) CNAS io Aeeredtation ( MEMORANDUM OF UNDERSTANDING BETWEEN (CHINA NATIONAL ACCREDITATION SERVICE, FOR CONFORMITY ASSESSMENT (PEOPLE’S REBUBLIC OF CHINA) AND FEDERAL ACCREDITATION SERVICE (RUSSIAN FEDERATION) China National Accreditation Service for Conformity Assessment (CNAS) and Federal Accreditation Service (RusAccreditation) (hereinafter referred to as “the Parties") in order to establish a long-term cooperation mechanism and carry out close cooperation under the framework of China-Russia Standing Group on Standardization, Metrology, Certification and Inspection Control; facilitate mutual recognition mechanism of accreditation of certifi bodies, testing laboratories and inspection bodies in China and Russia have reached understanding on the following: 1, Subject and Guiding Principles of the Memorandum ‘The subject of the present Memorandum is informational, analytical and ‘organizational interaction of the Parties on the issues of accreditation of conformity assessment bodies and other issues of mutual interest, The Parties are intending to develop mutually beneficial cooperation in the field of accreditation within the scope ofits competence and in accordance withthe legislation of their states. Cooperation of the Parties will be based on the principles and rules used by international and reg’onal accreditation organizations. . Cooperation Strategies The Parties jointly agree on the following cooperation strategie 1. to lear from each other the experience in the field of accreditation; 2. to jointly develop a better understanding of the Russian Federation accreditation system by China regulators and of China accreditation system by Russian regulators; 3. to work together to enhance confidence in results generated by accredited conformity assessment bodies of the Parties; 4. to work together to promote the recognition of accredited results by the Parties; 5. to work together to resolve issues of mutual technical concer in bilateral trade relevant to accreditation; 6. 10 work jointly to enhance the effectiveness of the ILAC, IAF and associated regional MLA/MRAS; 7. to seek mutual recognition of accreditation through canying out necessary technical sooperation and exchanges with the principle of equality and mutual recognition, 3. Formal Liaison Mechanism ‘The Parties agree that a mechanism for liaison willbe established to allow easy ‘and clear communications between the Parties, and to enhance and assure the effectiveness of this MoU, 4. Areas for Cooperation ‘The Parties agree on the following arces for cooperation. 1) Technical Cooperation to exchange information on each of the respective accreditation system; to identify and analyze differences between the two accreditation systems; to conduct technical exchanges and cooperation discussion on accreditation issues in China and Russia; to determine the methods and criteria for harmonizing the two accreditation systems; to elaborate suggestions for mutual recognition of accreditation; to conduct joint research on methodology and other aspects associated with assessments; to develop joit accreditation programs in areas of mutual interes; to foster the trsfer of knowledge through the exchange of personel (including the exchange of personnel participating in a specifi project in relevant 2) Proficiency Testing to share experience and information on the wse of PT in accreditation. 3) Tisining to collaborate n researching taining needs and developing tsining courses that support accreditation as appropriate. 4) Other Possible Areas to provide assessor resource support when necessary; to conduct joirt assessments as deemed relevant. 5. Confidentiality ‘Unless otherwise determined by national legislation of Russia and China or ly decided by the Parties, the Parties will keep confidential all information and jot documents exchanges under the terms of this MoU. 6. Procedure for Disputes and Disagreements Resolution In case that any disagreement atises, the MoU in English will be used for the purpose of the interpretation. Any difference that may srise from the interpretation or application of the provisions of the MoU wil be settled amicably through ‘consultation or negoriation between the Parties. 7. Terms of the Duration and Termination of the MOU ‘This MoU shall apply from the date both Parties sign this document, ‘The MoU is applied unless, and until terminated by either Party by giving 90 days" written notice tothe other Party. ‘The present Memorandum is not an international treaty and does not create any rights and obligations for the Parties governed by infgmational law.
