Affirmation and Release For Extracurricular Recreational Activity

This affirmation and release was executed in Omaha, Nebraska, by

____________________________ (Participant) in favor of the Board of Regents of the
University of Nebraska on behalf of the University of Nebraska at Omaha (UNO).The
participant wishes to participate in the recreational activity provided by UNO
commonly known as UNO Track and Field Club In consideration for the privilege
of participating in this activity, the Participant agrees to the following:

1. Participant certifies that he/she is physically capable of participating in the

Activity and that he/she will take responsibility for physical fitness and capability
necessary to perform the Activity.

2. Participant is aware that the Activity is often a vigorous undertaking, which may
involve cardiovascular stress and joint/muscle exertion. Risks involved in
participating in the Activity include, but are not limited to death, serious neck and
spinal injuries resulting in complete or partial paralysis, brain damage, heart attack,
and injury to bones, joints, muscles, and internal organs, travel to and from
participation sites, and the reckless conduct of other activity participants.
Participant voluntarily participates in the Activity with knowledge of the dangers
involved and hereby agrees to accept any and all inherent risks of property
damage, personal injury, or death.

3. Participant accepts responsibility to ensure that any equipment needed to

participate in the Activity is safe, functioning properly and that Participant uses
such equipment as intended.

4. In the event of medical emergency, UNO or its representatives have permission

to take whatever measures they deem reasonable to render assistance to
Participant and that Participant will be financially responsible for any expenses
involved.

5. In consideration of Participant’s participation, Participant hereby releases and

covenants not to sue the Board of Regents of the University of Nebraska at Omaha,
the Department of Campus Recreation, and any of their employees, instructors, or
agents, from any and all present and future claims arising in connection with
participation in the Activity and hereby releases all employees, instructors, or
agents of UNO for any injury or damage which may befall the Participant while
participating in the Activity, and agrees to indemnify and hold harmless UNO, its
employees instructors and agents from any claim by the Participant, or his/her
family, estate, heirs or assigns, arising out of the Participant’s participation in the
Activity.

Participant understands that this Release and Waiver is intended to be as broad and
inclusive as permitted by the laws of the State of Nebraska and agrees that if any
portion is held invalid, the remainder of the Release and Waiver will continue in
legal force and effect. Participant further affirms that the venue for any legal
proceedings shall be in the State of Nebraska.
