The Historic Hill Association is requesting a temporary street closing to conduct a neighborhood
Block Party for its members residing in The Historic Hill District.
STREET: School Street between Mary Street and Touro Street ( only this end is needed)
EVENT DETAILS: A casual summer outdoor neighborhood event to encourage meeting and
mingling with neighbors. Residents with homes located on School Street will serve food and
beverages from tables set up on their driveways and lawns.
Beer and wine will be served and only consumed on this private property.
The No-Open Container on Public Property Law will be strictly adhered to in the street.
The street area will be used for safely mingling about, conducting games, musical
entertainment and for dancing.
A musical group will perform and will adhere to the Noise Ordinance Sound Requirement
of under 65 dBA.
The Historic Hill Association will provide a Liability Waiver letter releasing" the City of
Newport" of any liability and a Certificate of Insurance upon approval of the street closing
request.

PRO.lECT ONE
PUBLIC ART NEWPORT
Project One is an all volunteer organization dedicated to promoting public art, and to producing
public art events and initiatives in and around Newport. We have produced many successful and
highly visible exhibitions, including The Banners project on light poles around the City; art on
Easton's Beach, Wind Sea Sky; and most recently, the temporary art installation VIEWPORT at
King Park in September/October 2010.
Based on the success of VIEWPORT 2010, Project One would like to organize a VIEWPORT
event for 2011. This letter is designed to outline the idea and invite the City's support and input.
VIEWPORT 2011 will follow the format of last year's VIEWPORT 2010 nearly identically:
The installation will be on view for four weeks from Sunday, September 11 th through Sunday,
October 9th.
VIEWPORT 2011 will involve sculptural installations on and around the beach area, floating
near the sea wall at anchor, and on lawn areas away from the playgrounds and gazebo.
Regional artists working with a vast range of materials will participate in installing 12 to 24
temporary site-specific artworks. (VIEWPORT 2010 had 11 artists' work displayed)
Artwork will be selected for content and safety. Limitation on height and square footage of the
artworks' footprint will be instituted and enforced.
An opening day event on Sunday, September 11, 2011, 1-5pm will be scheduled. Dance or
performance works will be presented at the opening day event and the NIMFEST will have
their last concert of the season in the Park.
Art will be removed from King Park by end-of-day Monday, October 10th.
Project One volunteers will assist with the installations, monitor the exhibition daily, and
ensure the artwork is removed upon completion of the event.

PUBLIC ART NEWPORT
Project One has reviewed this event with Susan Cooper of the Parks Department. Letters have
been sent to the Waterfront Commiss!on and the abutting property owners inviting them to voice
any concerns.
Two public meetings will be held to inform the public about the event and respond to any ques-
tions and concerns: Newport Public Library on May 3rd at 6-6:45 pm; King Park on May 7th
10-11 am.
We are hoping the City of Newport will collaborate with us to make this event possible again.
Bringing art into public spaces is important and exciting because it fosters an appreciation for art
within a community and encourages creative expression and civic participation at all levels. For
over 10 years, operating under the 501 (c)3 umbrella of the Arts and Cultural Alliance of Newport
County, Project One staged public arts events, worked closely with the city, local businesses,
utilities companies, artists, students, and volunteers creatively, and collaboratively. Project One's
purpose is to demonstrate that our city's cultural life is vibrant, ongoing and accessible to all.
Project One events and exhibitions bring art out of traditional settings and into the daily life of our
island and our city. Site-specific installations such as this offer an opportunity for engagement
with environmental conditions by temporarily and imaginatively transforming and re-using our
surroundings.

