U.S. Department of Justice Bureau of Alcohol, Tobacco, Firearms and Explosives Assistant Director March 3, 2021 700000:BGH 3140 MEMORANDUM TO: All Special Agents in Charge FROM: Assistant Director, Field Operations SUBJECT: Update to NICS Management Log Entries Responsibilities regarding Delayed Denial Investigations This memorandum serves to implement a new reporting requirement to NICS Delayed Denial investigations in the approved case management system. Effective immediately, mandatory 30 day management log updates to open NICS delayed denials will be documented in the approved case management system within the first 10 days of each month using the mandatory drop down management log tab titled “NICS Delayed Denial Monthly Update”, ATF Order 3140.1, Denial Enforcement and NICS Intelligence Branch — Referrals and Investigations on page 7, Section 2(d) will be updated to reflect this procedural change. The updated language to this section is in bold below: the firearm has not yet been retrieved, returned, or otherwise removed from the possession of the suspected prohibited possessor, and, when the investigation confirms the existence of a prohibition, the special agent will update the continued investigative activity, at a minimum, every 30 days in N-Force within the first 10 days of each month using the mandatory drop down management log tab titled “NICS Delayed Denial Monthly Update” along with the case agent's corresponding investigative activity entry. A Field Management Staff notification has been prepared regarding this reporting requirement and an appropriate case management log snapshot has been included as reference to guide the field in implementing the change. This change is effective immediately. ATF © 3140.1A will be updated to reflect this policy change update when re-certified.
