TERMS OF REFERENCE FOR THE SUBDIVISION SURVEY


OF NEW LANDS AND COLLECTIVE CLOAS

I. BACKGROUND AND RATIONALE:

Land acquisition is the process of acquiring private agricultural lands in order of priorities and
implementation as provided by RA 6657 as amended by RA 9700 under the different modes of acquisition.
It involves identification of landowners, landholdings and beneficiaries, land surveys, land valuation, and
transfer of ownership from the landowner to the Republic of the Philippines. Part of land acquisition is
the ocular inspection or field inspection of the landholding, which involves the verification and
identification of its location, boundaries and the beneficiaries within it, and whether it could be totally or
partially acquired using an Approved Subdivision Plan as reference.

Land distribution, as the final stage of land tenure improvement, is the process of generation,
registration and distribution of the Emancipation Patent (EP) and Certificate of Land Ownership Award
(CLOA) on the individual tillage of the Agrarian Reform Beneficiaries (ARBs) / tillers based on the Approved
Survey Plan (ASP) – either under collective or individual ownership – of a public or private agricultural
land. Moreover, one of the basic requirements of the Registry of Deeds in the registration of EP and/or
CLOA is the ASP.

The following are the properties/lots which are potential areas intended for subdivision to actual
occupants, to wit;

II. OBJECTIVE OF SUBDIVISION SURVEY:

The objective of the subdivision survey is to assist landowners and farmer beneficiaries/tillers to
facilitate easily the identification of their lot claimed, secure needed requirements, and likewise to
generate approved survey plan and individual tabular technical description of each lot within the
subdivision plan necessary in the generation of Emancipation Patents (EPs) and Individual Certificate of
Land Ownership Awards (CLOAs)

III. FUND SOURCE

The funding for the survey modules shall be from the Land Use Management & Development
(LUMD) fund of the Department of Agrarian Reform (DAR).

IV. SCOPE OF THE PROJECT:

The works to be undertaken includes the furnishing of labor, materials, tools,


instruments/equipment and other facilities necessary in the execution of the relocation/boundary,
perimeter land use mapping (PLUM) and subdivision surveys as well as the setting of standard AR
cylindrical concrete monuments on all subdivision corners of all lots described in the Approved Survey
Module.

The works shall include the following features:

a. Reconnaissance/Preliminary sketching of all landholdings


b. Fabrication and delivery on site of standard AR cylindrical concrete monuments
c. After the initial “pulong-pulong”, conduct perimeter/relocation survey of the boundary of the
entire property and mark all corners with the prescribed markers/monuments (Section 6.3.1,
DAR-MC No. 15, S. 2013 dated August 22, 2013)
d. Conduct of segregation and subdivision survey of all lots included in the approved module
shall be executed in accordance with Section 6.3.2 to 6.3.5 of DAR-MC No. 15, S. 2013
e. Preparation of survey computations and subdivision plans using the prescribed LMB forms
together with the DLSD files
f. Submission of acceptable and complete survey returns to DENR-Technical Services for
verification and approval with E-copy in compliance with LAMS Philippines
g. Submission to the DARRO the following documents:
i. Polyester copy of all approved survey plans,
ii. Eight (8) certified blue print copies of all approved survey plans,
iii. Eight (8) certified blue print copies of all lot descriptions sheets (if applicable)
iv. Eight (8) certified copies of tabular technical descriptions of all subdivision lots within the
project
v. One (1) electronic copy on CD of Approved Survey Plan, Lot Descriptions, Tabular
Technical Descriptions and Lot Data Computations.

h. For New Lands, one (1) blueprint copy of Advance Survey Plan with land use and certification
that advance survey plan is the same subdivision plan attached to the Survey Returned
submitted or for submission to DENR-TS, Legazpi or to LRA, Quezon City for verification and
approval.

V. RESPONSIBILITIES OF THE SURVEY CONSULTANT

It is the responsibility of the Survey Consultant to abide with the provisions of the services
agreement, specifically:

a. Coordinate with the DARPO and DARMO for the scheduling of the conduct of initial pulong-
pulong and execution of field survey of all landholdings within the project
b. Conduct the relocation/boundary, perimeter land use and subdivision survey
c. Fabricate, deliver on site and setting/planting of standard AR cylindrical concrete monuments
d. Prepare the corresponding survey returns using the prescribed LMB forms
e. Submit the survey returns to the DAR for review of operational and technical completeness
f. Submit the survey returns with DLSD File to DENR-TS for verification and approval
g. Coordinate regularly with the DENR-TS for the verification and approval of survey returns
h. Submit to the DAR the documents enumerated in IV.g.

