General report:

Author: #9604 ZUBRINIC, J. Report time: 11/29/2017 07:21

Narrative:

On 11/27/17, at approximately 1340 hours, I (Officer Zubrinic) was on duty at Arvada West High School, 11595
Allendale Dr., when I was informed that a student had been physically assaulted in one of the classrooms. I was told
by campus supervisor Shan Boe that the victim was currently in the school clinic. She said that the teacher and
students in the classroom had witnessed the incident.

I went to the clinic and met with student Alexander (Alex) Kimose (7/20/99). The clinic aide and school nurse were
also present. I observed Alex sitting on a bench in the clinic, holding an icepack on his head. The right side of Alex`s
face was red and swollen and his right eye was red and partially closed. He was bleeding from his nose and also
from the mouth. Alex was shaking and appeared to be very upset. I asked him what happened and he told me he
was in math class, talking with another student, when Ahmad Alissa came up and punched hin in the side of the
head. Alex said he fell to the ground and Ahmad just kept punching him in the face. Alex said that his head and his
face hurt. He also informed me he had a cut on the inside of his right cheek.

I asked Alex why Ahmad hit him and he said he didn`t know, that Ahmad came up behind him and just punched him
without saying anything. Alex said they used to be friends. I then took photos of Alex`s injuries with the camera on
my department issued phone. Alex`s parents were phoned and informed of the incident and his father said he would
be right down to the school. Principal Robert Bishop came to the clinic while I was taking photos of Alex.

While I was in with Alex, assistant principal Jessica Clay informed us over the school radio that Ahmad had come to
her office and turned himself in, saying that he had hit another student in class. Clay spoke with Ahmad and got his
side of the story and also had him fill out an incident statement for the school.

When Alex`s father arrived, Alex was still upset and was crying and throwing up. His nose was still bleeding, and his
face stqrted to swell even more. It was also starting to discolor. Alex`s father stated that he was going to take Alex to
the doctor, that he wanted to make sure there was no serious injuries. He and Alex were very adament that charges
be pressed. I gave him a release for the physician to sign to allow me access to Alex`s health information and
records. I also gave him a Physician Statement form, in case Alex had serious bodily injury.

By the time I had finished dealing with Alex, Ahmad`s father had come to the school and had picked him up, because
he had been suspended for the incident. Jessica Clay gave me a copy of the written statement Ahmad had filled out.
The statement said in part that Alex had been bullying Ahmad for the past year. He wrote that Alex had called him
racist names, called him a terrorist, and even took a video of him and put it on Snapchat. The statement said in the
video Alex called Ahmad a nerd. Ahmad wrote that he "could not take it anymore, so I blacked out and rushed him."
Ahmad also wrote, "I don`t remember incident that much." I was also told by Jessica Clay that Ahmad and his father
claimed that Ahmad had been bullied by Alex for the past year.

I then spoke with Stephanie Bashford, the teacher who was in the classroom where the incident happened. She said
that at the end of 5th period math class, there were a few minutes left when she heard some students yelling. She
said when she turned around she saw Ahmad Alissa punch Alex Kimose in the face. She said Alex fell to the ground
and Ahmad continued to punch him until she and another student broke it up. Stephanie said she told Ahmad to stick
around when the bell rang, but he walked out of class. She said she talked with Alex and Alex appeared to be in
shock. He told Bashford he had not spoken with Ahmad in a long time. Stephanie said that Ahmad had a "look of
pure anger" on his face when he was hitting Alex. She said Alex did not fight back at all.

