AGENCY RESPONSES: (Sent 4/27/11 - Due 5/11/11)

Building Safety: Code Compliance: Development: Fire Marshal: LPD: Parks & Recreation: Public Service: Transportation: The use proposed in this SLU is much less intense that the area is designed to support. As such, no adverse traffic issues are :anticipated. This use does not, however, maximize the use of the transportation infrasteucture which was put in, place to support commercial activities on this site. ANALYSIS Section 1282.03(f)(1)-(2) sets forth the criteria which must be used. to evaluate a Special Land Use permit request The criteria and evaluation are as follows. 7:. Is the proposed special land use designed, constructed, operated and maintained in a manner harmonious with the character of adjacent property and the surrounding area? The proposed site is within. an exiting shopping center that houses retail and service related uses. A church in such an environment is perceived to have a negligible impact on surrounding uses, particularly since there is more than adequate parking available on. the site. Furthermore, the church is typically in use at times that do not conflict with peak hours for other businesses and activities are generally confined to indoors. The greatest potential impact on its harmony with the surrounding commercial area could be the .conflict between the church and future liquoriicenses. This is described in greater detail under item. 3 below. 2. Will the proposed special land use change the essential character of the surrounding area?

SLU-2-2D79

1122 W. Holmes Road

Page 3

The proposed church will not change the essential character of the area. The church will be located in an existing commercial facility and, as described in item 1., should not have any negative impacts on. the surrounding area. 3. Will the proposed special land use interfere with the enjoyment of adjacent property? The primary concern with churches in terms of interfering with the enjoyment of adjacent properties is the potential conflicts with liquor licenses. By state law, a church has an opportunity to object to all new liquor licenses within 500 feet of the church property. In this. case, there are several commercially zoned properties within 5Q0 :feet of the subject property. Since this is a predominately commercial district, the applicant should agree, in writing, that it will not object to the issuance of liquor licenses in the.area. 4. Will the proposed special land use represent an improvement to the use or character of property under consideration and the surrounding area in general, and will the use be in keeping with the natural environment of the lot? The. proposed use of this site for a church will .nothave any negative environmental impacts on the site or the surrounding: area in general. In fact, the proposed . church. could have a positive impact 01 tile.facilityby providing aviable'use of anOtherwise Vacant portion of .a shopping center. With regard to the natural environment, no changes are proposed for the site. 5. Will the proposed special. land use be hazardous to adjacent property or involve uses, activities, materials or equipment which are detrimental to the health, safety or welfare of persons or property through the excessive production of traffic, noise, smoke, odor, fumes or.glare? The. church will not generate any nuisances .or'bo7ardoris conditions. 6. Will the proposed special land use be adequately served by essential public facilities and services, or is it demonstrated thatthe person responsible for the proposed special land use is able to continually provide adequately for the services and facilities deemed essential to the special land use under consideration? The subject property is. currently served by all necessary public services and utilities. No negative comments have been received fromany of the reviewing departments or agencies. Inspections may be necessary to determine if the structure complies With current building code and fire code requirements for an assembly use. 7. Will the proposed special land use place demand on public services and facilities in excess of current capacity? The proposed special land use is not expected to increase the demand on public services .and facilities in excess of current capacity

8_

Is the proposed special land use consistent with the intent and purpose of this Zoning Code and the objectives of any currently adopted Comprehensive Plan? The comprehensive plan and the zoning ordinance both designate the subject property for commercial use. Churches are permitted in commercial districts, subject to obtaining a special land use permit. In many respects, churches have a similar impact on the surrounding area as most 'Commercial' uses in that passenger parking is the only regular activity occurring on the site, outside of the building.

9..

