How does this work for #3 – I took additional language from the 2008 MOU between DHS, DOJ

and DOS.

3. Is there any technical limitation that would prevent ICE from filtering

out records from a particular jurisdiction if it decided to honor a

locality’s “opt-out” request?

There is currently no technical limitation that would prevent ICE from

filtering out records from a particular jurisdiction. However; there are

policy limitations pursuant to statutes and Executive Orders and

consistent with Congressional appropriations guidance requiring the

federal agencies to share information.

1. Is DC actually enrolled in Secure Communities? The last time I

checked, ICE was unable to get the DC Attorney General to sign the

MOA and therefore had not turned on the system with the MPD. Has

that changed?

2. When jurisdictions within a State with an active MOA ask to opt out of

Secure Communities, does that request come to ICE or to the State

Bureau of Investigations (or whomever else signed MOA)? If the opt-

 out request is sent to ICE, what does ICE do with it?