I write today to seek the council's approval to hold a parade procession down Bellevue Avenue on
Saturday, June 18, 2011. The purpose of this event is as follows; to commemorate Bellevue House
(the privately owned home located at 304 Bellevue Avenue, which is currently in its 101st year), to
celebrate the 70th birthday of Ronald Lee Fleming (the current owner of Bellevue House), and
finally to sashay proudly past the architectural achievements that make Newport the important
historic town that it is, all the while admiring the newly minted historical markers that line Bellevue
Avenue.
Those participating in the event would gather at the parking lot at Bailey's Beach Club at 4:30 pm.
They would then be driven, by city trolley, from Bailey's to 304 Bellevue avenue, where they will
gather in the front courtyard. The group will leave the residence between 5: 15-5 :30 pm. They will
walk to Bailey's Beach with an expected arrival time of between 5:45-6:00 pm. The participants
will be led by an acoustic jazz band on foot. The theme of the event will be a Louisiana style jazz
parade, or "Second Line". The gentleman will wear white suits and the ladies will wear black
dresses. Ifneeded the procession could step on the side walk at two intervals to allowiraffic to pass.
This jazz parade would welcome local people and visitors alike to experience the avenue as it
would have been years ago, while following in the continuity ofthe world famous Newport Jazz
Festival. This jazz parade would invite us all to listen, see and hearken to a day long past but not
forgotten.
We expect about 75 participants in total. The city council is welcome to join the parade.

This letter serves as a follow-up to our April 21, 2011 Council workshop which we presented an
updated alternative design for the subject project. This alternative is a direct result of the completed
Aquidneck Island Transportation Study (AITS).
As you are aware, the study was an initiative ofthe Aquidneck Island Planning Commission (AIPC)
working in close partnership with its member communities of Newport, Middletown and
Portsmouth, Rhode Island and its funding agencies, the Federal Highway Administration, the Rhode
Island Department ofTransp0l1ation and the Rhode Island Department ofAdrninistration's Division
of Plarrning. A significant amount of new transportation data along with stakeholder and public
input has been collected over the last 24 months and is included in the AITS.
The Pell Bridge Access Improvements concept modified under the Aquidneck Island Transportation
Study (AITS) ranked the highest with the weighted evaluation criteria meeting the overall goals and
objectives of the AITS. The concept appears to meet the goals of the City ofNewport and address
concerns expressed by the RITBA and RIDOT on previous alternatives that were developed under
the "Reconstruction ofPell Bridge Approach Roads and Ramps (Newport Side Only) and Admiral
Kalbfus Rotary" project. At a public meeting for the AITS on December 9,2010, the concept was
also viewed favorably during a "dot voting" exercise when the public was asked to vote for their
. preferences of proposed transportation improvements.

