TO ALL TO WHOM THESE PRESENTS SHALL COME THAT I, SHELTON


JAYARATNE of No.357, Horana Road, Alubomulla, Panadura (hereinafter sometimes
called and referred to as “the said Declarant” which term or expression as herein used
shall where the context so requires or admits of construction mean and include the said
SHELTON JAYARATNE and his heirs executors admininstrators and assigns)

SEND GREETINGS:

WHEREAS by virtue of Deed bearing No.1382 dated 10.12.1939 and attested by


W.P.Seneviratne Notary Public and also by Deed bearing No.5540 dated 01.06.1941 and
attested by P.Charles Dias Notary Public ANDRAHENNEDIGE SIMON JAYARATNE
was the Original Owner and was seised and possessed of and or otherwise well and
sufficiently entitled to all those amalgamated allotments of lands marked Lots 6 & 7
depicted in Plan No.12121 dated 28.03.1938 and made by B.M.F.Caldera Licensed
Surveyor of land called DELGAHAWATTA in extent 1 Rood and 26 11/48 Perches
and morefully described in the Schedule hereto and the aforesaid Deeds Nos.1382 &
5540 are registered under title B 310/31 (which is said to have been brought forward
from B 308/115) in the Land Registry of Panadura..

AND WHEREAS the said ANDRAHENNEDIGE SIMON JAYARATNE by Deed of


Transfer bearing No.2789 dated 02.07.1975 attested by A.P.Fernando Notary Public of
Panadura sold and conveyed the said amalgamated allotments of lands marked Lots 6 & 7
depicted in Plan No.12121 dated 28.03.1938 and made by B.M.F.Caldera Licensed
Surveyor of land called DELGAHAWATTA in extent 1 Rood and 26 11/48 Perches
and morefully described in the Schedule hereto to SHELTON JAYARATNE the said
Declarant who is the Present Owner thereof and the aforesaid Deed No.2789 is registered
under title F 79/99 in the Land Registry of Panadura but without having any cross
connection or brought forward reference to the earlier folio bearing No. B 310/31 (said to
have been brought forward from B 308/115) where the title Deeds of the Vendor to Deed
No.2789, namely the said ANDRAHENNEDIGE SIMON JAYARATNE, are registered.
AND WHEREAS as the registers prior to F 79/99 pertaining to the Land morefully
described in the Schedule hereto are decayed it cannot be ascertained through a diligent
search in the Land Registry whether the predecessor of the Present Owner namely the
said ANDRAHENNEDIGE SIMON JAYARATNE did not sell gift or in anywise
dispose of the land morefully described in the Schedule hereto and remained the Owner
of the same upto the time of executing the Deed No.2789 under and by virtue of which
the Present Owner the said SHELTON JAYARATNE became entitle to the same and
also that the land registered under title B 310/31 and the land registered under title F
79/99 is the one and the same land which is identical with the land morefully described in
the Schedule hereto.

AND WHEREAS for the better manifestation of title now it has become necessary and
expedient to execute these presents to declare that the predecessor of the Present Owner
namely the said ANDRAHENNEDIGE SIMON JAYARATNE did not sell gift or in
anywise dispose of the land morefully described in the Schedule hereto and remained the
Owner of the same up-to the time of executing the Deed No.2789 under and by virtue of
which the Present Owner the said SHELTON JAYARATNE became entitle to the said
land and also that the land registered under title B 310/31 and the land registered under
title F 79/99 is the one and the same which is identical with the land morefully described
in the Schedule hereto.

NOW KNOW YE AND THESE PRESENTS WITNESSETH AND IT IS HEREBY


DECLARED that the predecessor of the Present Owner namely the said
ANDRAHENNEDIGE SIMON JAYARATNE did not sell gift or in anywise dispose of
the land morefully described in the Schedule hereto and remained the Owner free of any
encumbrances of the same up-to the time of executing the Deed No.2789 under and by
virtue of which the Present Owner the said SHELTON JAYARATNE became entitle to
the said land and also that the land registered under title B 310/31 and the land registered
under title F 79/99 is the one and the same which is identical with the land morefully
described in the Schedule hereto.

IN WITNESS WHEREOF I the said Declarant set my hand to this and to two others of
the tenor and date as these presents at Colombo on this Thirty firsth day of May Two
Thousand and Two.

