 La maîtrise d'ouvrage (MOA)
La maîtrise d'ouvrage (MOA)
(Owner/Client), aussi dénommée maître d'ouvrage
est l'entité porteuse d'un besoin, définissant
l'objectif d'un projet, son calendrier et le budget
consacré à ce projet. Le résultat attendu du projet
est la réalisation d'un produit, appelé ouvrage.
La maîtrise d'ouvrage est à l'origine de l'idée
de base du projet et représente, à ce titre, les
utilisateurs finaux à qui l'ouvrage est destiné.

 Maîtrise d'œuvre (MOE)
Le maître d’œuvre (MOE) (Engineer/Consultant)
est la personne physique ou morale, publique ou privée,
qui, en raison de sa compétence technique, est chargée par
le maître de l’ouvrage ou son mandataire, afin d’assurer la
conformité architecturale, technique et économique de la
réalisation du projet objet du marché, de diriger
l’exécution des marchés de travaux, de lui proposer leur
règlement et de l’assister lors des opérations de réception
ainsi que pendant la période de garantie de parfait
achèvement.

 Bureau de Contrôle technique
Le contrôle technique de la construction vise
à prévenir les aléas techniques susceptibles de se
produire dans les projets de construction
notamment et pouvant entraîner des sinistres. Le
contrôle technique se fait principalement dans les
domaines de la solidité de l'ouvrage et de la
sécurité des personnes, particulièrement par la
vérification du respect des règles de l'art.

 L'Entrepreneur
L'Entrepreneur est celui qui se charge de la
Conduite et de l'Exécution d'un Bâtiment, sur les
Dessins de l'Architecte. Quelquefois l'Architecte
lui-même devient Entrepreneur (A ne pas
conseiller, il y a un conflit d’intérêt)

Les Cahiers de Charges comprennent
normalement 4 documents:
1. Cahier des Clauses Administratives Générales et
Particulières CCAG et CCAP (Conditions of
Contract)
2. Cahier des Clauses Techniques Générales et
Particulières CCTG et CCTP (Specifications)
3. Devis (Bill of Quantities (BOQ))
4. Plans (Drawings)

 Devis (Bill of Quantities (BOQ))
« Les devis (ou BOQ en abréviations du
terme anglais « Bill Of Quantities » et marchés en
matière de construction sont, dans un sens général,
l'ensemble des conventions qui interviennent entre
le propriétaire et les constructeurs, pour régler le
mode d'exécution d'une construction déterminée.
C'est l'entrepreneur en bâtiment qui contracte le
marché, et non pas l'architecte.

 Devis (Bill of Quantities (BOQ))
Le Devis normalement se divise en taches
(ou divisions): Excavation, Béton, Maçonnerie,
Bois, finitions, Plomberie, Ventilation, Electricité,
etc…
Il se présente en forme de tableaux divisés
en deux parties:
- Descriptif et Quantitatif préparé par le
Consultant.
- Estimatif chiffré par l’Entrepreneur.

 Types de Marché (Contrat)
1. “Re-measured Contract” (Marché à Prix
Unitaires): Dans le tableau du Devis (BOQ),
les quantités préparées par le consultant ne
sont pas exactes. L’entrepreneur sera payé
suivant le métré des quantités réelles préparé
par lui même après exécution et approuvé par
le consultant. Les prix unitaires de l’offre de
l’entrepreneur restent inchangeables.

 Types de Marché (Contrat)
2. Marché forfaitaire (“Lump-Sum contract”): Dans le
tableau du Devis (BOQ), quelle que soit l’exactitude
des quantités préparées par le consultant, celles-ci
restent inchangeables. L’entrepreneur sera payé
suivant ces quantités. Les prix unitaires de l’offre de
l’entrepreneur restent aussi inchangeables. Par
conséquent, lors de la phase du chiffrage du Devis,
l’Entrepreneur doit revoir toutes les quantités à partir
des plans, des spécifications et des autres documents
du Dossier de Consultation des Entreprises

3. “Cost Plus Contract” (‫)ﺍﻟﺗﻌﺎﻗﺩ ﺑﺎﻷﻣﺎﻧﺔ‬: Dans le tableau
du Devis (BOQ), les quantités préparées par le
consultant et les prix Unitaires de l’entrepreneur sont
à titre indicatif. L’entrepreneur sera payé les factures
des différents fournisseurs de matériaux, de la Main
d’Œuvre et des divers Services, en ajoutant sur le
montant de ces factures une somme calculée à partir
d’un pourcentage contractuel de Faux-Frais et de
Bénéfice.

 Prix Unitaires d’un Devis
Le prix unitaire d’un Item d’un Devis est composé
de 3 parties:
1. Le coût direct relié à la description de l’Item
comprenant le cout des matériaux, de la main
d’œuvre, des équipement, des services et d’autres
frais divers
2. Le coût indirect qui sont des frais à distribuer sur
tous les Items du Devis
3. Les Faux-Frais et le Bénéfice (Overhead & Profit) à
distribuer sur tous les Items du Devis

Le coût indirect est préparé suivant un format propre à
chaque entreprise. Il comprend à titre indicatif non limitatif:
- Coût de l’installation de chantier: les bureaux équipés, camp des
ouvriers, …
- La consommation d'énergie: Electricité, Fuel, …
- Equipements: Compresseurs, grues à tour, …
- Le staff: Ingénieurs, foreman, secrétaires, comptables, …
- Les frais financiers liés au projet, frais des assurances, …
- Autres charges indirectes
