This is to request your assistance in regards to this letter I recently received from the Federal Emergency
Management Agency (FEMA):

March 31, 2011

Dear Mr. Heimlich:

This letter pertains to your January 20, 2010, Freedom of Information Act (FOIA) request to the
Department of Homeland Security (DHS)/Federal Emergency Management Agency. You
requested information regarding all correspondence exchanged between representatives of the
Save-A-Life Foundation (Schiller Park, IL) from January 1, 2007 to the present.

By a letter dated March 19, 2010, we advised you of the estimated fee of $410.00 for processing
your FOIA request. Because the estimated fee exceeded $250.00, we required an advance
payment of the estimated fee for us to continue processing your request. See 6 C.F.R. § 5.1 l(i).
We also advised you in that letter that if payment was not received within 14 business days, we
would consider your request withdrawn. To date, we have not received your payment. As a
result, we are administratively closing this case.

Additionally, please be advised that because we have not received a payment of $410.00, we will
not process any future requests you submit to this office. See 6 C.F.R. § 5.11(1). Moreover, in
accordance with 6 C.F.R. § 5.11(g), we may charge interest on any unpaid bill starting on the
31st day following the date of this letter. Interest charges will be assessed at the rate provided in
31 U.S.C. § 3717 and will accrue from the date of the billing, in this case March 19, 2010, until
payment is received by FEMA. FEMA shall follow the provisions of the Debt Collection Act of
1982 (Pub. L. 97-365, 96 Stat. 1749), as amended, and its administrative procedures, including
the use of consumer reporting agencies, collection agencies, and offset.

To summarize, Dr. Bennett's letter accurately states that I submitted a January 20, 2010 FOIA request
and that in a March 19, 2010 reply, FEMA informed me that if I did not submit a $410.00 processing fee
within 14 business days, my request would be withdrawn and the case closed. I chose not to pay the
processing fee and based on the understanding that the case would automatically expire, I perceived no
need to respond.
I received no further communications about the matter until Dr. Bennett's recent letter informing me that
I'm subject to the following penalties:

1) FEMA will not process my future FOIA requests.

2) FEMA may hold me liable be for interest charges, I may be dunned by collection agents, and my credit
rating may be damaged.

As I understand it, as of March 31, 2011, FEMA is penalizing me for failing to pay for a FOIA request that
was never processed, for which I never received any documents, and about which I've received no
communications since a March 20, 2010 letter informing me that my request would be canceled 14
business days thereafter.

I couldn't understand the reasoning in Dr. Bennett's letter, so I shared it with attorneys who specialize in
federal FOIA law. They responded that they'd never heard of anything like this, that they didn't
comprehend the nature or purpose of his letter, and that they saw no basis for FEMA inflicting any
penalties upon me or threatening to do so. I also contacted an organization that represents reporters'
legal rights and shared Dr. Bennett's letter with a staff member who specializes in FOIA. His response
mirrored that of the attorneys.

Further, I received an April 14, 2011 voice message from Dr. Bennett informing me that FEMA would not
process a FOIA that been submitted to his department on September 30, 2010 on my behalf in a memo
from Sabrina Burroughs, Disclosure & FOIA Operations Manager of the Department of Homeland
Security (attached).

Based on your job description posted on the Department of Homeland Security website, I thought you
might be able to help address, untangle, and perhaps resolve this matter. I value my rights granted by the
Freedom of Information Act, therefore I wish to comprehend on what basis they've been rescinded and
what actions I must take to reinstate them.

Since my credit rating may be in jeopardy, I respectfully request your prompt attention to this matter.

Attached is a Freedom ofInformation Act (FOIA) request received at the DHS FOIA Office on
September 22,2010. The requester is seeking any and all records pertaining to the following
events:

1. May 18, 2007 letter, Deputy Chief Illinois Homeland Security Director Col. Jill
Morgenthaler and Indiana Senior Homeland Security Planner David Barabee participated in a
First Responder/Careers in Healthcare Curriculum Review Panel organized by the Save-A-Life
Foundation (SALF), a nonprofit based in Schiller Park, IL.

2. September 1, 2007 media release, Co. Morgenthaler participated in a SALF event in


Maywood, IL called the "Coalition of the Caring".

Upon review of the request, I have determined that, if such records exist, they would be under
your purview. Therefore, I am transferring this request to your office for action. Please respond
directly to the requester.