After talking with Bashford, I was given written statements from some of the students present in the classroom, that
school administrators had collected. Student statement said that he and some other students were
standing around talking with Alex, when, "out of nowhere Ahmad came up to Alex and started to push and hit Alex on
the floor." stated that he tried to break it up, but Ahmad continued to punch Alex in the face. Alex did not fight
back, but was just yelling for Ahmad to stop. It stated when Ms. Bashford came over, she broke it up and Ahmad left
the room.

statement said that he was sitting at a table with Ahmad, when Ahmad brought up Alex Kimose,
and Ahmad said, "I`m going to slap the shit out of that kid someday." wrote that a couple of minutes later
Ahmad got up and walked away. A short while later he heard kids yelling and when he looked up he saw Ahmad
standing over a bloodied Alex, then Ahmad walked away. stated he did not see any blows, just the end.
also stated that a couple of weeks prior to this incident, Ahmad told him that Alex was mean to him (Ahmad) and that
he didn`t like Alex very much.

statement said that he was standing up in class when he observed a kid (who`s name he
believed was Ahmad) stand up, walk across the room, and "started punching Alex Kimose in the face and body."
Ahmad didn`t stop until the teacher came over and broke it up.

statement said that she heard kids yelling in the class and when she looked up she
saw that Ahmad had Alex in a headlock. When another student, , helped break it up, Ahmad "ran away."

Student Hallie Smith`s statement said that she and her friends were all talking when she saw Ahmad come up and
hit Alex, then punch him another 2-3 times, before a student and the teacher broke it up.

On 11/28/17 I had a copy of the physician statement left in my school mailbox for me by It stated
I spoke
with by phone and they told me that Alex was uncomfortable going back to class with Ahmad, but
seemed to taking it worse than Alex They said was very upset and scared and did not
want to see Ahmad again. They told me they would be keeping Alex home from school for the next
few days. They again informed me that they wanted charges pressed against Ahmad.

I phoned Ahmad and his parents and left several messages over the next few days, but did not hear back from
anyone.

On 11/29/17 I started interviewing all the witnessess who were present in math class on 11/27. Over the next few
days I interviewed 27 people and they all told me that Ahmad`s attack was totally unprovoked and that Alex had
never talked to Ahmad during class. They all stated that Ahmad appeared extremely angry, and that Alex never
fought back. Following are a synopsis of statements given by each witness.

Hallie Smith (11/02/99) told me that she was standing near her table with Alex and two other students, talking, when
Ahmad "out of the blue", came up behind Alex Kimose and punched him hard in the side of the face. Alex fell to the
floor and Ahmad hit him at least 2 or 3 more times in the face. Ahmad appeared "really mad", but did not say a word.
Alex never said anything or fought back. Student and the teacher tried to break it up and Ahmad then
stopped and left the room. After it stopped Alex Kimose just said "What the hell?" Hallie told me she thought that
Kimose and Alissa were friends. I asked if she ever heard or saw either Ahmad or Alex say or do anything mean to
the other one and she said she did not. She said a few weeks earlier, Alex took a video of her going up to Ahmad
and asking for her phone back (which was hidden by her friends at her table), but it was really a joke on her, not
Ahmad. She said the video was put online for a short time.

told me that she, Hallie, Alex and another student were at their table talking when she saw
Ahmad come up and he appeared "furious." She sad Ahmad punched Alex on the right side of the face, Alex fell to
the floor and Ahmad continued to punch Alex when he was on the floor. She said he hit Alex at least one or two more
times, until tried to break it up. Ahmad never said a word, he just left. Alex Kimose`s face was red and
bloody and he just replied, "What the fuck?", when it was over. She told me she never heard Ahmad or Alex ever say
anything bad or mean about the other.

told me he and some other students had just stood up from their table, getting ready for class
to end, when "out of nowhere" Ahmad punched Alex in the face. Alex had been standing there, but fell to the ground.
Ahmad continued to punch Alex in the face several more times (about 6-8x total) until he tried to break it
up. said Ahmad looked "furious" and had "anger in his eyes." He said he is friends with both Alex and
Ahmad, and he knew that they were friends last year. I asked if he ever heard either Ahmad or Alex say anything bad
about the other one. He told me his group jokes around a lot, and last year Ahmad and Kimose used to jokingly call
each other names back and forth. He said that he has not heard them say anything about each other, even in a
joking manner, for several months.

