I. GENERAL INFORMATION

„ The motorway is part of the development strategy plan in the


National Motorways Program frame, and it fits in the National
Spatial Plan - Roads section, approved by Law 363/2006.

„ It represents the middle area of the Pan-European Transport


Corridor no. IV, which crosses Romania from east to west,
between Nadlac and Constanta.

„ The area is one of the crouded route in Romania, having traffic


values over 50,000 MZA.

„ The route (174 km) crosses the following counties :


- Bucharest – almost 1,6 km

- Ilfov– almost 30,1 km

- Prahova– almost 115,3 km

- Brasov – almost 26,3 km


II. ENVIRONMENTAL REQUIREMENTS REALIZED UNDER THE
PROJECT FRAME

GENERAL LEGISLATION

The general framework legislation concerning environment protection is provided


by the Law of environment protection no. 195/2005 (approval with Law no.
265/2006 with amendments and completions) harmonised with the
international Conventions and the European Union directives have been
adopted.

The most important laws and legal documents are as follows:


„ Governmental Decision no. 1213/2005 concerning the procedure to settle the
economic and social activities of environment impact (EIA)
„ Order no. 860/ 2002 of Minister of environment and water management to
approve the procedure to evaluate the environment impact assessment and the
issuing of environment permit.
„ Governmental Decision no. 1076/2004 concerning the procedure to settle the
plans and programmes of environment impact (SEA)
„ Law no. 57/2007 concerning on the conservation of wild fauna and flora and
natural habitats (including to NATURA 2000 sites)
„ Law no. 86/2000 for the ratification of Aarhus Convention concerning public
access to information, public participation in taking decisions and access to
court for environment issues, adopted on June 25, 1998.
„ Law no. 3/2001 for the ratification of Kyoto Protocol of the United Nations
Convention concerning climate change, adopted on December 11, 1997
Applied legislation

Air
„ Order no. 592/2002 on the establishment of limit values, the threshold values and ,
methods of assessment of sulfur dioxide, nitrogen dioxide and nitrogen oxides,
particulate matters, lead, benzene, carbon monoxide and ozone in ambient air;
„ Order no. 462/1993 - Technical conditions for atmosphere protection. Rules to limit
emissions of pollutants for combustion instalations.

Noise
„ STAS 10009/1988 – Urban acoustics. Noise limits;
„ Government Decision no. 539 of April 7, 2004 on the limitation of noise emissions
into the environment, noise generated by the equipment for outdoors use;
„ Government Decision no. 321/2005 about the assessment and management of
environmental noise;
„ Guide - 30/06/2006 - Interim Methods for calculating the noise indicators made by
roads, rail and air traffic in the vicinity of airports, along industrial areas.
Applied legislation

Water
„ Water Law no. 107/1996, with subsequent additions and amendments;
„ Law no. 458/2002 - Conditions for drinking water quality;
„ Law no. 311/2004 amending and supplementing Law no. 458/2002 - Conditions for
drinking water quality;
„ Government Decision no. 930/2005 - Special rules on the nature and size of sanitary
protection areas;
„ Order no. 161/2006 – Rules for clasifying the surface water quality, in order to
establish the ecological status of water particles;
„ NTPA 001/2002 - regulatory framework for setting limits to polluting loads of the
industrial and municipal wastewater, which can be discharged into natural receivers;
„ NTPA 002/2002 - acts regarding conditions of wastewater discharge into the
sewerage networks in villages;
„ Government Decision no. 352/2005 - amending and supplementing Government no.
188/2002 for approving the rules on the conditions of discharge wastewater into the
aquatic environment;
„ STAS 9450-1988 - Technical conditions of water quality for irrigation of crops.

Soil
„ Order no. 756/1997 - Order approving the regulation on the assessment of
environmental pollution.
Impact Assessment Methods

Collecting data

„ Site visits

„ Analysis of existing documentation (General Urban Plans., Area


Urban Plan, Directories - environmental factors, management
plans for forest ranges, etc.)

