Theodore B. Olson and David Boies, long identified as opposing forces for conservative and liberal groups, filed
suit in federal court on behalf of two gay men and two gay women, arguing that a California constitutional
amendment eliminating the right of gay couples to marry violates the U.S. constitutional guarantees of equal
protection and due process.
Olson said he hopes the case will wind up before the U.S. Supreme Court.
"This is a federal question," Olson said in a telephone interview Tuesday. "This is about the rights of individuals
to be treated equally and not be stigmatized."
He said that he and Boies, who have become close friends in the years since Bush v. Gore, decided to
collaborate on the issue.
"We wanted to be a symbol of the fact that this not a conservative or a liberal issue. We want to send a signal
that this is an important constitutional issue involving equal rights for all Americans," Olson said.
The lawsuit was filed in U.S. District Court in San Francisco on Friday, before the California Supreme Court
issued a ruling Tuesday upholding the state's voter-approved Proposition 8, which banned gay marriage.
The suit argues that Proposition 8 creates a category of "second-class citizens" in violation of the U.S. M OS T PO P UL AR M OS T CO M M E NT S

They cite numerous alleged violations of the federal amendment including singling out gays and lesbians for a No eviction for home-renovating family - Metro

"We believe this is the kind of matter where Americans must come together and recognize the rights of all
citizens," Olson said.
The lawyers filed their challenge on Friday after the California Supreme Court announced it would be deciding
the issue on Tuesday. The suit is not an appeal of Tuesday's state high court decision but rather a challenge of
the Proposition 8 constitutional amendment. It was assumed that federal courts would be waiting for the
California decision before deciding whether to enter the fray. The lawyers hoped that filing early would give
them priority to enter the federal courts.
Olson said that no matter how the case is decided in the district court, one side or the other would likely appeal
to the 9th U.S. Circuit Court of Appeal. A decision there could be appealed to the U.S. Supreme Court, setting
up the ultimate legal contest.
Olson, a former U.S. solicitor general, has argued 55 cases before the U.S. Supreme Court. He has prevailed in
over 75 percent of those arguments. He has served in high level positions at the U.S. Department of Justice in
the Reagan and George W. Bush administrations.
In addition to the Bush v. Gore case, Boise has made headlines for other cases, including his successful
defense of NASCAR against antitrust charges. He collected a record $4 billion for American Express in its
litigation against Visa and MasterCard in 2008.

Brown and a private lawyer for Schwarzenegger wrote in papers filed in U.S. District Court in San Francisco
late Thursday that allowing same-sex couples to resume marrying now would create too much uncertainty.
Suspending the ban "would not serve the public interest because it would create significant uncertainty for
many persons concerning a relationship in which certainty is of the utmost importance," Brown said. "At this
stage of the litigation, these concerns must override the countervailing arguments presented by plaintiffs."
But the attorney general, in a follow-up brief filed Friday evening said he supports the aims of the lawsuit.
Brown said he agrees that Proposition 8 "imposed a special disability on gays and lesbians and their families on
the basis of sexual orientation," violating the U.S. Constitution's promise of equal protection and due process.
"Taking from same-sex couples the right to civil marriage that they had previously possessed under California's
Constitution cannot be squared with guarantees of the Fourteenth Amendment," Brown said. "Accordingly, the
Attorney General answers the Complaint consistent with his duty to uphold the United States Constitution."
On May 26, the California Supreme Court upheld the voter-approved same-sex marriage ban, which as a
constitutional amendment trumped the court's decision from a year earlier striking down a pair of laws that
limited marriage to a man and a woman.

Schwarzenegger has not taken a position yet on the validity of the federal challenge to Proposition 8. As a

During the challenge to Proposition 8 that was handled by the state Supreme Court this year, Brown, a
Democrat considering running for governor next year, surprised many people by refusing to defend the
measure. Schwarzenegger did not take a formal position in that case.
"It's still disappointing that (Brown) would continue to target Prop. 8 even after the California courts said it was
valid," Pugno said.
The federal case was filed on behalf of two unmarried gay couples last month by Theodore Olson and David
Boies, the lawyers who represented opposing sides in the contested 2000 presidential election. Griffin, a Los
Angeles-based political strategist, approached Olson about taking on the case and has recruited director Rob
Reiner, producer Bruce Cohen and screenwriter Dustin Lance Black as board members.
A hearing on their request for a temporary injunction that would prevent the state from enforcing Proposition 8 is
scheduled for July 2. If a judge grants the request, gay couples could have years to avail themselves of the
right to wed before the case gets settled.
Theodore Boutrous Jr., a member of the legal team in the case, said he disagreed with Brown and the governor
that lifting the ban when it could be reimposed later would create too much confusion. He noted that that in
upholding Proposition 8, the state Supreme Court allowed to let stand the marriages of an estimated 18,000
gay couples who tied the knot before the measure passed.

wished Schwarzenegger and Brown supported the injunction, it was more important for them to support the
ultimate purpose of the lawsuit.