told me he was statnding up, near the door, towards the end of class when he saw
Ahmad stand up, walk across the room towards Alex K. Ahmad came up behind Alex (who was possibly sitting), then
Alex fell to the floor. He said he did not see what intially knocked Alex to the floor, but he then saw Ahmad punch
Alex about 4 or 5 times. Neither Ahmad nor Alex said anything, and Alex did not fight back. said Ahmad
appeared, "very, very angry." also told me he has not heard either Alex or Ahmad say anything bad about the
other person.

told me that he had a good view of the "attack." He said it was not really a fight because
Alex never hit Ahmad. said Ahmad came over to Alex and puiched him (he believes in the head). Alex fell to
the floor, leaning up against the wall and there was a slight pause, then Ahmad was "attacking Alex`s face for several
minutes." He said Ahmad punched Alex at least 4-5 more times when he was up against the wall. He said the
teacher yelled and Ahmad stopped, then left the classroom. said he didn`t hear either of them say anything
except for when Alex said, "What the fuck?" after he was hit. told me he knows of "no bad blood" between
Alex and Ahmad, that is why is was so unexpected.

said she was sitting with her friends, facing Alex K.`s table when she saw Ahmad walk quickly

towards Alex and started throwing punches. She thinks Alex was standing when the first punch hit him, then he fell
down to the floor, leaning against the wall, and Ahmad threw about 3 or 4 more "hard punches" to Alex`s face. She
said nothing was said during the incident and she has never heard either of them say anything bad about the other.

said during the last few minutes of class, she was standing up, with her back to the
situation. She said she heard the teacher yell, and she turned and saw Ahmad punching Alex. She said she saw
Alex on the floor, against the wall and only saw Ahmad throw 1 or 2 punches and hit Alex in the face. She said when
Ahmad was walking away he appeared "really angry." She said Alex`s face was bleeding when she saw it.
said neither Ahmad nor Alex said anything during the encounter, and she never heard either one say anything bad
about the other before that.

said she was packing up her backpack at the end of class, when Ahmad walked by. She said
his fists were clenched and he seemed "intense." Ahmad marched over to Alex K., who was standing, and started
hitting him. Ahmed hit Alex with his left hand to Alex`s face and Alex fell to the ground. Ahmad hit him about 3 more
times while he was on the ground. She said neither of them said anything until Ahmad left and Alex said, "What the
hell?" said that Alex didn`t seem to know what happened. She said he never had a chance to fight back, but
Alex is not "that type of person" anyway. told me that Ahmad had a look of "pure anger" on him and he
was "very direct", "he knew what he was doing." She said she never heard either one say anything bad about the
other before that.

told me she was sitting in class, talking to a friend, when she heard a crash and turned
around. She saw Ahmad with his hand in Alex`s face and saw him punch Alex once. She said the teacher yelled and
Ahmad stopped and stormed out of the room. She said he had a look of "pure anger" on him, that his eyes "looked
angry." She also told me she never heard either one of the two say anything bad about the other.

said she was standing around, at the end of class, heard something crash and then the
teacher rushed over. She said when she turned around she saw Ahmad had Alex in his grasp, pushed up against the
wall, and saw him punch Alex at least one time. She never heard any words exchanged and Alex seemed to be in
shock. said she`s never seen the two of them interact before and never heard either of them say anything bad
about the other.

said a couple of minutes before class ended she heard desks shuffle, then heard a crash. She
looked and saw Ahmad hit Alex on the right side of the face. Ahmad looked "really, really angry" and got a few more
punches in before the teacher intervened. said Alex seemed taken aback, was on the ground and couldn`t do
anything. She said nothing was said the entire incident until Ms. Bashford yelled for Ahmad to stop. She said she
was surprised becasue Alex was a "funny, happy kid" I asked if she ever heard either of them say anything bad
about the other. She told me that she heard something bad happened last year, but does not know what, or where
she heard that from.