Recommended Concept
INTRODUCTION
Over the past 20 months, VHB has been working with the Aquidneck Island Planning Commission
(AIPC) on the multimodal Aquidneck Island Transportation Study (AITS). The study is an initiative of
the AIPC working in close partnership with its member communities of Newport, Middletown and
Portsmouth, Rhode Island and its funding agencies, the Federal Highway Administration, the Rhode
Island Department of Transportation and the Rhode Island Department of Administration's Division of
Planning. The intent of the 24-month study is to develop a Comprehensive Multimodal Transportation
Master Plan for Aquidneck Island. The Master Plan will guide the investment of future funding into the
Island's overall transportation system through a program of recommended short, medium, and long-term
capital improvements suitable for inclusion into the State of Rhode Island Transportation Improvement
Program.
As part of the AITS, VHB has collected a significant amount of new transportation data along with
stakeholder and public input; developed an Aquidneck Island regional travel demand model looking at
future travel demand forecasts based on future land use information received from the different Island
communities; worked with a project Technical Steering Committee to identify 28 different evaluation
criteria for various transportation improvement alternatives; and identified preliminary transportation
improvement alternative packages.
One of the preliminary transportation improvement recommendations from AITS, which was ranked the
highest with the weighted evaluation criteria meeting the goals and objectives of the study was a
variation of the Pell Bridge Access Improvement concept plan previous developed under the separate
"Reconstruction of Pell Bridge Approach Roads and Ramps (Newport Side Only) and Admiral Kalbfus
Rotary" project funded by the RITBA through the RIDOT. This memorandum has been prepared to
present the revised concept plan and highlight the changes from the previous concepts.
It should be noted that the roundabout analysis results summarized in this memorandum are based on
SIDRA software results, which is currently an accepted method of analyzing roundabouts, to analyze the
JT Connell Road/ Admiral Kalbfus Road roundabout.
PREVIOUS CONCEPTS
As part of the Study & Development phase of the "Reconstruction of Pell Bridge Approach Roads and
Ramps (Newport Side Only) and Admiral Kalbfus Rotary" (Reconstruction Project), several different
concepts and variations were developed and discussed. However, two concepts were selected for further
evaluation as described briefly below. Under both concepts, the Newport Rotary would be reconfigured
as a modern roundabout. For consistency with the results presented in this memorandum, it was
assumed that the double-lane roundabout wouldbe constructed with slip lanes (bypass lanes) for right
turn movements on all approaches expect the Training Station Road eastbound approach.
The weekday morning and evening peak hour periods were developed based on automatic traffic
recorder (ATR) counts and turning movement counts (TMCs) performed in July and August of 200l.
Based on RIDOT and RITBA data, an 18.5 percent reduction factor was applied to the peak season traffic
volumes to estimate average month conditions. To provide for a conservative assessment of future traffic
impacts, the existing peak season and average traffic volume networks were then increased by one
percent (1 %) per year for twenty years, and estimated site specific traffic generated by various potential
developments were added to establish 2021 peak hour traffic volumes networks, which were distributed
on proposed roadway networks based on the concept plans. The traffic assessments described below are
based on the projected traffic volumes from the Reconstruction Project and have not been updated to
reflect new traffic projections from the AITS.
Under Concept A, a portion of the bridge and ramps that currently provides access from the Pell Bridge
to Admiral Kalbfus Road would remain and be modified to also provide an on ramp to the Pell Bridge.
This would provide more traffic capacity and two connection routes to the Bridge. Under this concept
less traffic would travel through the roundabout because there will be an entrance/ exit ramp to the Pell
Bridge on Admiral Kalbfus Road at the traffic signal across from Newport Grand.
Under Concept A, the Admiral Kalbfus Road/JT Connell Highway roundabout is projected to operate at
an overall Level of Service (LOS) B during average weekday evening peak hour conditions. The
calculated 95th percentile queue length on all intersection approaches would be less than 200 feet during
the average weekday peak hour conditions.
During the peak season, the Admiral Kalbfus Road/JT Connell Highway roundabout is projected to
operate at an overall LOS D during weekday evening peak hour conditions. However, the Training
Station Road eastbound approach is projected to operate at LOS F with average delays over 3 minutes
and a calculated 95th percentile queue length of over 1,100 feet.
Concept B proposes to remove the existing bridge and off-ramp from the Pell Bridge to Admiral Kalbfus,
opening up a large area for potential development. Under this alternative more traffic will be required to
enter the roundabout and there will only be one connection route to enter and exit the Pell Bridge from
the north and east.
Under Concept B, the Admiral Kalbfus RoadlJT Connell Highway roundabout is projected to operate at
an overall LOS C during average weekday evening peak hour conditions. The Training Station Road
eastbound approach would operate at LOS F and experience some long delays with queues (over 600
feet) during the concentrated peak period; however, all other approaches would operate at LOS D or
better during the average weekday peak hour conditions.
During the peak season, the projected traffic volumes under Concept B at the Admiral Kalbfus Road/JT
Connell Iiighway roundabout would be greater than the maximum recommended for a double-lane
roundabout, and the roundabout would operate at a calculated LOS F during the weekday evening peak
hour period. The JT Connell Iiighway southbound approach is projected to operate at Level of Service