Brown again says Prop. 8 should be struck down;
In his response to a federal lawsuit, he maintains the ballot measure violates
the U.S. Constitution.

California Atty. Gen. Jerry Brown once again refused to defend Proposition
8's ban on same-sex marriage Friday, telling a federal judge that it violated
the U.S. Constitution and should be struck down.
Brown made his arguments in response to a federal lawsuit against the state
by two gay couples who contend the initiative violates federal due process and
equal protection guarantees.
Over Brown's opposition, the California Supreme Court upheld the proposition
last month on state, not federal, constitutional grounds, a few days after the
federal suit was filed in San Francisco.
Brown's willingness to fight a state law that has been upheld by the state's
highest court contrasted sharply with President Obama's decision this week to
oppose a federal challenge to the U.S. Defense of Marriage Act brought in Orange
County.
In that case, a married gay couple, Arthur Smelt and Christopher Hammer, has
challenged the constitutionality of both Proposition 8 and the 1996 federal law
that prohibits extension of federal benefits to same-sex couples.
The U.S. Justice Department has argued that the Orange County challenge
should be dismissed, a position that was quickly denounced by gay rights law-
yers.
In a statement, Obama's lawyers noted that the president considers the gay
marriage ban discriminatory and wants it rescinded, but that his government is
legally obliged to defend the law on the books.
"The president has said he wants to see a legislative repeal of the Defense
of Marriage Act because it prevents [lesbian, gay, bisexual and transgender]
couples from being granted equal rights and benefits. However, until Congress

passes legislation repealing the law, the administration will continue to defend
the statute when it is challenged in the justice system," the statement said.
Brown, however, said that even though California is required to enforce
Proposition 8, he is free to agree with the challengers that it violates the
14th Amendment of the U.S. Constitution.
Brown's position, laid out in a brief filed late Friday, puts the state's
highest-ranking law enforcement officer on the record declaring that the ballot
measure violates federal constitutional protections. The San Francisco case may
eventually reach the U.S. Supreme Court.
At the same time, Brown argued that U.S. District Judge Vaughan Walker should
not suspend Proposition 8 immediately because a higher court could reinstate it
later and put same-sex couples in "legal limbo."
"Staying operation of Proposition 8, without the certainty of a final judg-
ment as to its constitutionality, would leave same-sex couples, as well as their
families, friends, and the wider community, in legal limbo," Brown argued.
Andy Pugno, the lawyer for the campaign that won passage of the measure, ac-
cused Brown of being "intent on undercutting Prop. 8 at every opportunity" when
told of the filing.
"The people of California really deserve better than to have their vote just
continually questioned and second-guessed by the attorney general," Pugno said.
The campaign has asked Judge Walker to allow it to defend the measure as a
full participant in the case, just as it did before the California Supreme
Court.
Nationally renowned attorneys Theodore Olson and David Boies filed the San
Francisco suit on behalf of a lesbian couple from Berkeley and two gay men from
Burbank who had been denied marriage licenses after Proposition 8's passage.
The lawyers are scheduled to ask Walker on July 2 to put Proposition 8 on
hold pending a trial. Gov. Arnold Schwarzenegger, in a separate filing, also
said the measure should not be temporarily blocked because of the uncertainty
over what higher courts will rule.
The federal challenge brought by Olson and Boies has worried gay rights advo-
cates who fear the federal courts, currently dominated by judges named by Repub-
lican presidents, could rule against those claiming a constitutional right for
gays to marry and set back their cause by as much as decades.
The American Civil Liberties Union, speaking for an alliance of gay rights
groups, lamented the Justice Department's move to dismiss the Orange County cou-
ple's suit.
"The administration is using many of the same flawed legal arguments that the
Bush administration used," Paul Cates, the ACLU gay rights project director,
said of the brief filed by the government late Thursday. "These arguments
rightly have been rejected by several state supreme courts as legally unsound
and obviously discriminatory."
The federal ban on recognizing same-sex marriages is also being challenged by
12 gay couples from Massachusetts who have identified specific damages suffered
because of the law, such as denial of joint tax-filing benefits, spousal bene-
fits for federal employees and inheritance rights.
Smelt and Hammer also sued the state over Proposition 8. In response to that
challenge, Brown filed a motion to dismiss, arguing that the men lack standing

to sue because their marriage has been recognized as legal and is unaffected by
the voter initiative.
In upholding Proposition 8, the state high court refused to apply it retroac-
tively, leaving an estimated 18,000 same-sex marriages intact.
Proposition 8, a constitutional amendment, reinstated a same-sex marriage ban
following the California Supreme Court's historic, May 15, 2008, ruling that the
ban violated the state Constitution.
The state high court rejected challenges that the measure was an impermissi-
ble, sweeping revision rather than a more limited constitutional amendment.