THE SCHEDULE ABOVE REFERRED TO:

All those two contiguous allotments of land marked Lots 6 & 7 depicted in Plan
No.12121 dated 26.03.1938 made by B.M.F.Caldera Licensed Surveyor of the land called
DELGAHAWATTA together with the entirety of the residential premises bearing
Assessment Nos.357 & 357/1 Horana Road and trees plantations and everything standing
thereon situated at Alubomulla in the Panadura Thalpiti Debadda of Panadura Thotamuna
in the District of Kalutara Western Province and bounded on the NORTH by
Delgahawatta belonging to Katugahage People on the EAST by Paranayawatta of
D.Helenis Perera and D.Emis Perera on the SOUTH by Main Road from Panadura to
Horana and on the WEST by Lot 5 of the same land and containing in extent ONE
ROOD AND TWENTY SIX AND ELEVEN UPON FORTY EIGHT PERCHES
(A:0 – R:1 – P: 26 11/48 ) and registered under title F 79/99 (brought forward from
B 310/31 in the Land Registry of Panadura.

Which said contiguous allotments of lands marked Lots 6 & 7 in the said Plan No.12121
according to a re-survey can be described as follows:

All that allotment of land marked Lot X depicted in Plan No.2953 dated 04.05.2002 and
made by M.C.G.Fernando Licensed Surveyor (being the amalgamation of Lots 6 & 7 in
Plan No.12121 dated 26.03.1938 made by B.M.F.caldera L.S.) of the land called
DELGAHAWATTA together with the entirety of the residential premises bearing
Assessment Nos.357 & 357/1 Horana Road and trees plantations and everything standing
thereon situated at Alubomulla as aforesaid and bounded on the NORTH by
Delgahawatta claimed by L.P.Perera formerly belonging to Katugahage People on the
EAST by Paranayawatta claimed by L.P.Perera formerly belonging to D.Helenis Perera
and property claimed by N.Alwis formerly belonging to D.Emis Perera on the SOUTH
by Highway from Panadura to Ratnapura and on the WEST by Lot 5 of the same land in
the aforesaid Plan No.12121 and containing in extent ONE ROOD AND TWENTY
THREE PERCHES (A:0 – R:1 – P:23) according to the said Plan No.2953.

MAHATHELGE FRANKLYN LLOYD PEIRIS and MAHATHELGE PATRICK

FERNANDO the mother of the said Declarants became entitled to the right of roadway
and other similar rights in over under and along the allotment of land marked Lot CIC
(Reservation for a path) depicted in Plan No. 474 dated 15.05.1948 made by K.G.W.Silva
Licensed Surveyor of the land called RUKGAHAKOTTANUWA, and morefully
described in the Schedule hereto and the aforesaid Deeds No.1584 is registered under title
M 495/205 in the Land Registry of Mount-Lavinia (formerly Colombo).

AND WHEREAS the said WANNAKUWATTAWADUGE LISSIE SELINA


FERNANDO by virtue of several Deeds became the Owner of all the surrounding lands
of the said allotment of land marked Lot CIC (Reservation for a path) depicted in Plan
No. 474 dated 15.05.1948 made by K.G.W.Silva Licensed Surveyor of the land called
RUKGAHAKOTTANUWA, and morefully described in the Schedule hereto and was in
the sole use of the said Reservation for a road

AND WHEREAS the said WANNAKUWATTAWADUGE LISSIE SELINA


FERNANDO was in the possession of the said allotment of land marked Lot CIC
(Reservation for a path) depicted in Plan No. 474 dated 15.05.1948 made by K.G.W.Silva
Licensed Surveyor of the land called RUKGAHAKOTTANUWA and morefully
described in the Schedule hereto as a n allotment of land and not as a roadway as a sole
owner without any hindrance or obstruction by any person and adverse to the rights and
title of all the others and thereby became entitled to the said of land marked Lot CIC
(Reservation for a path) depicted in Plan No. 474 dated 15.05.1948 made by K.G.W.Silva
Licensed Surveyor of the land called RUKGAHAKOTTANUWA

AND WHEREAS AND WHEREAS the said WANNAKUWATTAWADUGE LISSIE


SELINA FERNANDO as the sole owner as such caused the said allotment of land
marked Lot CIC (Reservation for a path) depicted in Plan No. 474 dated 15.05.1948
made by K.G.W.Silva Licensed Surveyor of the land called
RUKGAHAKOTTANUWA and morefully described in the Schedule hereto to be
amalgamated with several other lands and the land identical with the said Lot C1C
morefully described in the Schedule hereto was devolved on the said Declarants by
virtue of intestate succession from the said WANNAKUWATTAWADUGE LISSIE
SELINA FERNANDO.

