – refers to the act of making the


National/Provincial/City/Municipal/Barangay Road as place/area for drying
palay and putting barricades on both ends.

j. “Distracted driving” – refers to the use of mobile communications or


entertainment devices by drivers while driving, whether in motion or temporarily
stopped at a red light, including the use of mobile communication devices or
electronic entertainment or computing devices, and other similar acts.
k. Early Warning Device - early warning device consisting of a triangular;
collapsible reflectorized plates in red and yellow colors at least 5 cms. at
the base and 40 cms at the sides; whenever any motor vehicle is stalled
or disabled or is parked for thirt (30) minutes or more on any street or
highways, including expressways or limited access roads, the owner, user
or driver thereof shall cause the warning device mentioned herein to be
installed at least four (4) meters away to the front and rear of the motor
vehicle stalled, disabled or parked

l. Electronic Vehicles – a vehicle that is driven by an electric motor which draws


its current either from storage batteries or from overhead cables .

m. Foot Peg/Rest – refers to flat form attached to motocycles on which to stand or


brace the feet.

n. Helmet – refers to a protective head covering which is required by the law to be


worn by motorcycle driver and backrider while on travel.

o. Motor Vehicle – refers to any land transportation vehicle propelled by any power
other than muscular power.

p. Motor vehicle designed to carry hazardous materials - refers to a vehicle


designed to carry or transport materials which may endanger health and lives of
the public.

q. Parking – refers to the act of putting a halt a motor vehicle beside the road and
leaving the premises of the vehicle for more than five (5) minutes.

r. Passenger – refers to a traveler on a public or private conveyance other than the


driver or crew.

s. Public Utility Vehicle (PUV) – refers to motor vehicles for hire and used to carry
or transport passenger or goods.

t. Pedicab (Trisikad) – a bicycle pedal driven vehicle with a side cabin carrying
passengers mostly in urban barangays.
u. Road Shoulder – is a strip of pavement outside an outer lane; it is provided for
emergency use by traffic and to protect the pavement edges from traffic damage

v. Seat belt – refers to any strap, webbing or similar device in the form of pelvic
restraints or lap belt,upper torso restraint or shoulder strap or a combination
thereof designed to secure a person in a motor vehicle in order to mitigate the
results of any accident, including all necessary buckles and other fasteners and
all hardware designed for installing such seat belt device in a motor vehicle.

w. Speed gun – a device used to measure the speed of moving vehicles.

x. Speed Limiter – A speed limiter is a governor used to limit the top speed of a
vehicle. For some classes of vehicle and in some jurisdictions they are a
statutory requirement, for some other vehicles the manufacturer provides a non-
statutory system which may be fixed or programmable by the driver

y. Traffic – refers to the flow and motion, ingress and egress, transit and stops,
terminal and waiting stations of motored and non-motored vehicles and
pedestrians.

Section 5. Prohibited Acts - the following acts are declared unlawful and prohibited
by this Ordinance:

a. Driving under the influence of Alcohol or Dangerous Drugs.


b. Drying of palay along the National/Provincial/City/Barangay Road and placing
barricades on it.
c. Stockpiling of construction materials and debris along the
National/Provincial/City,/Barangay except for those intended for the
implementation of government projects provided warning devices are installed.
d. Parking on the National/Provincial/City/Barangay Road covering more than three
(3) feet of the road from its shoulder.
e. For Public Utility Vehicles (PUV), for stopping and dropping passengers on the
Roads within National/Provincial/City/Barangay Road covering more than four
(4) feet of the road from its shoulder.
f. Double Parking along the National/Provincial/City/Barangay Road with the
National/Provincial/City,/Barangay of _______.
g. Parking and washing of vehicles on the overflow bridges.
h. Overloading and hitching of passengers in PUV.
i. Modifying of vehicles’ lights, mufflers and installation of sound systems causing
vision and hearing disturbances to drivers and other vehicles, the driver of the
vehicle itself, other road users and the general public.
j. Removing of side mirrors in vehicles, causing vision impairment of trailing and
overtaking of vehicles.
k. Slow moving vehicles, motorcycles and tricycles using the inner lane in a four
lane road, must take the outer lane always.
l. Use and plying of pedicabs in national roads.
m. Ambulant vending in road shoulders.
n. Planting of crops, trees and ornament in road shoulders.
o. Non-wearing and absence of seat belt while inside a vehicle with running engine
on any road or thoroughfare.
p. Drivers are prohibited from using mobile communications or entertainment
devices while driving, whether in motion or temporarily stopped at a red light.
q. Children should not be allowed to ride motorcycles on any road within
National/Provincial/City,/Barangay Road unless the follwing conditions are
present:
q.1 The child’s feet must be able to comfortably reach the footrest of the motorcycle;
q.2 The arms of the child can reach around and grasp the waist of the motorcycle driver.
q.3 The child is mentally-capable to appreciate the need to hold on to the rider; and
q.4 Only one (1) child is riding the motorcyle.
r. For Speed Limit, refer to Maximum Allowable Speeds under Republic Act 10916.
s. Driving without Driver’s License.
t. Driving an unregistered vehicle.
u. Driving/Riding motorcycles without helmet.