(LOS) with average delays over 3 minutes and a calculated 95th percentile queue length of over 2,500
feet.
AITS CONCEPT
A significant amount of new traffic data was collected in 2009 as part of the Aquidneck Island
Transportation Study. Based on discussions with the study Technical Steering Committee and the
RIDOT, it was determined that planning analysis day and month for the AITS would be calculated using
the 30 th highest hour volume. The 30 th highest hour is defined by the FHWA as a percentage of the annual
average daily traffic. For the ArTS, the 30th highest hour was determined to be during the afternoon peak
(4:00 PM) on a Thursday in August which is within the Summer peak season on the Island, and is
consistent with the time frame of the peak period that was analyzed under the Reconstruction Project.
An important component of the ArTS involved forecasting travel demands and land use changes
throughout Aquidneck Island. The Rhode Island Statewide Model was used to create an Aquidneck
Island sub-area model to estimate future travel demand on the Island. The Study Team used the land use
scenarios identified by the Island planners and estimated the number of households or jobs created by
each land use. The additional households/jobs were then applied to the appropriate Traffic Analysis
Zones (TAZs) in the model. Additionally, background residential growth independent of specific
development growth was allocated to each TAZ in the model based on existing land use patterns to
remain consistent with statewide forecasts. The model was used to forecast 2020 and 2030 future traffic
volume scenarios and to test alternatives that involve major changes in transportation infrastructure that
alter traffic patterns or mode choice. The resulting future traffic growth projections averaged to
approximately 0.64 percent per year between 2009 and 2030.
Using the traffic volumes projected from the detailed future conditions assessment performed under the
ArTS results in lower future condition traffic volumes compared to what was projected under the
Reconstruction Project. As a result, the actual operation of the roundabouts would be better than what
was projected under the previous study. However, the City of Newport was not in favor of Concept A
because it did not meet their goal of maximized redevelopment area, and the RlTBA was not in favor of
Concept B because all of the traffic in the area would be directed towards the roundabout and there
would be a "single point failure" if there was an incident in the roundabout without any alternate routes.
The concept developed under the Aquidneck Island Transportation Study, which is presented in
Attachment A, includes the same elements as previous Concept B (two-way connection along JT Connell
Highway from the Newport Rotary to Van Zandt Avenue, reconfiguration of the Newport Rotary into a
modern roundabout with slip lanes for right-turn movements, and the removal of the existing bridge and
off-ramp from the Pell Bridge to Admiral Kalbfus Road) with additional connections, increased capacity,
and enhancements to improve traffic flow and safety in the area as summarized below:
l" Construction of the Halsey Street Extension between Admiral Kalbfus Road and JT Connell
Highway with roundabouts on both ends. This new roadway, which was included in the City of
Newport's North End Master Plan, would provide an alternate connection and would reduce the
amount of traffic traveling through the roundabout at the intersection of JT Connell Highway and
Admiral Kalbfus Road.
l" Construction of a new connection from JT Connell Road (near the Pell Bridge Ramps) to Halsey
Street and Admiral Kalbus Road following an alignment along the south and east edges of the
DPW property and west of Newport Grand. This new roadway would provide an alternate