AND WHEREAS for the better manifestation of title now it has become necessary and
expedient to execute these presents to declare that we the said Declarants are the owners
of the said allotment of land marked Lot CIC (Reservation for a path) depicted in Plan
No. 474 dated 15.05.1948 made by K.G.W.Silva Licensed Surveyor of the land called
RUKGAHAKOTTANUWA and morefully described in the Schedule heretomorefully
described in the Schedule hereto.

NOW KNOW YE AND THESE PRESENTS WITNESSETH AND IT IS HEREBY


DECLARED that we the said Declarants are the only owners of the said allotment of
land marked Lot CIC (Reservation for a path) depicted in Plan No. 474 dated
15.05.1948 made by K.G.W.Silva Licensed Surveyor of the land called
RUKGAHAKOTTANUWA and morefully described in the Schedule heretomorefully
described in the Schedule hereto.

IN WITNESS WHEREOF We the said Declarants set our respective hands to this and
to two others of the tenor and date as these presents at Colombo on this Twenty Seventh
day of December Two Thousand and Three.

THE SCHEDULE ABOVE REFERRED TO:

All that divided and defined allotment of land marked Lot CIC (Reservation for a path)
depicted in the same Plan No. 474 of the land called RUKGAHAKOTTANUWA,
situated at Kawdana as aforesaid and which said Lot CIC is bounded on the NORTH by
CIA of the same land on the EAST by Lot CIB of the same Plan on the SOUTH by Lot
C of the same Land and on the WEST by Welikumbura belonging to the heirs of Romel
Annavirala and containing in extent NOUGHT DECIML FIVE TWO PERCHES (A:0
– R:0 – P:0.52) according to the said Plan No 474 and registered under title M 495/205
in the land Registry of Mount -Lavinia.

MANAGE ANURA SILVA of No.69/9, Galabodawatta, Rukmalgama, Pannipitiya presently of
Nagoya Shi, Tinpaku- Ku, Tsuchihara, 1 Chome 184-2, Caron Tsuchihara – 203, Japan T 468 -
0026 (hereinafter sometimes called and referred to as “the said Declarant” which term or
expression as herein used shall where the context so requires or admits of construction mean and
include the said MARAKKALA MANAGE ANURA SILVA and his heirs executors
administrators and assigns)

SEND GREETINGS:

WHEREAS by virtue of Deed bearing No.2432 dated 31.03.2000 and attested by


Y.P.Rajaratnam Notary Public THE FINANCE AND GUARANTEE COMPANY LIMITED a
company duly incorporated in Sri Lanka and having its registered office at No.97, Hyde Park
Corner, Colombo 2 was seised and possessed of and or otherwise well and sufficiently entitled to
all that allotment of land marked Lot 1 depicted in Plan No.1786 dated 29.03.2000 and made by
K.D.G.Weerasinghe Licensed Surveyor of land called HIKGAHALANDA in extent 2 Roods
and 22.99 Perches and morefully described in the Second Schedule hereto.
AND WHEREAS the said THE FINANCE AND GUARANTEE COMPANY LIMITED caused
the said allotment of land marked Lot 1 depicted in the aforesaid Plan No.1786 to be sub-
divided into 9 allotments of land as per Plan No.1793 dated 07th April 2000 made by
K.D.G.Weerasinghe Licensed Surveyor.

AND WHEREAS the said THE FINANCE AND GUARANTEE COMPANY LIMITED put the
said 9 allotments of land depicted in the said Plan No.1793 on public sale subject to the terms
inter alia
(i) the full Purchase Price may be payable on easy payment terms
(ii) the possession of the land is handed over to the intended Purchaser on the completion
of 25% of the Total Purchase Price

AND WHEREAS the said MARAKKALA MANAGE ANURA SILVA the Declarant
hereto agreed with the said THE FINANCE AND GUARANTEE COMPANY LIMITED to
purchase the allotment of land marked Lot 2 in the aforesaid Plan No.1793 morefully described in
the First Schedule hereto on the aforesaid terms and conditions referred to in the preceding
paragraph for a price or sum of Rupees Six Hundred Thousand (Rs.600,000/-) and made a
payment of Rupees One Hundred and Fifty Thousand (Rs.150,000/-) (equivalent to 25% of the
total Purchase Price) to be eligible for the possession of the land and agreed to settle the balance
of Rupees Four Hundred and Fifty Thousand (Rs.450,000/-) in equal installments throughout a
period of 7 years.