Will the proposed special land use meet the dimensional requirements of the district in which. the property is located? The only dimensional requirement that applies to. this request is parking. Section 1284.13.(b)(1) of the Zoning Ordinance requires 1 parking space.for each 3 seats in the main sanctuary. Since the :applicant would like to have seating for 30 people in the sanctuary, l0 parking spaces are required. There. are several hundred parking spaces on the site, most of 'which are rarely ever used.. There are numerous vacancies: in the shopping center. and. even at full capacity, there is more than adequate parking to accommodate the needs and f dill the. Zoning Ordinance requirements for a shopping center. Section 1268.04(b) of the Zoning Ordinance states that churches in the "F" Commercial district, must be. located on a collector, principal or minor arterial. Holmes Road is designated as.a:minorr arterial and S. MLK is designated as a major arterial. Therefore, the request complies with the condition. SUMMARY

This is -a request by Esteban R. 'Chavez to utilize 1122 W. Holmes Road, Suite 3 (Logan Square Shopping Center) for a church. Churohes are-permitted in the "F" Commercial district, which is the designation of the subject property, if a Special Land Use permit is. approved by the Lansing City Council. The church has been established for 6 years and has a membership of approximately 30 individuals. -Services are held on Sunday from 10-11:30 n.m. Wednesday services, Friday youth activities and other special events and outreach services are also provided. Based on the findings contained in. this staff report, the proposal complies with all of the criteria of Section 1282;03(f)(1)-(9) of the Zoning Code for evaluating `Special Land 'Usepermits. L 2. 3.. The proposed SpecialLand Use will be harmonious with the character of adjacent properties and surrounding uses. The proposed Special Land Use will not change the essential character of the surrounding properties. The proposed Special Land Use will not interfere with the general enjoyment of adjacent properties.

The proposed Special Land Use does represent an improvement to the lot as it currently exists. The proposed Special Land Use will not be hazardous to adjacent properties. The proposed Special Land Use can be adequately served by public services and utilities. The proposed Special. Land Use will not place any demand on public services and facilities in excess of current capacities. The proposed Special Land Use is consistent with the specific designations of the Zoning Code and the Southwest Area Comprehensive Plans. The proposed Special Land Use will comply with the dimensional requirements of the Zoning Ordinance.

RECOMMENDATION Staff recommends approval of SLU-2-2011., based upon the findings of fact as outlined in this staff eport, subject to the applicant agreeing, in w-iting, that it will not object to the issuance of liquor licenses in the area. Respectfully Submitted, Susan Staehowiak Zoning Administrator

June 28, 2011

Honorable Mayor Virg Bernero Ninth Floor, City Hall Lansing, MI 48933-1694 RE: Z-1-2011, 601 N. Pennsylvania Avenue Rezoning from "DM-3" Residential District to "D-1" Professional Office District Dear Mayor Bernero: The Lansing Planning Board, at a special meeting held on June 23, 2011, voted (5-0) to recommend approval of the request by the Neogen Corporation to rezone the property at 601 N. Pennsylvania Avenue from "DM-3" Residential District to "D-1" Professional Office District. The intent of the rezoning is to allow the building at this location to be used for administrative offices for the Neogen Corporation. The Planning Board found, based on testimony, evidence and the staff report that the proposed rezoning would be consistent with the established zoning and land use patterns in the area. The board also found that the rezoning would not create any adverse impacts on traffic, the environment or future patterns of development in the area. At the Planning Board public hearing held on June 21, 2011, the applicant spoke in favor of the request and no other comments were received. Following your review of this matter, please refer it to the City Council for its consideration.

MASTER PLAN DESIGNATION: The Northeast Area Comprehensive Plan designates the subject property for office use. Pennsylvania Avenue is designated as a minor arterial and Linden Grove Avenue is designated as a local road.

SPECIFIC INFORMATION This is a request by the Neogen Corporation to rezone the property at 601 N. Pennsylvania Ave., more specifically described as: Lot 19, Block 1, Assessors Plat No 7, City of Lansing, Ingham Co., MI from "DM-3" Residential District to "D-1" Professional Office District. 601 N. Pennsylvania Avenue

