Abstract. In the article it is discussed the legal issues associated with historical cultural, culturological,
and archaeological expertise in the field of protection and use of monuments of history and culture in the Republic
of Armenia. The aim of this work is to identify the shortcomings of the current legislation, the formation
of the evidence base in cases of destruction, damage of monuments of history and culture. An important tool
to ensure the investigation and bringing the perpetrators to justice is expertise. The empirical data presented
in the paper confirm the correctness of this conclusion. The importance and actuality of development
of normative-methodological documents in the field of economic evaluation of damage caused to the historical and
cultural monuments are noted, as the current legislation of the Republic of Armenia and the relevant procedures
of examination do not allow to clearly determine the extent of damage. To address this question, it is proposed
the adoption of the law on the relevant expertise in this area, as well as the introduction of departmental regulations
that meet certain requirements. In addition, it is used the conceptual framework, the knowledge of which
is necessary for correct qualification of crimes. The interest of the reader can call up statistics that indicate
a high concentration of monuments of history and culture of the Republic of Armenia, principles of classification
of monuments according to the types. The article is recommended for employees carrying out state control
in the sphere of historical and cultural heritage. Some of the findings in terms of the purpose of historical-cultural,
culturological, and archaeological examinations, which reveal their essence, can be used in the preliminary
investigation and the filing of lawsuits.
