SJRRC EQUIPMENT STORAGE AND MAINTENANCE FACILITY (Also known as ACE Rail Equipment Maintenance Facility Located at 2801 West Lane, Stockton, CA)
PUBLIC NOTICE IS HEREBY GIVEN THAT SAN JOAQUIN REGIONAL RAIL
COMMISSION ("SJRRC") invites sealed bids for a contract for the following described work:
Construction of the Altamont Commuter Express (ACE) Service Equipment
Storage and Maintenance Facility in Stockton, California. Major elements of the project include a maintenance building (shops and offices), service and inspection area, train washer, ancillary structures and enclosures, yard track improvements, and site improvements.
A. TYPE OF BID: Bids shall be on a stipulated sum basis and shall cover the entire work; segregated bids will not be accepted.
B. CONTRACT TIME: The work shall be completed by the date stipulated in
the Contract Documents.
C. PROCUREMENT AND CONTRACT DOCUMENTS: Will be available
beginning on or about March 30, 2011 and may be examined, free of charge, at the office of SJRRC located at: San Joaquin Regional Rail Commission (SJRRC) 949 East Channel St. Stockton, CA 95202
Beginning on or about March 30, 2011, to acquire Procurement and
Contract Documents visit www.stocktonblue.com and connect to PlanWell Public Planroom or contact Stockton Blue at (209) 464-8724.
D. PREBID MEETING: Bidders are strongly encouraged to attend a pre-bid
meeting at San Joaquin Regional Rail Commission 10:00 a.m. PDT on April 11, 2011, at: San Joaquin Regional Rail Commission 949 East Channel St. Stockton, CA 95202 E. BID SECURITY: All bids shall be accompanied by a cashier’s or certified check payable to the order of SJRRC, amounting to ten percent (10%) of the bid, or by a bond in said amount and payable to SJRRC signed by the Bidder and a corporate surety.. In the event that the Bidder fails, within ten (10) days after written notice that the Contract has been awarded to it, to enter into a Contract with SJRRC, SJRRC may award the Contract to the second lowest bidder. In such event, the amount of Bidder’s security shall be applied by SJRRC to the difference between the Bidder’s bid and the second lowest bid, and the surplus, if any, shall be returned to the Bidder if cash or check is used, or to the surety on Bidder’s bond if a bond is used.
F. PREQUALIFICATION: Contractors shall be required to prequalify prior to
submitting bids. Interested bidders which have not previously qualified with SJRRC for this work must deliver the required prequalification documents to the SJRRC up to but not later than Wednesday, April 20, 2011 at 3:00 p.m. PDT. Interested bidders which have previously qualified with SJRRC for this work must also deliver to the SJRRC, by that same time, an update to its prior prequalification documents.
G. RECEIPT OF BIDS AND BID OPENING: Bids must be on forms obtained at
the office as set forth in paragraph C and must be delivered to said office in a sealed envelope marked “SJRRC Equipment Storage and Maintenance Facility.” SJRRC will receive bids up to but not later than 2:00 p.m. PDT, June 8, 2011, at San Joaquin Regional Rail Commission, located at 949 East Channel Street, Stockton, CA 95202. Bids received after this time will not be accepted. Bids will be publicly opened, examined and declared at 2:00 p.m. PDT, on June 8, 2011. SJRRC reserves the right to waive any informality or irregularity and to reject any and all bids.
H. BONDS: The successful bidder will be required to post a performance
bond and a labor and materials bond, each in the sum of 100% of the contract price, as detailed in the General Conditions and Supplementary Conditions of the Contract.
I. SUBSTITUTION OF SECURITIES. SJRRC will permit successful bidder to substitute
securities for retention monies withheld to ensure performance of Contract, in accordance with California Public Contract Code, Section 22300. By this reference, California Public Contract Code, Section 22300 is incorporated in full in this Section 00 11 16.
J. FEDERAL COMPLIANCE: This Contract is Federally assisted by the U.S.
Department of Transportation, Federal Transit Administration. The Contractor must comply with Buy America and all other applicable Federal requirements, as well as with applicable wage and hour and labor requirements, as stated in the Agreement Documents. K. PREVAILING WAGE. Subject to the Paragraph J, the provisions of the California Labor Code will be incorporated in and govern this contract award. Contractor agrees to pay each craft, classification or type of workman the prevailing wage determined by the State of California, Director of Industrial Relations, in the published wage scale determination, a copy of which is available at the principal office of SJRRC and which shall be made available to any interested party on request, and to comply with California Labor Code §§ 1777.5, 1776. If the Federal Prevailing Wage established by the Davis Bacon Act is higher than the wage established by the California Labor code, for any craft, contractor will comply with the Davis Bacon Act rather than the California Labor Code for that craft.
L. CONTRACTOR’S LICENSE: Contractor shall posses an A and/or or B
California Contractor’s license, valid and in good standing, at the time of award of the Contract.
M. REJECTION/CONSIDERATION OF BIDS: SJRRC reserves the right to
waive any informality or irregularity in any bid received and to be the sole judge of the respective merits of the respective bids received. The contract award, if made, will be made to the lowest responsible and responsive bidder. SJRRC reserves the right to take all bids received under advisement for a period not exceeding ninety (90) calendar days from and after the date upon which such bids are opened and declared, and all bids and bid guarantees submitted shall remain valid and subject to enforcement during that period of time.