VI. RESPONSIBILITIES OF THE DAR

As the implementor of the project, the DAR has the following responsibilities:

a. Provide technical assistance to the survey consultant


b. Provide the survey consultant with the needed documents pertinent to the Project
c. Provide/assign DAR personnel to assist in the conduct of initial pulong-pulong, field survey,
and final pulong-pulong/validation
d. Review the completeness and correctness of the survey returns
e. Supervise, monitor and inspect the implementation of the project
f. Prepare claim vouchers and pay the survey consultant based on the approved schedule of
payments
g. Evaluate, assess and review the accomplishment of the survey consultant

VII. CONTRACT DURATION OF THE PROJECT

Allocated time for the conduct of research, survey, monumenting, preparation and submittal of
the complete survey returns shall be 90 calendar days from the issuance of Notice to Proceed up to the
submittal thereof to the DENR-TS for Inspection, Verification and Approval of Surveys (IVAS) in accordance
with the specification under Chapter VI, Article 21 of the Manual for Land Survey Procedures.

However, the Department may extend the service agreement period due to valid reasons, such
as force majeure, fortuitous events, or lawful order of the competent authorities.

Upon receipt of the consultant’s requests for survey schedule and submission of the survey
returns to the DAR Municipal Office, DAR Provincial Office, DAR Regional Office and DENR-LMS, running
of the service agreement period shall be suspended.

VIII. DETAILED ACTIVITIES

After receipt of the Notice to Proceed, the Survey Consultant shall:

1. Research and Pre-Survey Verification


a. Research work where the technical documents could not be provided by the DAR
b. After research, in order to ascertain the workability of the lots included in the awarded
module, the Consultant shall conduct pre-survey verification which will include Technical
review to determine if the lots are not problematic e.g. with open parcel, inconsistency
in the areas per title, plan or technical description

2. Conduct of Initial “Pulong-pulong”


a. Coordinates with respective MARPO regarding the schedule of “pulong-pulong” and field
survey with BARC and farmer-beneficiaries;
b. The Consultant shall discuss the work plan and time frame to allow the parties to adjust
their respective schedule;
c. After final “pulong-pulong”, the Consultant shall relocate the boundary of the entire
property
d. The Consultant shall prepare and submit report supported by MARPO’s certification if
awarded lots were found not deliverable. DARPO to issue termination letter of the service
agreement, as the case may be.

3. Conduct of Field Works

In the conduct of field survey, the provisions of the DENR Administrative Order No. 98-12
otherwise known as the Revised Manual of Land Surveying Regulations in the Philippines shall be
followed.

a. The Consultant shall conduct reconnaissance of all lots within the project to locate the
control points and boundaries and determine the actual occupants and land uses of each
lot within the landholdings.
b. The Consultant shall coordinate and notify the DARPO, DARMO, the concerned LGU
officials and the FBs on the date of the execution of the field survey.
c. The Consultant shall relocate the boundary of the entire property.
d. The Consultant shall conduct subdivision survey of CARPable area and determine its land
use and non-CARPable areas as well as the retention area of the Landowner in the
presence of concerned DARMO personnel, FBs, concerned landowner or his/her
representative.
e. All corners of the resulting lots subdivision survey shall be planted with standard AR
cylindrical concrete monuments 15x40 cm.
f. The Consultant shall prepare an advance plan with land use, which shall be signed and
submitted to the PARPO including the technical descriptions of each of the sub-lots as
reference of the DAR-LBP joint field investigation, does not need approval of the DENR-
TS (for LBP Compensable Lands).
g. Prepares preliminary subdivision scheme for preliminary validation of the MARPO and
the farmer-beneficiaries/tillers;
h. If there are revisions/modifications in the subdivision scheme, name of claimants, area
occupied by each claimant, the consultant shall abide except for instances where it will
violate the Land Survey Manual of the Philippines or the CARPer Law;
i. The maximum award limit to each ARB/tiller or preferred beneficiary and retention area
of the landowner/s shall be strictly observed.

4. Conduct of Validation of Survey

The Consultant shall submit the subdivision plan, CARP Survey Profile and Joint MARO-GE
Certification to the DARMO for validation and signature. The validation shall be conducted to
verify the correctness of the result of the subdivision survey. All deficiencies noted shall be
corrected by the Consultant both in the computations, on the plan and on the ground.