Page 3

COMPLIANCE WITH MASTER PLAN The Northeast Area Comprehensive Plan, as amended in 1986, designates the subject property for office use. Therefore, the request is in compliance with the land use pattern being advanced in the Master Plan. IMPACT ON VEHICULAR AND PEDESTRIAN TRAFFIC No adverse impacts on vehicular and pedestrian traffic are anticipated to result from the proposed rezoning. Pennsylvania Avenue is a minor arterial that is designed to carry a relatively high volume of traffic. In addition, there is already a strong mix of residential and nonresidential traffic in the area. The applicant intends to utilize the existing building at 601 N. Pennsylvania for "overflow" office space to support the Neogen operations that are headquartered in the former Oak Park Elementary School building located approximately 200 feet northwest of the subject property. The required number of parking spaces will be based upon the amount of usable floor area in the building. The ordinance requires 1 parking space for each 200 square feet of usable floor area. The existing building has a gross floor area of 836 square feet. Therefore, if 75% of the building will be considered usable floor area, 3 parking spaces will be required. Required parking spaces must be located either on-site or within 300 feet of the site. While the subject property is too small to accommodate 3 parking spaces that would meet the dimensional requirements of the Zoning Ordinance, Neogen owns two large properties to the west that are well within 300 feet and have ample parking to accommodate the required parking spaces for this proposal. Since the property is currently zoned "DM-3" Residential, based upon the lot size 2 2bedroom apartments would be permitted. The traffic generated by these apartments would likely be equal to or exceed the traffic generated by the proposed office uses. ENVIRONMENTAL IMPACT There are no physical changes proposed for the site and therefore, the rezoning will have no impact on the natural environment. IMPACT ON FUTURE PATTERNS OF DEVELOPMENT The request to rezone the subject property to "D-1" Professional Office will not adversely affect the land use patterns in the area. There is already a very strong presence of office zoning and land uses in this area. In fact, the property located directly west of the subject property is currently zoned "D-1" Professional Office district and is owned and utilized by the applicant for this proposal (Neogen Corporation).

The Neogen operations have also proven to be very compatible with adjoining residential uses, as they are low impact uses that do not generate much traffic, noise and other. potential nuisances. There are several properties owned and operated by Neogen on the east side of Lansing and most, if not all, are located in predominantly residential neighborhoods. There have been no complaints of noise, fumes, odors, excessive traffic or any other type of problems. Neogen is proposing to utilize the building at 601 N. Pennsylvania Avenue for offices which should not interfere with the enjoyment of the adjacent residential properties. Office uses in general are considered compatible with residential neighborhoods since they typically generate a low volume of traffic and do not create much noise or other nuisances SUMMARY This is a request by the Neogen Corporation to rezone the property at 601 N. Pennsylvania Ave., more specifically described as: Lot 19, Block 1, Assessors Plat No 7, City of Lansing, Ingham Co., MI from "DM-3" Residential District to "D-1" Professional Office District. The purpose of the rezoning is to allow the building at this location to be used for administrative offices for the Neogen Corporation. The proposed rezoning is consistent with the land use pattern being advanced in the master plan and with the zoning and land use patterns already established in the area. In addition, no adverse impacts on vehicular and pedestrian traffic, the environment or future patterns of development are anticipated to result from approval of this rezoning. RECOMMENDATION Pursuant to the findings described above, the following recommendation is offered for the Planning Board's consideration: Recommend that Z-1-11 be approved to rezone the property at 601 N. Pennsylvania Avenue from "DM-3" Residential District to "D-1" Professional Office District, based on the findings of fact as outlined in this staff report. Respectfully Submitted, Susan Stachowiak Zoning Administrator

June 28, 2011 Honorable Mayor Virg Bernero Ninth Floor, City Hall Lansing, MI 48933-1694 RE: Z-2-2011, 2331 N. Larch Street Rezoning from "J" Parking District to "F" Commercial District Dear Mayor Bernero: The Lansing Planning Board, at a special meeting held on June 23, 2011, voted (5-0) to recommend approval of the request by Leo J. Trumble III to rezone the rear portion of the property at 2331 N. Larch Street from "J" Parking District to "F" Commercial District. The purpose of the rezoning is to allow for future construction of a building on the area of the site that is currently zoned "J" Parking. The Planning Board found, based on testimony, evidence and the staff report that the proposed rezoning would be consistent with the established zoning and land use patterns in the area. The board also found that the rezoning would not create any adverse impacts on traffic, the environment or future patterns of development in the area. At the Planning Board public hearing held on June 21, 2011, the applicant spoke in favor of the request and one other person had questions about the proposed rezoning. Following your review of this matter, please refer it to the City Council for its consideration.