connection to/from the Connell Road/Farewell Street area to Admiral Kalbfus Road and the
potential redevelopment areas. Through the construction of a new roundabout, the connection will
provide an alternate access route from Admiral Kalbfus Road and the redevelopment areas to the Pell
Bridge On-ramp.
As part of the concept, it is assumed that JT Connell Highway will be widened to four lanes from
Admiral Kalbfus Road to north of the Halsey Street Extension at a minimum. In addition, limited or
restricted access with a center median will be needed along Admiral Kalbfus Road between Connell rr
Highway and Malbone Road/ Girard Avenue and along JT Cormell Road between the Pell Bridge Ramps
and Admiral Kalbfus Road. Vehicles wishing to turn left into or out of existing or proposed development
sites in these areas would be required to change direction (make u-turns) at the roundabouts.
Under the AITS Concept, during the peak season the Admiral Kalbfus RoadlJT Connell Highway
roundabout is projected to operate at an overall LOS B during weekday evening peak hour conditions.
The Training Station Road eastbound approach is projected to operate at LOS F with average calculated
delays of about 90 seconds and a calculated 95th percentile queue length of approximately 725 feet.
However, if a slip lane for right-turning vehicles is provided on the Turning Station Road eastbound
approach, the approach would operate at LOS B with average calculated delays on the approach reduced
to under 20 seconds, and the 95th percentile queue length on the approach would be reduced to under 200
feet.
SUMMARY
The Pell Bridge Access Improvements concept modified under the Aquidneck Island Transportation
Study (AITS) ranked the highest with the weighted evaluation criteria meeting the overall goals and
objectives of the AITS. The concept appears to meet the goals of the City of Newport and address
concerns expressed by the RITBA on previous alternatives that were developed under the
"Reconstruction of Pell Bridge Approach Roads and Ramps (Newport Side Only) and Admiral Kalbfus
Rotary" project. At a public meeting for theAITS on December 9, 2010, the concept was also viewed
favorably during a "dot voting" exercise when the public was asked to vote for their preferences of
proposed transportation improvements.
Preliminary analysis of the concept indicates that the Admiral Kalbfus Road/JT Connell Highway
roundabout is projected to operate at an overall acceptable LOS B during peak season peak hour
conditions with manageable queue lengths. If the concept is approved by the RIDOT, RITBA, and the
City of Newport, it is recommended that a VISSIM simulation model be developed to more accurately
simulate future conditions and to assist as the design is advanced.
WHEREAS, the City of Newport has been engaged with the Rhode Island Department
of Transportation (RIDOT), and with the Rhode Island Turnpike and Bridge Authority
(RITBA) in a study of the Claiborne Pell Bridge exit ramp configuration; and
WHEREAS, the study has focused on development of a modified bridge ramp plan that
creates a safe and efficient traffic flow pattern while allowing for the redevelopment of
land surrounding the bridge exit and entrance ramps; and
WHEREAS, with funding from the Federal Highway Administration, the Rhode Island
Department of Administration's Planning Division, and RIDOT, the Aquidneck Island
Planning Commission initiated the Aquidneck Island Transportation Study (AITS); and
) WHEREAS, in the AITS project, among the specific transportation issues considered
for review, the Pell Bridge Access Improvement concept received the highest ranking and
therefore was selected for further analysis by the design consultants; and
WHEREAS, the Newport City Council was presented with an updated alternative
bridge ramp design concept by RIDOT representatives on April 21, 20 II, reflecting the
product of work produced under the Aquidneck Island Transportation Study (AITS);
WHEREAS, both the Rhode Island Department of Transportation and the Rhode Island
Turnpike and Bridge Authority have endorsed the AITS Pell Bridge Access
Improvements concept. NOW THEREFORE BE IT
RESOLVED: the Newport City Council endorses the Pell Bridge Access Improvements
concept prepared by the AITS and directs City Administration to draft a letter of support
to RIDOT stating its endorsement thereof.

RECOMMENDATION:
As the petition for residential sticker parking meets the requirement of a minimum of 51 % of the resident households, it
is recommended that the attached ordinance amendment be adopted on first reading at the May 11, 2011 meeting. If
approved on second reading at the May 25, 20 Ilmeeting, sticker parking would then become effective 24 hours a day,
May I t1rrough September 30, once the appropriate signs have been installed.
On April 15, 2011, a petition from the residents of Martin Street was received requesting the implementation of
residential sticker parking 24 hours a day. The petition was forwarded to the Engineering Division of the Public
Services Department for review. The Engineering Division has advised that the number of resident households
represented on the petition exceeds the minimum 51 % required by City ordinance.

RECOMMENDATION:
The Department of Public Services recommends approval of a two year extension of the existing contract with Waste
Management. The contract extension period will be from July I, 20 II to June 30, 2013.
In accordance with the existing contract #07-071, the City of Newport may at its discretion negotiate three individual
one year extensions to the WM solid waste and recycling collection and disposal services contract. The City of Newport
exercised option I during FY II budget cycle which provided for a 0% contractual increase for the fiscal year. During
negotiations for the FY 12 budget cycle, the City was able to negotiate a two year extension that incorporates a 0%
contractual price increase during FYI2 and an increase no less than 0% and no more than 3% for FY13 based upon the
Annual Consumer Price Index Adjustment. The agreement also includes the implementation of the pilot "commercial
recycling" program during FYI2 (targeted start-up for July I, 20 II) and inclusion of 25 solar powered trash receptacles
similar to the demonstration unit located in front of Newport City Hall. Savings to offset the proposed increase in FY 13
will come from minor modifications to the yard waste and City barrel collection schedules. If approved, the City would
slightly increase the service provided to our citizens and expand our recycling capabilities while keeping costs at current
levels.