Section 6. Designation of School Crossing Enforcer, Pedestrian Crossing Lanes


and PUV Stops.

a. Pedestrian lanes whenever applicable must be painted by a reflectorized paint on


the road surface.

b. PUV stops and any related signages shall be posted clearly on the sidewalk
abutting the roadway.

c. Pedestrian lanes in every school shall have a School Crossing Enforcer who shall
be responsible for guiding students in road crossing and to control the traffic to
maintain road safety in the area
Section 7. School Based Road Safety Measures

All educational institutions, private and public are strongly encouraged to include in
their instructions and provisions in this ordinance, emphasizing the advantage of a safety
road as a part of their daily route in going to their school.

Section 8. Community Based Pedestrian Training

A practical road side pedestrian training shall also be encouraged in every


Barangay/City/Municipality/Barangay, other sectors, as part of road safety awareness.

Section 9. Road Safety Taskforce of _________ Creation of a Road Safety


Taskforce which shall be responsible for the implementation of the provisions of the
Ordinance and other safety awareness programs, projects and activities in coordination
with various government and non-government organizations in the __________.

Section 10. Objectives of Road Safety Taskforce of ________


Objectives:

1. To restore the public’s trust regarding road safety by increasing safety awareness
programs and activities throughout the ________.
2. To enhance safety education by holding road safety lectures through seminars in
schools and in the barangays.
3. To promote the safety and comfort of the travelling public with respect to motor
vehicles, motorcyles, and tricycles.

Section 11. Composition of Road Safety Taskforce of ________.

1. Governor/Mayor/Brgy. Captain or his duly designated representative as


Chairman.
2. Sangguniang _______ Committee on Public Order and Safety as Co-
Chairperson.
3. Member:
a. Health Office
b. PNP
c. Designated Traffic Chief
d. Department of Education
e. President of _______ Transport Group/Federation
f. ABC President
g. Engineering Office
h. DRRMO
i. BFP
Section 12. Function of Road Safety Taskforce of ________ - shall be responsible
for the monitoring and implementation of the Comprehensive Road Safety Ordinance.

Section 13. Meeting of Road Safety Taskforce of ________. The Road Safety
Taskforce of the ________ shall meet at least once in a quarter or as often as needed.
Majority of its members shall constitute a quorum.

Section 14. Enforcement

The Road Safety Task Force or its duly authorized officers shall implement and
enforce the mandate of this Ordinance, as well as in the conduct of educational awareness
campaigns, information dissemination programs that will inform the constituents of
________.

A road safety orientation conducted by Road Safety Taskforce shall be a requisite for
the issuance/renewal of franchise and mayor’s permit and business license.

Section 15. Funding

The ________ shall appropriate funds in the amount of _________ Pesos (0.00) per
year for the Road Safety Ordinance programs and projects.

Section 16. Penalty Clause

Violation of any provision in Section 5 of this Ordinance shall be punishable by a


fine as follows:

1st Offense - P 500.00 plus road safety seminar


2nd Offense - P 1,000.00 plus forty (40) hours of community service
3rd Offense - P 3,000.00 plus six (6) months to one (1) year imprisonment

For acts in violation of Section 5-b hereof, the owner of palay shall be responsible for
the payment of fine.

For acts in violation of Section 5-i hereof, the modified lights, muffler and sound
system shall also be confiscated in the second and succeeding offense.
Of the collected fine, 20% shall be given as incentives to the enforcers directly
involved in the apprehension, 30% shall accrue to the general fund, while the remaining
50% shall be deposited in a special account within the general fund which shall be
created by virtue of this ordinance to be used for road safety education, medical services
and logistics, and engineering.

Section 17. Repealing Clause

All ordinances, rules and regulations or parts thereof, in conflict with or in contrary
with to the provisions of this Ordinance are hereby repealed, amended and modified
accordingly.

Section 18. Separability Clause – if for any reason, any section of this ordinance
shall be held unlawful, other section which are not affected hereby shall continue to be in
full force and effect.

Section 19. Effectivity

This Ordinance shall take effect ___days after its publication in a newspaper or
approval of the _____ and of local circulation as required by law or posting in all
conspicuous places in the Province/City/Municipal/Barangay.