1 Pursuant to Rules 26 and 45 of the Federal Rules of Civil Procedure, Schubert Flint Public
2 Affairs, Inc., (“Schubert Flint”) hereby objects to the Subpoena issued by Plaintiffs in the above
3
captioned matter dated September 17, 2009 and served on Schubert Flint on September 24, 2009 as
4
follows:

GENERAL OBJECTIONS

7 1. Schubert Flint is still in the process of completing its factual investigation in connection
8 with the Subpoena served on it less than two weeks ago. Accordingly, these objections and
9 responses are provided without prejudice to Schubert Flint’s right to produce subsequently
10 discovered documents and materials, or to modify, change or amend these responses and
11
objections. The information provided in these objections is nevertheless true and correct to the
12
best of Schubert Flint’s knowledge at this time.

2. Schubert Flint specifically incorporates by reference the objections and arguments set
14
15 forth by Defendant-Intervenors in the following: 1) Defendant-Intervenors’ responses to Plaintiffs’
17 Defendant-Intervenors’ Reply in Support of Motion for Protective Order (Doc # 197); and 4) in
18
any stay and/or appeals papers Defendant-Intervenors may file regarding Plaintiffs’ attempt to
19
discover internal campaign strategy documents and/or nonpublic and/or anonymous
20
communications related to Proposition 8. These objections are based, inter alia, on relevance,
21
burden, and First Amendment privilege grounds.

24 Plaintiffs’ requests as set forth in the Subpoena violate protected First Amendment rights and
1 objections referenced above also include but are not limited to the objections made by Defendant-
2 Intervenors to producing drafts and other nonpublic pre-decisional documents or communications
3
associated with preparing final documents or communications regarding Proposition 8 that were
4
actually disseminated to the electorate and objections to producing documents and information
5
postdating the passage of Proposition 8 in November 2008.

8 burdensome to the extent that the terms “public” and “third-party” are not defined and/or limited in
9 any way, and taken at face value would encompass all communications Schubert Flint may have
10 had with any “third party”—even a single individual, whether or not a California voter—bearing
11
any relationship to Proposition 8 whatsoever. Such documents include, but are not limited to,
12
communications with individual donors, volunteers, or voters; communications with political
13
strategists and other agents or contractors of Defendant-Intervenors; and communications with
14
15 friends, colleagues, and casual acquaintances. Moreover, Plaintiffs seek these communications
16 regardless of whether they relate to the public understanding of or motivation for enacting
17 Proposition 8. This presents not only First Amendment concerns, but also creates an undue burden
18 on Schubert Flint in attempting to gather, review, and produce all such communications.

9 are more convenient, less burdensome, and/or less expensive. Schubert Flint further objects to the
10 Subpoena to the extent it purports to place an obligation on Schubert Flint to produce documents

Schubert Flint objects to the phrase “any third party” as vague, ambiguous, not defined, and not

reasonably narrowed. Schubert Flint further notes that when a similarly broad request was made to
13
Defendant-Intervenors, the Court in which this action is pending found the request to be too broad
14
15 and Defendant-Intervenors’ undue burden objections well-taken. Plaintiffs were directed “to
16 revise request no 8 to target those communications most likely to be relevant to the factual issues
17 identified by plaintiffs.” Doc. # 214 at 16. No such attempt to redraft the Request being
18 propounded on Schubert Flint has been made. On its face, this Request appears to be seeking any
19
communication related to Proposition 8 in any way, whether or not it is related to a public
20
communication or was actually available to the public. This Request appears to include, for
21
example: any and all communications Schubert Flint may have had with other vendors,
22
23 consultants, donors, members, friends, associates, or other correspondents. Such a broad request is
24 objectionable on First Amendment grounds and because of the undue burden and expense it would
25 impose on Schubert Flint to gather, review, log and/or produce all responsive materials, the
26
overwhelming majority of which are irrelevant to any issue in dispute in this case in violation of
27
Fed. R. Civ. P. 26(b)(2)(C)(iii) and 45(c).