AGENCY RESPONSES: Assessor: BWL: Building Safety: Code Compliance: Development: Fire Marshal: Parks & Rec.: Public Service: Transportation: No comments or requirements. ANALYSIS COMPATIBILITY WITH SURROUNDING LAND USE The proposed rezoning will have no negative impacts on the surrounding land uses. The current zoning pattern was an attempt to provide a transition between the residential zoning to the west and the commercial zoning to the east. The "J" Parking district was commonly used in the past by the City as a means for limiting the use of specified sections of a parcel for parking only. In this manner, a commercial building or commercial activities exterior to the building (other than parking) could not be located in proximity to an abutting residential use. As evidenced by the attached zoning map, there are a fewl other instances of this transitional zoning pattern on the east side of N. Larch/N. East Streets, although it is unclear as to why this pattern is only used sporadically along the corridor. In some cases, the elimination of transitional zoning and placement of commercial buildings and activities closer to a residential district could have a negative impact on these neighboring uses. In this case, however, the area of the site to be rezoned is adjacent to Gier Park as opposed to a residential use. The proposed rezoning will have no negative impacts on Gier Park. Any construction on the area of the site currently zoned "J" Parking will be required to maintain a 20 foot building setback from the west/rear property line. Furthermore, the subject property is the only commercial property that adjoins Gier Park that includes the "J" Parking transitional strip along its west border. Therefore, the proposed rezoning will actually eliminate an inconsistency in the zoning pattern in this area. No comment.

Page 3

COMPLIANCEWITHMASTERPLAN The Northeast Area Comprehensive Plan, as amended in 1986, designates the subject property for commercial use. Therefore, the request is in compliance with the land use pattern being advanced in the Master Plan. IMPACT ONVEHICULARANDPEDESTRIAN TRAFFIC The proposed rezoning will have no impact on vehicle or pedestrian traffic. ENVIRONMENTAL IMPACT There are no negative environmental impacts anticipated from this request. IMPACTONPUBLICFACILITIES: The subject property is currently served by all necessary utilities. Any future construction will require site plan review at which time the adequacy of the utility systems to accommodate the proposed development will be evaluated. IMPACTON FUTURE PATTERNS OF DEVELOPMENT The proposed rezoning is not anticipated to have any negative impacts on future patterns of development in the area. The rezoning will eliminate a spot zone of "J" Parking which make will make the property more consistent with the zoning pattern that has already been established in the area. In this particular case, the "J" Parking district serves no purpose as a transitional zone, as described above, since the area of the site that is zoned "J" Parking adjoins Gier Park rather than a residential use. Furthermore, none of the other properties in this area that adjoin Gier Park have a "J" Parking buffer. SUMMARY This is a request by Leo J. Trumble III to rezone the rear portion of the property at 2331 N. Larch Street, more specifically described as: N 75 FT LOT 69 & COM NW COR LOT 69, TH E 24 FT, N 112 FT, W 116.4 FT, S 187 FT, E 92.4 FT, N 75 FT BEG; BANGHART SUB, CITY OF LANSING from "J" Parking District to "F" Commercial District. The purpose of the rezoning is to allow for future construction of a building on the area of the site that is currently zoned "J" Parking.

Z-1-2011

601 N. Pennsylvania Avenue

Page 4

The proposed rezoning is consistent with the land use pattern being advanced in the master plan and with the zoning and land use patterns already established in the area. In addition, no adverse impacts on vehicular and pedestrian traffic, the environment or future patterns of development are anticipated to result from approval of this rezoning.

RECOMMENDATION Pursuant to the findings described above, the following recommendation is offered for the Planning Board's consideration: Recommend that Z-2-11 be approved to rezone the portion of the property at 2331 N. Larch Street that is currently zoned "J" Parking District to "F" Commercial District, based on the findings of fact as outlined in this staff report.

Respectfully Submitted, Susan Stachowiak Zoning Administrator

To Whom It May Concern, I am writing this letter for the purpose of appealing the City of Lansing's denial of my claim for a rental property that I own (1229 Dakin). Per the instructions of the notice I received, I am submitting this request to be heard by the City Council. Please use the information below to contact me regarding the steps I need to take.

Thank you,