The survey returns of the validated subdivision survey shall be submitted to the DARPO
for preliminary review as to the correctness and completeness of technical and operational
requirements.

5. Survey Returns Preparation and Approval


a. Prepares the final subdivision plan for final validation of the MARPO, CARP survey profile
and PARPO/MARPO/GE Certification which shall be signed.
b. Prepares the complete survey returns for initial review and verification of the DARPO
Survey Section, consists of the following;
b.1 Transmittal of Survey Returns;
b.2 PHILARIS/Verified copy of the title; for Untitled Property, CARPER LAD Form 2-A or
2-B (JAO 3, S. 2014)
b.3 Subdivision plan duly validated by the MARPO concerned;
b.4 PARPO/MARPO/GE certification that the lot was surveyed and fully monumented;
b.5 CARP Survey Profile;
b.6 Lot data computation sheets using true coordinates
b.7 Traverse computation
b.8 Common Point computation
b.9 Location Monument Recovery Report
b.10 Field notes Cover, duly notarized
b.11 Field notes duly signed by the GE
b.12 Reference document – cadastral map, lot data computation sheet of the boundary;
copy of the old survey plan or LRC approved plan (if applicable)
b.13 E-copy of Digital Land Survey Data (DLSD) File

c. Endorses the complete survey returns to DARRO.


d. Coordinates / Follow-up with DENR-TS on the approval of surveys.

6. Required Outputs

Upon approval of the survey returns, the survey consultant shall facilitate the generation
and submission of the following to the DARRO:
a. One (1) Polyester copy and eight (8) certified blueprint / whiteprint copies of the duly
Approved Survey Plan.
b. Eight (8) copies of Tabular Technical Descriptions.
c. One (1) electronic copy on CD of Approved Survey Plan, Lot Descriptions, Tabular
Technical Descriptions and Lot Data Computations.

IX. PROJECT COST

X. SCHEDULE OF PAYMENT

Payment of the contract price shall be made to the Consultant in accordance with the following
schedule:

1. Forty percent (40%) of the services agreement price upon certification of the Regional
Technical Director of DENR-TS or his authorized representative as to acceptability of survey
returns for verification and certification of the PARPO as to completion of all field and office
works including the complete monumenting of all lot corners of lands in the project.
2. Sixty percent (60%) of the Services agreement price, after the final approval of the complete
survey returns, submission to and certification of DARRO of the receipt of the required
documents.

A ten percent (10%) retention for every collection / payment shall be withheld to care of any
contingency, such amounts shall be released and paid to the Consultant forty five (45) days after
submission of all documents provided that there are no valid complaints on record filed with the DARPO
against the Consultant or regarding the manner of execution of the module project.

XI. TRAINING

The Consultant must be:

a. Of good standing with a certification to that effect issued by the Geodetic Engineers of the
Philippines, Inc., Region V and from the place of origin
b. With CARP Accreditation
c. With LAMS Accreditation

XII. OTHER INSTRUCTIONS

The PARPO or his authorized representative shall supervise the operation of the Survey
Consultant, and shall issue instruction from time to time, as may be deemed necessary for the proper
execution of the project. Likewise the PARPO or his authorized representative shall verify fieldworks done
by the Consultant through the conduct of field inspection and review of records such as subdivision plans
and computations, furnished by the Consultant free of charge.

The MARPO shall ensure constant availability of its duly authorized representative during the
actual execution of the field survey.

XIII. MODE OF PROCUREMENT

The mode of procurement is through Public Bidding.

XIV. LEGAL LIABILITIES

The Survey Consultant shall, even after the submission of all polyester copies, approved survey
plans, lots descriptions sheets, tabular technical descriptions and other supporting documents to the DAR,
be responsible for any correction of any mistakes or errors in the survey, provided it is still within the
prescribed period of 45 days from receipt of the DARMO of the ASPs and TTDs.

Otherwise, if the MARPO had already issued the corresponding certification as to the receipt of
complete and correct ASPs and TTDs after the lapse of 45 days, the Survey Consultant can no longer be
obliged to do the correction.

XV. APPLICABLE LAWS AND REGULATIONS

All laws and regulations issued by the DAR and the DENR pertinent to the execution of
relocation/boundary and subdivision survey are hereby made integral part of this Terms of Reference
whenever applicable.