SOLID WASTE MASTER CONTRACT 2007 - CONTRACT #07-071
24 - MONTH TERM EXTENSION
By and between
This contract term extension is made and entered into by the associated parties.in accordance with
Paragraph 4, TERM OF CONTRACT, as found on page 20 of said contract #07-071 in order to extend the
solid waste master contract term by a period of24 months beginning July 1,2011 through June 30, 2013
per all existing contract language as contained within Contract #07-071, Solid Waste Master Contract 2007
as dated September 17, 2007. As agreed by both parties, the existing and current price structure for period
July 1,2011 to June 30, 2012 will be maintained throughout this term extension thereby resulting in zero
percent (0%) increase to contract value. For the period July I, 2012 to June 30, 2013, the existing and
current price structure will be subject to the contractual CPI index adjustment using the full year (12
month) percentage change for the 2012 calendar year as a basis of increase limited to no less that 0% and
no more than 3%. The average annual percentage will be utilized if it fall between these limits.
As condition for the 24-month extension, the target date for implementation of the pilot "Commercial
Recycling" Program will be July I, 2011. Furthermore, the contractor will supply 25 Big Belly Solar
Powered Trash/Recycling Receptacles for use within the City of Newport at various locations agreed upon
by the contractor and the City ofNewport. No additional cost will be incurred by the City of Newport for
their use. The target date for delivery and installation is 90-120 days after execution of this extension
agreement. The City of Newport will also work with WM in order to exercise the suggested modifications
to the yard waste and public barrel collection schedules as outlined in the WM correspondence dated April
22,201 L

This letter is to respond to the two questions raised regarding our latest extension offer dated
April 13, 20 II.
The target date for the implementation the pilot "Commercial Recycling" program will be July I,
2011. Upon execution ofthe Amendment to the Master Agreement, we will work with City staff
to finalize a plan to address communication of the availability of this service to the target
audience.
As far as piloting Waste Management's Solar Powered public area trash receptacles, we would be
prepared to commit to supplying up to 25 units to be placed in the highest volume areas ofthe
City. This would be done at no additional cost to the City and WM would retain any cost savings
gained through collection efficiencies during the pilot, to offset the significant investment. We
would need 90 to 120 days from execution ofthe Amendment to the Master Agreement to deliver
the units. We would work together to identi/y the locations for the new solar powered units to be
installed and to determine the number and locations for the current public litter barrels to be
removed. The target would be to remove 40 to 50 ofthe current batrels to be replaced with the 25
solar powered units. We will work with your staff to develop an implementation plan over the
next 30 days.

