6. Charge or information:-

On date 04.12.2010, myself SI/J.N. Singh, ASI/A. Rai, H/C -1584, SK. Mazumdar,
C/9251, R. Mohanta were an ambush watch towards outside /NWS/KGP, North B/Wall
from 03.45 hrs. under supervision of Sri MK. Singh OC/RPF/NWS to work out an
information.

In course of ambush at about 04.15 hrs. noticed one person was coming towards East
from West direction by the South Side of Railway track, having some things heavy on his
hand in very suspicious manner. On reachable suspicious while he came near corner of
outside West + North Boundary wall /NWS/KGP by South Side of Rly. Track/NMP, We
surrounded and managed to detain.

On checking of plastic bag which was in his possession found identical Rly. material
noted in Sl. No. 4
On interrogation he disclosed his name and address on noted in Sl. No. 3(b). On asking
he failed to produce any legal document for the same in support of his lawful possession.
So it is reasonably suspected to have been stolen or unlawfully obtained from the Rly. As
per order of OC/RPF/NWS/KGP, I seized the same and then labeled at that spot in
presence of available witnesses. No other person could not be seem at the site due to
lonely place and night time. Informed the offence committed by him and then taken into
custody U/s 6 of RP(UP) Act. 66.

All we returned to the post with arrested person and seized materials, diarized the above
facts and a case No. 11/2010, dated 07.12.2010 U/s 3(a) RP(UP) Act 66 has been
registered against him and then enquired into the case instructed to me by
OC/RPF/NWS/KGP. (Extract of GDE enclosed).

In course of enquiry, examined the arrested person, and recorded his statement in
presence of one independent witnesses who gave voluntarily and confessed his guilt and
also prepared other relevant documents and then forwarded in the Hon’ble Court of
CJM/Paschim Medinipur for legal action.

In course of inquiry, as per lay written requisition, Sri SK. Acharyya/JE/NWS/KGP,

attended the RPF-Post-NWS/KGP’s Malkhana on 30.12.2010, where I produced the
seized material for his examination and certification. Who examined the same and I
obtained a certificate in this regard. (Certificate enclosed).

In course of enquiry, examined the seizure witnesses recorded their statements in which
all of them corroborated the date, time, place of seizure and articles seized and strongly
supported the prosecution (Statements are enclosed).

Also visited the RO and made a sketch map which is enclosed under the above facts
and circumstances i.e. on the merit of seizure list, confessional statement of accused
expert opinion certificate, statement of prosecution witnesses, being identical Rly.
materials, a prima-facie charge is made out against him for committing his offence for
unlawful possession of Railway materials which is punishable U/s 3(a) RP(UP) Act. 66.

Therefore, pray before your honour that kindly pass an order to put him into open trial
and PWS may please be examined.