told me that she was talking with the teacher when Ms. Bashford looked away and yelled.
said she turned around and saw Ahmad punching Alex. Alex was leaning against the wall, and slid down. She
said Ahmad punched several more times, but she only saw one punch connect. She said Alex seemed to be in
shock. Ahmad grabbed his backpack and left the classroom. She said he appeared "extremely angry." She told me
she never heard any words said during the entire incident.

said that she heard Ms. Bashford yell, "Stop", and when she looked, she saw Alex K. getting
hit in the face by Ahmad. She said she saw him punched twice while Alex was against the wall, partway on the floor.
She said she had never seen Ahmad and Alex even talk to each other before.

said he was sitting with Ahmad during class. He said at the end of class Ahmad said
something about "slapping the shit out of that kid." (meaning Alex K.) He said a few minutes later Ahmad got up and
walked away, then heard a commotion. said he didn`t see the fight from where he was at. told me
that a couple of weeks earlier, when Ahmad saw Alex walk by, Ahmad told that Alex was mean to him, "
because of his (Alex`s) deformity."

told me he was chatting with Ahmad before the end of class. A few minutes later Ahmad
got up and walked away, then a few seconds later heard the teacher yell. He said he turned around and "saw
the last punch" where Ahmad hit Alex in the face, then Ahmad left. said in the past he heard Ahmad say Alex
was "annoying", and also heard him say something about "beating Alex up", but he never took Ahmad seriously.

said he sat at Ahmad`s table with him during class and Ahmad "seemed OK." At the end of
class he saw Ahmad get up and walk away. said he looked back and saw Ahmad punch Alex in the face. Alex
fell and Ahmad went on top of him, but he couldn`t see the rest. He told me that nothing was said during the fight.
did tell me that a couple of weeks prior to the event, Ahmad said Alex was a "dick." He told that Alex
picked on him, but said Ahmad didn`t seem too bothered by it. He said Ahmad was vague about what Alex
said or did to pick on him.

told me that he was not looking towards Alex at the end of class, but he heard a chair fall and

when he turned around he saw Ahmad on top of Alex, and Ahmad punched Alex 1 or 2 times in the "head, neck,
shoulder area." said he did not hear either of them say anything during the incident, and Alex did not fight back.
He said Ahmad seemed really, really angry, and after the teacher broke it up, Ahmad walked out of the room.

told me that everything seemed normal during class. He said that he was sitting with Ahmad and
some others when someone in the group "said something about Muslims" (Alex was not in the group) said some
of the kids asked Ahmad questions about Islam, then a few minutes later Ahmad made a statement like, "I`m gonna
go over there." Ahmad left , then heard the teacher yell. turned and saw Alex on the ground and Ahmad was
throwing punches at his head. (he saw at least two punches) When the teacher yelled again, Ahmad stopped, got up
and left.

said that she was facing towards where Alex was sitting. She said at the end of
class she saw Ahmad get up, "storm over" and grabbed Alex by the neck and saw him start punching Alex. She said
Ahmad hit Alex about five times. She said tried to stop the fight and the teacher also came over. That is
when Ahmad stopped, grabbed his backpack, and left. told me nothing was said by either during the
incident, and Alex never fought back. She told me she never heard either Alex or Ahmad say anything bad about the
other one before that.

told me that the class were all standing around before the bell rang, when she saw Ahmad
cross the room, grab Alex and started punching him. Ahmad then put Alex on the ground and continued punching
him. She said he hit Alex in the face about three to five times. She said Alex didn`t fight back, but he appeared to try
to get away. She said a student and the teacher broke it up and Ahmad left. She told me in the past she never heard
either one of the two say anything about the other one.

said at the end of class she was talking with someone else when she heard Ms. Bashford
yell, "Stop." said she turned around and saw Ahmad punch Alex in the head at least twice. She said the
teacher and a student broke it up, the teacher told Ahmad to stay there, but he left. told me the whole
thing "happened out of nowhere." She said she didn`t know that Ahmad and Alex even knew each other til that day.