I am in receipt of your letter dated March 24, 2011 which responds to our recent offer for
the extension of the Master Agreement for Solid Waste and Recycling services.
Waste Management, in response to your request, would ask the City to consider this
revised offer.
I. The cpr adjustment that would take effect July 1, 20 II will be waived and the
current rates would remain in effect through June 30,2012. Rates for FY13 would
be subject to the contractual cpr adjustment, limited to no less than 0% and no
more than 3%. We would also suggest modifying the cpr index to use the full
year percentage change in the CPI vs. the month of April index. This will allow
the FY13 rate to be calculated in early February for budgetary purposes.
2. The remaining two option years will be extended bringing the conclusion of the
Agreementto June 30, 2013.
4. WM shall incorporate into the amendment to the Master Agreement, the services
provided under the expired Transfer Station Residents Use contract. This will
allow Newport residents to continue to receive the benefits offered for the two-
year extended term.
5. The City can elect to modifY the scope of work as outlined below in order to
reduce the associated cost as specified. WM will consider other modifications as
requested by the City and agrees to promptly offer an estimate of any potential
savings under the Agreement for same.
• Modify Yard Waste Collection Schedule - The City may wish to consider
reducing the winter yard waste collection frequency. We would suggest
eliminating I week in December, conduct only 1 combined yard waste/Tree
collection in January and eliminate 1 week in February. This modification
would provide savings of $ 13,000.00
• Modify Public Barrel Collection Schedule - The City may wish to eliminate
the second daily collection of the public area barrels for the months of
November through February. This modification would provide savings of
$10,000.00
We understand the financial plight of the City, but we believe it is important to point out
that this offer will mean our rates to the City have actually been reduced by .02% from
FYIO through FY12. I can assure you our costs, when considering the skyrocketing
health care and fuel expenses, are not going down and this request for a third consecutive
year without a rate increase will continue to deteriorate any earnings we anticipated when
we entered the Agreement with the City.
More importantly, by exercising the two remaining option years in the Agreement, we
can have adequate time to work with the City on important program changes such as the
implementation of the Commercial Recycling program. There is a great deal of effort to
introduce such a program and the two year term will allow us the proper time to work
through the start-up challenges.
We would also like to revisit the introduction of Waste Management's Solar Powered
public area trash receptacles. We believe these units may offer a clean efficient solution
to manage litter in key areas of the City in a way that will demonstrate the City's
leadership to introducing environmentally responsible programs.
We believe this is a fair offer for both parties and we would respectively request your
support to put this before the City Council for consideration. Please let me know if you

The Department of Utilities recommends approval of CAM #11-001 with United Water which adds the operation and
maintenance and monitoring of the UV Disinfection System for the moat discharge onto Easton Beach to the service
agreement effective stating May 20 II. The operation and maintenance and monitoring costs associated with the UV
Disinfection System will result in the annual service fee for FY2012 to be increased by $148.680.00. The service fee for
May and June 20 II will be $12,390 per month for the operation of the UV Disinfection System.
United Water provides services for the Water Pollution Control Division per a Service Contract executed December 13,
2000. Contract Administrative Memoranda is the formal process within Section 6.17 of the Service Agreement for
addressing changes in the Service Agreement. CAM # 11-00 I represents a change in the Service Agreement by adding
the UV Disinfection System to the managed assets; in tum this results in an increase to the Service Fee. CAM #11-001
also includes the additional sampling and laboratory analysis required per the draft Consent Decree being negotiated
with EPA. The allowance for the sampling and laboratory analysis for FY 2012 and 2013 is $20.000. Beginning in FY
2014 the sampling and laboratory analysis allowance will be reduced to $1000 and will be reflected in the annual service
fee for FY 2014.
The annual service fee for FY 2011 determined in accordance with the Service Agreement is $3,721,000.12 or
$310,083.34 per month. The annual service fee is adjusted annually as specified in Section 14.3.