AND WHEREAS the said MARAKKALA MANAGE ANURA SILVA the Declarant hereto
in pursuant to the said agreement and with the consent and concurrence of the said THE
FINANCE AND GUARANTEE COMPANY LIMITED entered into possession of the said land
marked Lot 2 in the aforesaid Plan No.1793 morefully described in the First Schedule hereto and
commenced the construction of a residential premises.

AND WHEREAS as there is no writing evidencing the actual agreement entered into between
the said MARAKKALA MANAGE ANURA SILVA the Declarant hereto and the said THE
FINANCE AND GUARANTEE COMPANY LIMITED it has become necessary and expedient
to execute these presents to declare that the said MARAKKALA MANAGE ANURA SILVA
the Declarant hereto entered into possession of the said land marked Lot 2 in the aforesaid Plan
No.1793 morefully described in the First Schedule hereto in pursuant to the said agreement and
with the consent and concurrence of the said THE FINANCE AND GUARANTEE COMPANY
LIMITED and commenced the construction of a residential premises and at present is in
occupation of the same with an intention of purchasing the same by paying the balance Purchase
Price.
NOW KNOW YE AND THESE PRESENTS WITNESSETH AND IT IS HEREBY
DECLARED that the said MARAKKALA MANAGE ANURA SILVA the Declarant hereto
entered into possession of the said land marked Lot 2 in the aforesaid Plan No.1793 morefully
described in the First Schedule hereto in pursuant to the said agreement and with the consent and
concurrence of the said THE FINANCE AND GUARANTEE COMPANY LIMITED and
commenced the construction of a residential premises and at present is in occupation of the same
with an intention of purchasing the same by paying the balance Purchase Price.

IN WITNESS WHEREOF I the said Declarant set my hand to this and to two others of the
tenor and date as these presents at Ethul Kotte on this Fourteenth day of August Two Thousand
and Three.

THE FIRST SCHEDULE ABOVE REFERRED TO:

All that divided and defined allotment of land marked Lot 2 depicted in Plan No.1793 dated
07.04.2000 made by K.D.G. Weerasinghe Licensed Surveyor of the land called
HIKGAHALANDA (being a sub-division of the land morefully described in the Second
Schedule hereto) together with the soil trees Plantations and everything else standing thereon
situated at Rukmale in the Palle Pattu of Hewagam Korale in the District of Colombo Western
Province and bounded on the NORTH by Road (P.S) on the EAST by Lot 03 in the aforesaid
Plan No.1793 on the SOUTH by Lot 4 in the aforesaid Plan No.1793 and on the WEST by Lot
01 in the aforesaid Plan No.1793 and containing in extent TEN DECIMAL FOUR EIGHT
PERCHES (A:0 – R:0 – P: 10.48 ) or 0.0265 Hectares according to the said Plan No. 1793.

THE SECOND SCHEDULE ABOVE REFERRED TO:

All that divided and defined allotment of land marked Lot 1 depicted in Plan No.1786 dated
29.03.2000 and made by K.D.G. Weerasinghe Licensed Surveyor of the land called
HIKGAHALANDA together with the soil trees Plantations and everything else standing thereon
situated at Rukmale as aforesaid and bounded on the NORTH by Lot 1 in Plan No. 4132 (Road
20ft.wide) on the EAST by Lot 1 in Plan No. 4132 (Road P.S.) on the SOUTH by Lot B1B in
Plan No. 4444 and on the WEST by Rukmalgama Housing Scheme and Road and containing in
extent TWO ROODS AND TWENTY TWO DECIMAL NINE NINE PERCHES (A:0 – R:2
– P:22.99) or 0.2605 Hectares according to the said Plan No.1786 and registered under title G
1252/138 in the Land Registry of Homagama.
