On several occasions I have made it clear to Bob Kelley that that is the position of the BHE and if the NCAA grants relief, the BHE will fully support retention of the name and logo. His comments on the radio were not well put and I spoke to him about that. He directed me to his comments in the Herald on Saturday where he clearly stated that his belief that we need to move on is intended only in the event the NCAA does not grant relief. In that respect, I think most folks agree. However, that discussion should take place only in the event we don't have success with the NCAA, and not before. Late yesterday I met with Bob Kelley, Brian Faison, Tim O'Keefe and Jody Hodson and gave the same directive to Bob with them present. To be clear, there have been and will be NO efforts on the part of this Board or UND to diminish the ability of all constituents to make the best argument possible for retention of the name and logo. This being said, I am of the opinion, as I have stated to your earlier, that the primary presentation to the NCAA needs to be headed by the Governor and the legislative leadership as those are our "biggest guns" to use. Therefore, it is my sincere hope that you will make some effort to communicate with the Governor and Sen. Stenehjem, along with anyone else you see fit, to develop the arguments in advance of the Indianapolis meeting. I remain ready and willing to assist you in any manner you wish. Thanks Al. To: "Espegard, Duaine" <duaine.espegard@ndus.edu> Subject: UND Nickname Dear Mr. Espegard, Each of us has served as President of either the UND Alumni Association or Foundation Boards. All of us are proud Alums of the University of North Dakota and have gladly devoted many hours to serve. While we are no longer sitting in those chairs, we remain deeply engaged in caring for our Alma Maters future. And while we were honored to serve, we speak now as concerned Alumni, but with no official capacity. Each of us has had a keen interest in the way our school has been identified as the Fighting Sioux. Most, but not all of us, would have wished to see the nickname continue. But we have all reached the conclusion that to continue to fight the NCAA over this matter is counterproductive for the present and future of UND. It is our belief that the Fighting Sioux nickname must be retired quickly. We are aware of the steps taken by the North Dakota Legislature to enact into law that UNDs athletic teams would retain the Fighting Sioux name. And we are aware that the NCAA has informed the school that they intend to enforce sanctions against the school, should the name be retained beyond August 15th of this year. We are also aware that the invitation to join the Big Sky Conference is in jeopardy over the sanctions that will be applied if the name goes forward. We are also aware that State Leaders have been invited to meet with NCAA leadership over this matter sometime soon. We are concerned about the corrosive effect this situation has had on the leadership of the school, requiring extraordinary amounts of time and energy that should be going to the primary purpose of providing a quality education. It can be argued that todays students are being short-changed because of all the time and expense this has required of President Kelley and his administration. Barring a change in the position of the NCAA toward UND and the promised sanctions, we are asking you to move quickly to remove any roadblocks to retiring the Fighting Sioux nickname. If this requires a special session of the legislature to repeal the recent law, it should be done swiftly. It is our feeling that not doing so would have catastrophic results for our school. This is a real crossroads for the future of our institution. UND is one of the states greatest assets. To allow our athletic department to lose the opportunity to compete at the highest level possible would have far reaching consequences, none of which appear to be positive. Nothing short of a speedy settlement of this issue to the satisfaction of the NCAA and the Big Sky Conference is acceptable. There may remain pockets (even large ones) of popular

sentiment to retain the name and stand up to political correctness. However good those intentions, they are shortsighted and will only do great harm to UND. Please act quickly to protect UND from further damage. Sincerely,

I was a very strong Fighting Sioux supporter but realized some time ago that we were likely fighting a losing battle. Obviously, the SBoHE saw it this way as well. When the issue resurfaced in the ND legislature, I contacted every member of both the House and Senate. I asked them to vote for the bill ONLY if there was a very near 100% assurance that passage would put the issue to bed without ramifications from the NCAA. Obviously their vote was an attempt (a very late attempt) to save the name but it is clear that their effort has backfired. This is a real mess now! I am not knowledgeable enough to offer specific advice as to how to address and solve the problem but it does need to be addressed and it needs to be addressed immediately. Please be proactive in trying to remedy the issue rather than taking the stance that it is "no longer our problem". I would suggest the following action be done by those in charge very soon. (SBHE has sent letter twice to offer the help. They have not heard from any of them) 1. Make a trip to Standing Rock to see if they can get their permission to use the name a. If they can get the approval go to NCAA with approval in hand b. If not go to NCAA and see if they will compromise with out the approval. If they have approval see if they will go back and accept the terms after the fact. Which ever result UND needs to move on. If sanctions are imposed it will hurt all sports including Hockey.