Effective as of May 1, 2011
Set forth below are the understandings of the City and the Company with respect to this
Contract Administration Memorandum (CAM) to the Service Contract relating to the
scope of responsibilities, adjustment to the annual service fee and other fee adjustments
for Operation and Maintenance of the Easton Beach Storm Water UV Disinfection
System which is being added to the system. The Company agrees to perform the scope of
services and the City agrees to compensate the Company for services performed under
this Contract Administration Memorandum.
1. The Easton Beach Storm Water Ultra-Violet Disinfection System will be available for
service for the period May 1sl to September 30 th inclusive each calendar year. United
Water will monitor the disinfection facility when it is activated during storm events
occurring during the May through September period. Currently twenty-two (22)
activations are anticipated each year. The facility will remain online for a 24 hour
period, beginning at the onset of each activation. The Company will check and
observe proper operations of the facility for a 24 hour period at a frequency of not
less than once every 4 hours. Additionally, the Company will perform security checks
no less than two times per week and perform grounds maintenance year-round.
2. The Company will retain Fuss and O'Neill to support the initial operations of the new
Ultra-Violet Disinfection System for Easton's Beach. This subcontract will also cover
sampling and laboratory analysis requirements as requested by the City for Fiscal
Years 2012 and 2013 .. There will be an allowance of $20,000 per year, for the first
two years of this CAM for the sampling and laboratory analysis. At the beginning of
the third year, and beyond, the allowance will be reduced to $1,000 per year to cover
the cost of sampling and laboratory analysis. The Company will not exceed this
budget amount without prior authorization from the City.
3. The cost for electricity for this facility will be billed to the City on a monthly basis as
part of the monthly invoice, as is the current practice for all ofthe other facilities.
4. The Company will provide operation and maintenance of the Easton Beach Storm
Water Disinfection System in accordance with the Service Contract, subject to the
exceptions stated in this CAM # 11-00 I The annual fee for the initial year of
operations and maintenance of the facilities is attached.' This fee will be escalated
annually per the Adjustment Factor as set forth in Section 14.3(f) of the Service
Contract.
5. The Annual Repair and Replacement allowance for the UV System will be $57,200 as
of the date of this CAM 11-00I. This component will cover the costs for service
contracts, lamp and ballast replacement, lamp and ballast disposal, chemicals for
cleaning the UV tubes, cleaning of the UV channels as necessary to remove sand and
silt by outside vendor, crane services, repair costs associated with the bar screen, all
pumps, diversion gate, and any other ancillary equipment at the facility.
a. The Company will budget $57,200 per year (effective July I, 2011)
The Repair and Replacement costs will be tracked on a monthly basis
and will be included in the monthly Operating Report.
b. A one-time allowance of$II,745 for SCADA tie-in of the disinfection
system to the WPCF is included in the first year cost for this CAM.
c. Any funds from the Repair and Replacement allowance that are not
spent in any contract year will be rolled over to the following contract
year.
d. Any costs that are in excess of the Repair and Replacement allowance
balance will be billed directly to the City as they are incurred by the
Company.
e. The Company will preserve and enforce all warranties for new
equipment during the contract or warranty provided period.
f. The monthly fee for May 2011 and June 2011 will be prorated at
$12,390 per month with $4,766.67 per month going into the Repair
and Maintenance allowance.
6. The Company will maintain the facilities per the manufacturers' specifications but
will accept no liability for the facilities failing to meet their designed performance
levels.
7. Labor costs are based on twenty-two (22) events at twenty-four (24) hours in
duration.

Approve a two-year agreement between the City of Newport and the Newport Marriott Hotel, for extension of a contract
for use of the Gateway Parking facility. This agreement is an updating and continuation of an original covenant between
the two parties drafted in 1985, as part of the construction of the hotel.
As a condition of the building of the Marriott Hotel, to comply with Zoning requirements, the Marriott Hotel ownership
and the City of Newport agreed upon a plan wherein the City would allocate 210 parking spaces in the Gateway parking
facility, sold annually to the hotel in the form of21,000 daily parking passes. This agreement continues the provisions of
that original covenant and subsequent amendments in 1997 and 2008. The updating of the agreement raises the unit
price of the daily parking pass to $5.00. As a condition of the agreement, the Marriott Hotel will convey to the City of
Newport payment totaling $105,000; to be paid in increments defined in the agreement.

The current licensing period, beginning May 1st of each year, occurs after the start oft\Je seasonal operation of pedicabs
requiring the licensed vehicles to display City-issued license plates from the previous calendar year. Aligning the
licensing period with the calendar year will reduce confusion in the licensing process and in the police monitoring of
pedicab operations.
The City currently permits the licensed operation of Pedicabs on public roadways in Newport (as defined by Ordinance
5.97), and limits the number that may operate at anyone time to twelve (12) pedicab vehicles. The use of pedicabs has
proven to be an attractive alternative to motorized transportation in the downtown area. Upon receiving a request for
expansion of the number of pedicabs allowed to operate, a review of the history of pedicabs was done including
examination of complaints to police related to pedicab activity. No substantial issues were identified that would inhibit a
recommendation to expand the permissible number of licensed vehicles. Weighing the benefits and popularity of pedicab
use against relevant traffic and safety issues, the modest expansion of the pedicab vehicle number from 12 to 16 is
considered reasonable. Police will continue to monitor pedicab operations to ensure their adherence to all applicable
traffic safety rules.