„ Public consultations (interviews with the population from the


affected areas, meetings)
Public consultations

Public debate led to major environmental issues through punctually solutions and
specific treatment to ensure optimal environmental conditions.

Thus, for the information and consultation of public, there were made the following:
„ There were published in the press announcements relating to: filling application
for obtaining the environmental agreements, elaboration of the report about the
environmental impact assessment, submiting the report to the environmental
authorities and the possibilities of consultation, meetings of public debate of the
Report, date and location of the sessions and public debate, the decision of an
environmental issue;
„ The above-mentioned announcements were posted at city mayor;
„ Mayors have been submitted to the project documentation for public information
and questionnaires to record observations and proposals of the public;
„ Where held public consultation sessions in addition to those stipulated by the
legislation (at the Bucharest 2-nd Sector Mayor, at Barcanesti, Sinaia, Poiana
Campina).

Works for environmental protection

Works to protect wildlife:


„ Fencing: eliminate the risk of vehicles collisions with wild animals.

Works that allow wild animals to cross the motorway


„ Culverts for large wildlife;
„ Culverts to drain water and to restore the local roads, especially for small
fauna;
„ Numerous works of art (bridges and viaducts) that allow highway crossing
by wildlife.

Works to protect water quality and soil:


„ sedimentary basins
„ fats separator ,
„ pools of dispersion ,
„ cleaning services constructions provided to maintenance areas, bases and
coordination centers.

Works provided for protection against noise:


„ noise protection panels.
III. Protected areas. NATURA 2000 sites

„ Protected areas

„ NATURE 2000 Site “ Gradistea-Caldarusani-Dridu”


Natural Protected Areas

Bucharest Municipality: Motorway will not pass through protected


areas or go through the vicinity of protected areas.

Ilfov County: Highway will cross the Natura 2000 site - the special
protected areas Gradistea - Didru. This area, later in 2008, when was
developed a biodiversity study which was the basis for obtaining the
environmental agreement for clearing the site.

Prahova County: Highway will not pass through protected areas, but
near of:
„ Sinaia Alder Grove
„ Bucegi National Park

Brasov County: Highway will not pass through protected areas

designates as special protected areas (bird conservation) SPA -
“Grădiştea-Caldarusani-Dridu“ included in NATURA 2000 network.

Affected forest area that needs to be cleared is 4.24 ha (50 m


wide and 850 m long) between km 22+150 - 23+000, land that belongs
to Snagov Forest (Ilfov county) and the site is about 0.14% of total.
Nature 2000 Habitat
SPA Grădiştea - Caldarusani - Dridu was designated as a special protected
area by Romanian Ornithological Society (that part of Ilfov EPA), in order
to conserve about 20 bird species mentioned in Annex 1 of Birds Directive
(79/409/EEC), as it follows (except from Annex 4 to Government Decision
no. 1284/2007):
Circus aeruginosus
Ixobrychus minutus

Ciconia ciconia
Impact mitigation measures

•the road area which crossing the SPA's, the


fencing is additionally made - to wire mesh
panels on metal posts of 1.80 m high, located
at the motorway limit profile - and netting it
with a height similar to the size mesh
maximum 5 cm, to avoid direct flight of
small birds in the road collision area;

•installation of two "bats bridges" in this


section in order to help them crossing the
highway (ramose linear structures over the
road)
Impact mitigation measures

•along the whole area, which is crossing SPA , will be


placed noise bareers in order to minimize the effects of
noise on biodiversity

•replanting the motorway slopes with typical species -


native from the area crossed by the road

construction of 4 wildlife ecoducts for small and


medium fauna.
Impact compensation measures

„ In order to maintain the favorable conservation status of species


and offsetting negative impacts of highway construction is
necessary to compensate the loss of the habitat through
afforestation of agricultural land, with a specific forest
composition, similar to adjacent habitats and their integration

„ area which is going to be replanted is about 29 ha of farmland