said that at the end of math class, she was facing the door, when she heard a crash and
heard the teacher yell. She said she turned around and saw Alex K. on the floor, with his head propped up against
the wall. He was bleeding from his lip. She said she did not see the actual punches thrown, but saw Ahmad try and
leave and heard the teacher tell him he needed to stay. The teacher tried to grab Ahmad, but he left anyhow. She
said she never heard either of the two say anything about the other in the past.

told me that at the end of class, she was packing her bags, when she saw Ahmad march over
to Alex K. She said Ahmad looked frustrated, and he punched Alex in the face, grabbed him in a headlock and
punched Alex 3 or 4 more times. She said Alex never fought back.

informed me that at the end of class she heard yelling and when she looked up, she saw Alex
K. on the ground. When he stood up he had blood on his face. She said she did not actually see any punches
thrown. She said she did not see or hear them even talk to each other that day and had never heard either of the two
of them ever say anything about the other in the past.

said that she was standing at her table in class when she witnesed Ahmad walk by with
clenched fists. She said she turned around and started talking to a friend, then she heard a commotion and when
she turned back Alex was on the ground and Ahmad was hitting him in the face. Ahmad never said anything, then he
walked out of the room. She said while Ahmad was hitting him, Alex didn`t fight back or say anything, he just had his
hands up in the air. She said the only time she ever saw the two of them talk was over a month ago, when the two of
them were joking around with each other.

told me she only saw the end of the incident. She said Alex was on the ground and
Ahmad was getting up and seemed angry. She said Ahmad walked out of the room and Alex was bleeding from the
eye and nose. She said Alex looked confused. told me she never saw the two of them interact in the past and
neevr heard them ever say anything about the other.

On 12/12/17, at approximately 1030 hours, I was informed by principal Rob Bishop that Ahmad Alissa had returned
to school after his suspension, and was currently in Rob`s office. I contacted Ahmad, with Rob Bishop present, and
explained that I had left several phone messages, because I wanted to talk with him about the incident. He told me
that he did not know of any messages, then he proceeded to tell me that Alex Kimose had been harassing him and
calling him names, so he hit him. I informed Ahmad that I had interviewed all the witnesses in the class and he was
going to be receiving a summons. I told him that I wanted to hear his side of the story, but I wanted to advise him of
his rights first. I then verbally explained his Miranda rights to him and he waived them. (Ahmad is an adult and did not
need a parent present.) Ahmad then told that Alex has been mean to him in the past, and has called him racist
names, like "terrorist" and "sand nigger". He said that Alex also took a video of him in the classroom and put it on the
internet. In the video Alex called him a nerd. He asked if anyone told me about the video. I said that one of the girls I
interviewed told me that Alex had taken a video of her asking for her phone back, but she thought it was more about
being a joke on her, than making fun of anyone else. Ahmad said that he felt the video was about him and that made

him angry.

I told Ahmad that I was under the impression that the video had happened weeks ago and he said it did, but he was
still angry. I asked if he had a copy of the video, or knew who else did, and Ahmad told me he did not. I asked
Ahmad what happened that day in the classroom. He said that at the end of class he saw Alex talking with some
kids, and Alex was laughing. Ahmad said he felt like Alex was laughing at him and that made him mad. I asked if
Alex had said anything to him that day,or was specifcally looking or pointing at him, and Ahmad told me no. He said
that he just always feels that when Alex is laughing that it is because Alex was making fun of him. I explained that the
school nor I had never been informed of the allegations that Alex called him racist names or made fun of him. Ahmad
stated that he had never told us. I told him if it happened in the future that he needed to let the police or the school
know about it, and we would investigate it.

I then issued Ahmad a Jefferson County summons for third degree assault. I also told him that he was not to have
any interactions with Alex. Rob Bishop told Ahmad that he wanted to have a mediation between Ahmad and Alex
after the legal issues were settled. Ahmad agreed to that, saying that he just did not want Alex calling him names
anymore.

At the date and time of this report I have no additional information. Case status: closed
